Mgr. _5,__ Subnect: •ENCINA JOINT FACILITY - INDEPENDENT MANAGEMENT AND REORGANIZATION Statement of the Matter The five partners of Carlsbad in the ownership of the Encina Water Pollution Facility have written a letter requesting the City Council to reconsider their position of pursuing a change in management of the Encina Facility prior to consideration of a political change in the organization. BROADWAY • VISTA, CALIFORNIA Honorable Mayor Robert Frazee City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 November 4, 1977 Re: Encina Joint Facilities - Independen^^Ll- Management § Reorganization Dear Mayor Frazee: Earlier this month the Reorganization Subcommittee of the Encina Joint Advisory Committee met to discuss the reorganization of the Joint Advisory Committee and establishment of a separate entity. Several days prior to the meeting, each member agency received a letter from you stating that Carlsbad was not willing to pursue the matter of reorganization at this time, but rather propose to first assume local operational control of the Encina Joint Facilities with possible discussions regarding reorganization to follow. It is the intent of this letter to advise the City of Carlsbad that we, the undersigned member agencies of Encina, believe that reorganization should be discussed now, diligently pursued and consummated as soon as possible. It should be pointed out that as member agencies we have not agreed collectively or individually that Carlsbad or any other agency assume the local operation of the Encina Joint Facilities prior to the creation of a single purpose entity for administration, maintenance and operation. Because of the delays that have been experienced in the independent management process, we believe reorganization can and should be accom- plished without first assuming local operation of the Joint Facilities. We solicit Carlsbad's concurrence with our concerns and desires and ask that you give reconsideration to pursuing the proposed reorganization of the Joint Advisory Committee and the establishment of a separate entity. This ob- jective can be changes without changes to existing agreements. Carlsbad will not agree to creation of another special-purpose agency within its boundaries. To create another layer of government, not fully responsive to City Council, would only compound the diffi- culties of managing the City's future growth. Following the assumption of local control of the facility, Carls- bad would agree to negotiate such changes to the existing agreements as would give the JAC the requisite authority to manage the plant. However, it must be understood that Carlsbad will not bargain away those basic rights and privileges which accrue to it as one of the majority stockholders.
