COASTAL BIKE ROUTE - COOPERATIVE AGREEMENT
Statement of the Matter
CalTrans has allocated $14,000 under the provisions of SB 283 (Pacific Coast
Bikecentennial Route monies) to help fund construction of bike lanes on
Carlsbad Blvd. Before CalTrans can particiFate in the funding, a Cooperative
Agreement between CalTrans and the City of Carlsbad must be executed.
The balance of funds to complete the project has been authorized by the City
Council in the 1977-78 budget ($34,000) and by the Comprehensive Planning
Organization ($190,492 from Local Transportation Funds).

A FiESOLUTlON OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A COOPERATIVE AGREEMENT BETWEEN THE
CITY OF CARLSBAD AND CALTRANS FOR PARTIAL CONSTRUCTION FUNDING
OF BIKE LANES ON CARLSBAD BOULEVARD AND AUTHORIZING AND DIRECTING
THE CITY MANAGER TO EXECUTE AGREEMENT ON BEHALF OF THE CITY
The City Council of the City of Carlsbad does hereby resolve as follows:
1. That that certain agreement between the City of Carlsbad and
CalTrans for partial construction funding in the amount of $14,000 for bicycle
lanes on Carlsbad Boulevard, a copy of which is attached hereto, marked as
Exhibit 3, and incorporated herein by reference, is hereby approved.
2. That the City Manager of the City of Carlsbad is hereby authorized
and directed to execute said agreement for and on behalf of the City of Carlsbad,
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of
the City of Carlsbad held the 3rd day of January , 1978.

AND ENTERED INTO THIS 3rd

The CITY OF CARLSBAD, a body politic, and a municipal corpora- tion of the State of California,
. hereinafter referred to as "CITY"
The STATE OF CALIFORNIAI acting by and through its Business and Transportation Agency, Depart- ment of Transportation, hereinafter referred to as
"STATE"
WHEREAS, Section 11 of SB 283 CCH 1130/751 authorized the Secretary
of the Business and Transportation Agency to allocate funds to
make improvements on the Bikecentennial Route as designated by
Resolution, Chapter 31 of the 1975-76 Regular Sesaion of the
Legislature, and
WHEREAS, Carlabad Boulevard is located on the Pacific Coast Bike-
centennial Bicycle Route and has been found to be lacking adequate
width for bicycling, and

WHEREAS, the Comprehensive Planning Organization (CPO) has approved
a Iacal Transit Funds (LTF) Claim dated July 18, 1977 to fund con-
struction of bike lanes on Carlsbad Boulevard, and ..
WHEREAS, funds are available under the provisions of Section 11 of
SB 283 CCB 1130175) to participate in the cost of adding the addi-
tional width neceaaary to provide the aforesaid delineated bike lanes,
and
WHEREAS, the Business and Transportation Agency Secretary has approved
and allocated $14,000 for construction of improvements to provide
bike lanee on Carlsbad Boulevard, and
WHEREAS, in consideration of the above premises, it is the desire at
CXTY and STATE to cooperate in the construction of additional width
for bike lonea on Carlsbad Boulevard,
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
STATE AGREES8
1. To participate in the cost for preliminary engineering, construc-
tion engineering, and the cost of constructing additional width OR
Carlsbad Boulevard to accommodate bike lanes, Participation will

1. To incorporate bike lanes in CITY'S contract for construc-
tion of additional width on Carlsbad Boulevard to provide for
bike lanes as illustrated on Exhibit A, dated February 1977,
attached and by this reference made a part of this Agreement.
2. To bear all project costs except for those casts specifically
stated to be borne by STATE in SECTION I of this Agreement.
3. To perform surveys, prepare design plans and specifications as
necessary for completion of the project, and to submj.t said plms and
specifications to STATE for review and approval prior to advertisement
of a contract by CITY for said work.
4. To construct the entire bike lane facilities by contract in
accordance with the aforementioned plans and specifications, and to
accept payment by STATE aB provided in SECTION I as payment in full
for STATE'S share of cost far preparation plans, Specifications, and
for construction of the bikelanes as shown on Exhibit A.

1. That the design, construction and delineation of the bike lanes
shall conform to the criteria and specifications established by

tion of bikeway in California,
2. That, should any portion of the project be financed with
Federal Funds, or State gas tax funds, all applicable procedures
and policies relating to the use of such funds shall apply not-
withstanding other provisions of this Agreement,
3. CITY shall indemnify, de€end and save harmless STATE and each
and all its agents, officers and employees from any and all claims,
suits and actions of every name, kind and description brought for or on
account of injuries to or death of any person or damage to property
