The Adoption of the 1976 Edition of the
'Uniform Building Code —
Statement of the Matter
To adopt by reference the 1976 Edition of the Uniform
Building Code.
Presently the City of Carlsbad is working under and enforcing
the 1973 Edition of the Uniform Building Code.
The new 1976 Edition of the Uniform Building Code reflects
certain changes, additions, and amendments.
The Building.Inspection Department is anxious to proceed
with the adootion of the new code. The new code with its
proposed amendments has been reviewed by the members of the -
Advisory and Appeals Board at a regular meeting on November 14,
1977. It has also been reviewed and recommended for uniformity
by all San Diego jurisdictions and the San Diego Area Chapter
of the International Conference of Building Officials. -
Exhibit
Ordinance No. P.077 adopting the 1976 Edition of the
Uniform Building Code.
Recommendation
The Building Department recommends the adoption of the 1976
Edition of the Uniform Building Code. If Council concurs, your
action is to read the title of the attached ordinance and then,
by motion, set a public hearing to consider its adoption. The
hearing should be set at least 15 days from the date of this
meeting. The City Clerk should be directed to publish the
required notices containing the statement that copies of the
.ordinance adopting the code and the code are on file with the
.Clerk and available to the public. 'Notice should also contain
'a description of the purposes and subjedt of the ordinance
and the code.' \

ORDINANCE NO. 8077
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18,
CHAPTER 13.04 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTIONS 18.04.005, 18.04.020,
18.04.029, 18.04.030 AND 18.04.100, BY DELETION OF
SECTION; 1,8.04.045, 18.04.055, 18.04.075, 18.04.080,
18.04.OF 2 18.04.105, 18.04.110, 18.04.115 AND
18.04.120 AND BY THE ADDITION OF SECTIONS 18.04.075
AND 18.04.080 TO ADOPT BY REFERENCE THE 1976 EDITION
OF THE UNIFORM BUILDING CODE SUBJECT TO CERTAIN
AMENDMENTS.
The City Council of the City of Carlsbad, California, does
I ordain as follows:
SECTION 1: That Title 18, Chapter 18.04 of the Carlsbad
Municipal Code is amended by the amendment of Sections 18.04.005,
18.04.020, 18.04.025, 18.04.030 and 18.04.100 to read as follows:
"18.04.005 Adopted. The Uniform Building Code, 1976 Edition,
copyrighted by the International Conference of Building Officials,
is hereby adopted by reference as -the City of Carlsbad Building
Code for the purpose of prescribing regulations in the City of
Carlsbad, County of San Diego, for the erection, construction,
enlargement, alteration, repair, removal, conversion, demolition,
occupancy, equipment, use, height, area and maintenance of build-
ings and structures, including the appendix thereto, except for
the following changes, additions and amendments which shall super-
sede the provisions of said code.
18.04.020 Section 301(a) amended --Permits. Section 301(a)
of the Uniform Building Code is amended to read:
'No person, firm or corporation shall erect, construct,
enlarge, alter, repair, move, improve, remove, convert or demolish
any privately -owned building or structure in the city, or cause
the same to be done, without first obtaining a separate building
permit for each such building.or structure from the Building
Official except the following:
(1) Fences and free-standing walls and planter boxes not
exceeding six feet in height and not located in established setbac
areas, front setback areas or established sideyard areas that are
adjacent to street.
(2) Curbs, retaining walls and planter boxes not exceeding
twenty-four inches in height.
(3) Storage buildings up to 100 square feet and at .least
ten feet from any other building on the same property.
(4) Television and radio antennas supported on roofs.
(5) Awnings projecting up to six feet and attached to the
exterior walls of buildings of Group I or J occupancy.

(6) Standard electrolier not over thirty-five feet
in height above finish grade.
(7) Repairs which involve only the replacement of component
parts or existing work with similar.materials for the purpose of
maintenance and do not affect any electrical or mechanical
installations. Repairs exempt from permit requirements shall not
include any addition, change or modification on construction,
exit facilities or permanent fixtures or equipment. Specifically
excepted from permit requirements without limit to valuation are:
(a) Painting and decorating.
(b) Installation of floor covering.
(c) Cabinet work.
(d) Outside paving.
This section shall not be construed to require separate
building permits for a dwelling and auxiliary buildings or
structures on the same property which are described in the build-
ing permit application, plot plan and other dra-ings.
(8) Reroofing on buildings of I and J occupancy in Fire
Zone 3 (rated Roof -permit).'
-•18.04.025 Section 302(a)'amended -- Building Permit Issuance.
Section 302(a) of the Uniform Building Code is amended to read:
'The application, plans and specifications filed by an
applicant for a permit shall be checked by the Building Official.
Such plans may be reviewed by other departments of the city to
check compliance with the laws and ordinances under their juris-
diction. If the Building Official is satisfied that the issuance
of the permit is authorized by Chapter 18.05 of this code, that
the work described in an application for permit and the plans
filed therewith conform to the requirements of this code and other
pertinent laws and ordinances and that the fee specified in this
chapter has been paid, he shall issue a permit therefor to the
applicant. In the case of new building, all fees required for
connection to public water systems and to sewer systems provided by
entities other than the City must be paid or a bond posted before
the permit is issued.
When the Building Official issues the permit, he shall
endorse in writing or stamp on both sets of plans and specificatioi
"Approved". Such approved plans and specifications shall not be
changed, modified or altered without authorization from the Build-
ing Official, and all work shall be done in accordance with the
approved plans.
The Building Official may issue a permit for the construction
of part of a building or structure before the entire plans and
specifications for the whole building or structure have been
submitted or approved, provided adequate information and detailed
statements have been filed complying with all pertinent require-
ments of this code. The holder of such permit shall proceed
at his own risk without assurance that the permit for the entire
building or structure will be granted.'

