Subject: EXCEPTION TO SEWER MORATORIUM COLONIAL MALL Statement of the Matter Section 18.05.020(10) of the Municipal Code provides for exceptions to the sewer moratorium if the Council makes certain findings. An application has been made by Carlsbad Investment Corporation to make these findings and grant two additional sewer connections within the Colonial Mall development. The two connections will be used for a dental suite within a Colonial Mall lease area which has never before been occupied. The City Engineer's memo of December 7, 1977 discusses the necessary findings to be made by Council so that the request can be approved. This project was listed in a report to the Public Works Administrator prepared by the City Engineer dated August 2, 1977 (copy attached). If Council authorizes these connections, then 21 of the potential 25 connections listed in the August 2, 1977 report will have been granted by Council. MEMORANDUM TO: City Manager FROM: City Engineer DATE: December 7, 1977 SUBJECT: Sewer Connections at Colonial Mall I have reviewed Bob Watson's request for two additional sewer con- nections in the Colonial Mall. These two connections will accommodate a dental office which will occupy the last remaining vacant space within the existing complex. Section 18.05.020(10) of the Municipal Code allows for exemptions provided the Council makes certain findings. Based on available City records and information supplied by Bob Watson, all of the required find- ings can clearly be made. These are: 1. The building permit is for work to be performed within the ex- terior walls and roof of an existing structure. 2. Said structure was constructed pursuant to a building permit issued prior to April 19, 1977. 3. Those portions of the structure for which the building permit would be issued pursuant to this subsection have not been pre- viously occupied. 4. That the purpose of the building permit is to make internal modifications to the structure as necessary to accommodate oc- cupancy by a first user of the space. In light of the above, I recommend that the City Council grant the request. As of September of this year, Colonial Mall, Ltd entered into a lease arrangement with Dr. Dan Petersen and Dr. Bob Sunquist, two long established dentists serving the needs of the City of Carlsbad. 2. That the lease space to be used by the dentist consists of approximately 1200 square feet. This space is the last remaining unused space in the building. 3. We point out again, this last remaining suite had its exterior walls and roofs existing in where the dentist will put in all the necessary leasehold improvements. 4. The building known as Colonial Mall was built in 1973-7^- The needs, in order to carry on a proper medical facility of this nature involving many children and adults, will require the use of two (2) bathrooms as outlined on the attached plan. MEMORANDUM - August 2, 1977 TO: Public Works Administrator FROM: City Engineer SUBJECT: SEWER MORATORIUM - Potential Sewer Connections from Existing Buildings NOT YET FULLY LEASED A telephone survey was conducted last week to determine potential sewer connection demands for buildings recently constructed or under construction that may require additional sewer connections based on requirements of proposed or future tenants. No attempt was made to survey buildings that were fully leased prior to the sewer moratorium. Our existing procedure for determining an "equivalent dwelling unit" (E.D.U.) is based on restroom facilities and does not relate to anticipated sewerage demand. For example, two toilets and two sinks equate to two E.D.U.'s regardless of whether the restrooms are within a 1500 square foot office building or a 4000 square foot sit-down restaurant seating 80 people. Accordingly, the attached list computes E.D.U.'s based on pur current practice and based on the County sewer ordinance which more accurately relates sewage flow to type of use and size of project. (2) ? (2) 52 Attached is a rough draft list of buildings considered as well as excerpts from the County ordinance regarding E.D.U. determination. Based on the 25 additional connections at Lakeshore Gardens, 56 additional connections at Rancho Carlsbad, 5 E.D.U. (Minnich), and 25 proposed E.D.U. from the above list (Total = 111), this number would substantially use up the 130 "available connections." If more realistic data on anticipated flows from the unleased existing buildings is used, the anticipated total is 133 (25 +56+5 +52 = 138). This effectively uses up the 130 available connections.
