Recently, the County adopted amendments to their Animal regulations and zone
ordinance for the keeping of wild animals and private zoos. The County has
requested that the City of Carlsbad adopt similar regulations. Mr. Encil Rains,
Director, Animal Control, plans to make a presentation to the City Council on
this matter.
The County Animal regulations are adopted by the City by reference (7.08.040).
Therefore, the attached County amendment is automatically adopted by the City.
(See County Ordinance 4986). In addition to amendments to the amended
regulation, the County also amended its zone ordinance (See County Ordinance 5021)
to provide for the keeping of one wild animal in any zone, and increasing the
minimum number of wild animals to two for private zoos.
If the City Council wishes to continue with County animal services, staff suggests
amending our zone code to be consistent with the County's changes. These changes
are contained in staff memo to City Manager dated February 22, 1978.

RECOMMENDATION
It is recommended that the City Council direct the City Attorney to prepare
an Ordinance amendment regulating wild animals and private zoos as indicated
in the memo to the City Manager, dated February 22, 1978, and to submit the
Zone Code Amendment to the Planning Commission for public hearing.

SUBJECT: Wild Animal and Appropriate Zoning Ordinances
By January 5, 1978, all ordinances relating to the keeping of
wild animals as pets or in a private zoo are in effect. A
copy of the County ordinances on the permit system, change
to the appeal board, and zoning has been enclosed.
Basically and briefly, anyone now owning one (1) wild
animal can apply to the Department for a permit to keep it.
If two (2) or more are owned (or in one's possession) the
owner must go the route of applying for a special use permit
from LUER. An appeals route exists for denied permits.
It is suggested these changes be brought before your Council
for appropriate discussion and adoption. They are recommended
as the course of action to take to attempt to cope effectively
with what are.now illicitly held wild animals.
To make a presentation to this effect and to answer questions,
I am at your call to appear before your Council. Given
reasonable notice, there should be no conflicts in schedules.
Your secretary may call mine and confirm a schedule or if
you wish to discuss it with me, I stand ready and available
to you.

SUBJECT: Wild Animal Regulations, reference Letter from Encil Rains.
Director, Department of Animal Control, dated January 4, 1978
Presently, the City of Carlsbad has no regulations on wild animals except as
adopted by reference of the San Diego Code. (See Section 7:08:,010)
The referenced County Code and the County Zoning Ordinance have recently been
amended to include a distinction between keepina of wild animals and a private
zoo. The County now will allow the keeping of one wild animal upon approval
of a wild animal permit, while the keeping of two or more wild animals
would be considered a private zoo, which is limited to specific zones. So there
will be uniformity in regulations between the Cities and the County, and the
fact that the County presently regulates wild animals in the City of Carlsbad,
the Department of Animal Control has requested that the City of Carlsbad also
amend the zoning code to be uniformed with the County's new codes.
The County's new zone amendment adds a section 506.5 -- Wild Animals, which
is as follows:
Section 506.5. WILD ANIMALS. Wild animals for which a wild
animal permit is required and has been issued pursuant to
Section 62.631 of the County Code, may be kept in any zone, provided :
the keeping of such wild animals does not constitute the establish-
ment or maintenance of a private zoo. Private zoos may be established -
or maintained only in those zones where they are specifically
authorized.
This section is within the general provisions of the County Zone Code, and
therefore permits wild animals in any zone of the County. As follow-through,
the County also has amended its definition of private zoo to include two
or more animals. It is as follows:
Section 128. ZOO, PRIVATE. "PRIVATE ZOO" shall mean any lot,
building, structure, enclosure or premises whereupon or
wherein are kept by any person, other than a municipal corpora-
tion, the United States, the State of California, or any
political subdivision thereof, two (2) or more wild animals,
whether such keeping if for pleasure, profit, breeding, or
exhibiting, and including places where two (2) or more wild
animals are boarded, kept for sale, or kept for-hire.
Therefore, one wild animal may be kept in any zone pursuant to County approval
through County Section 62.681. Two or more wild animals is considered a
private zoo and permitted only in certain specified zones. Presently, in the
County Code, I could find only private zoos permitted in the Open-Space zone
by special use permit.
To be consistent with the County, we would need to add to the Uses Generally
that wild animals are permitted in any zone provided it is not a private zoo and
there is a valid county wild animal oermit. In addition, we would need to adopt
the County's definition for a private zoo. The animal section of the code, under
Title 7, appears to be adequate to cover the recent County Amendment Animal
Regulations. However, a question does arise where the City of Carlsbad would
permit a private zoo. We do have an Open Space zone, but it is very limited in
its application, especially to private property. Furthermore, there is a private
zoo now operating in the City within the P-C zone. (Dr. Murphy, El Camino Real
and Batiquitos Lagoon) It may be more appropriate to regulate zoos by design
and location rather than zone. Such regulation can be done through the
conditional use permit process with requirements for minimum lot size and
distances between animals and buildings for human habitats and property lines.
RECOMMENDATION
I recommend that the City Council direct the City Attorney to prepare ordinance
amendments as follows:
1) Section 21:44:085 — Wild Animals: The keeper of a wild animal for which
a wild animal permit has been issued pursuant to Section 62.681 of the
County Code, may be kept in any zone, provided the keeping of such wild
animal does not constitute establishment or maintenance of a private zoo.
Private zoos may be established or maintained only as stipulated in Section
21:42:010.
2) Amend Section 21.42.010, subparagraph 2, by adding (k) as follows:
Private zoos, the property for such private zoo has a minimum of
20,000 square feet, no animal is kept within 20 feet from any property
line, and a valid wild animal permit has been issued pursuant to
Section 62.681 of the County Code.
3) Adopt the definition for Private Zoo, as follows:
Section 21.04.400. ZOO, PRIVATE. "PRIVATE ZOO" shall mean any
lot, building, structure, enclosure or premises whereupon or
wherein are kept by any person, other than a municipal corpora-
tion, the United States, the State of California, or any
political subdivision thereof, two (2) or more wild animals,
whether such keeping if for pleasure, profit, breeding, or
exhibiting, and including places where two (2) or more wild
animals are boarded, kept for sale, or kept for hire.