18 04 030 Section 302(d) amended --Expiration. Section 302(d)
)f the Uniform Building Code is amended by the addition of the
.ollowing:
'Notwithstanding any other provisions of this section, no
permit shall expire by limitation and become null and void by
reason of failure to commence work authorized by such permit

The provisions of any sewer allocation system adopted
pursuant to Chapter 18.05 of this code shall supersede Section 302
(d) of the Uniform Building Code if the permit is issued pursuant
to such system.'
18.04.100 Section 3203(d)(3)"I" added-- Reroofing. Section
3203(d)(3) of the l'Jniform 11 Building Code is amended by the addition
of subsection "I" to read:
.'I.' Reroofing. The minimum built-up reroofing shall be not
less than two layers .of 15-pound organic fiber felt applied as
required for base sheets and one

nailed unless the deck is nonnailable.
Existing roofing on nonnailable roof decks shall be completely
removed prior to the application of a new roof.
Existing gravel roofs shall be scraped off and the roof
swept broom clean. Any existing metal gravel stop shall be
stripped clean or replaced, except where the reroofing material
will be shingles.'
SECTION 2: That Title 18, Chapter 18.04 of the Carlsbad
Municipal Code is amended by the deletion of Sections 18.04.045,
10.04.055, 18.04.075, 18.04.080, 18.04,085, 18.04.105, 18.04.110
18.04.115 and 18.04.120.
SECTION 3: That Title 18, Chapter 18.04 of the Carlsbad
Municipal Code is amended by the addition of Sections 18.04.075
and 18.04.080 to read as follows:

13. Toilet rooms containing facilities for the physically
disabled shall be of a configuration that will allow access to
toilet facilities. Dimensions giving access to such toilet
facilities shall be not less i.'., the following:
(i) Aisle width to toilet stool or toilet compartment--
36 inches.
(ii) Entry width to toilet compartment--30 inches when
located at the end; 34 inches when located at the side.
(iii) Toilet compartment width--51 inches.
(iv) Clear space in front of toilet stool--30 inches.
(v) Clear space on one side of toilet stool--28 inches.
Doors installed on such toilet -compartments shall swing out except
where the dimensions of the compartment are increased to allow for
encroachment of the door swing.'
18.04.080 Section 1711(c) Item 3, amended -- Toilet Room
Facilities. Section 1711(c) item 3, is amended to read:
13. Where towel and disposal fixtures are provided, they
shall be accessible to the physically disabled and at least one
shall be within 40 inches of the floor.'"
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.

RE: ADOPTION BY REFERENCE
OF THE 1976 EDITION OF THE
UNIFORM BUILDING CODE
NOTICE IS HEREBY' GIVEN that the City Council of the City of Carlsbad I
will hold a Public Hearing on Tuesday, March 7, 1978, in the City I
Council Chambers, 1200 Elm Avenue, Carlsbad, California, at 7:00 P.M.
to consider the adoption of Ordinance No.8077, which amends Title 18,
Chapter 18.04 of the Carlsbad Municipal Code by the amendment of Sec-
tions 18.04.005, 18.04.020, 18.04.025, 18.04.030 and 18.04.100, by
deletion of Sections 18.04.045, 18.04.055, 18.04.075, 18.04.080,
18.04.085, 18.04.105, 18.04.110, 18.04.115 and 18.04.120 and by the
addition of Sections 18.04.075 and 18.04.080 to adopt by reference
the 1976 Edition of the Uniform Building Code subject to certain
amendments. The purpose and subject matter of said Ordinance is
to prescribe regulations in the City of Carlsbad, County of San
Diego, for the erection, construction, enlargement, alteration,
repair,removal, conversion, demolition, occupancy, equipment, use,
height, area and maintenance of buildings and structures, including
the appendix thereto, except for the specified changes, additions
and amendments which shall supersede the provisions of said Code.
Copies of the 1976 Edition of the Uniform Building Code and of the
Ordinance adopting said Code are on file in the Office of the
City Clerk of the City of Carlsbad, 1200 Elm Avenue, Carlsbad,
California, and are open to public inspection.
