Subject: GENERAL MUNICIPAL ELECTION - March 7, 1978 Declaring results of election Statement of the Matter * Canvassing of the Ballots was comp.leted on March 10, 1978 and the results have been certified by the City Clerk. Exhibits 1 .. Resolution #5340, declaring the result of the election with certi f ica-tion by City Clerk attached. Recommendation: Adopt Resolution #5340, declaring the result of the election. Council action 3-8-78 Resolution No. 5340 was adopted,-reciting the fact of the General Municipal Election held in said City of Carlsbad on the 7th day of March 1978, declaring the result thereof and such other matters as are provided by law. 1 RESOLUTION NO. 5340 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECITING THE FACT OF 3 THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF CARLSBAD ON THE 7TH DAY OF MARCH 1978, DECLARING 4 THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAN. .5 - : 6 WHEREAS, a regular general municipal election was held and 7 conducted in the City of Carlsbad, County of San Diego, State of 8 California, on Tuesday, the 7th day of March, 1978, as required 9 by law; and 10 WHEREAS, notice of said election was duly and regularly 11 given in time, form and manner as provided by law; that voting 12 precincts were properly established; that election officers were 13 appointed and that in all respects said election was held and 14 conducted and the votes cast thereat, received and canvassed and 15 the returns made and declared in time, form and manner as required 16 by the provisions of the Elections Code of the State of California 17 for the holding of elections in cities; and 18 WHEREAS, pursuant to Resolution No. 5309 adopted the 21st 19 day of February, 1978, the City Clerk of the City of Carlsbad 20 canvassed the returns of said election and has certified the re- 21 suits to this City Council, said results are received, attached. 22 and made a part hereof as "Exhibit A." 23 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, 24 CALIFORNIA, DOES RESOLVE AS FOLLOWS: 25 SECTION 1. That there were 26 voting precincts established 26 for the purpose of holding said election consisting (of consoli- 27 dations) of the regular election precincts in the City of 28 . Carlsbad as established for the holding of state and county 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the laws relating to cities in the State of California, to wit: Mayor of said City for the full term of four years; One member of the City Council of said City for the full term of four years; A City Clerk of said City for the full term of four years; A City Treasurer of said City for the full term of four years; SECTION 3. That at said regular general municipal elec- tion, the following measure was submitted to the electors of said City, to wit: SAN MARCOS UNIFIED SCHOOL DISTRICT BOND Shall bonds of the District be issued and sold to •the amount of $20,000,000.00 for the purpose of raising money for the following purposes (which are united and shall be voted upon as a single proposition)? (1) The building or purchasing of school buildings. (2) The making of alterations or additions to the school building or buildings other than such as may be necessary for current maintenance, operation, or repairs. (3) The supplying of school buildings and grounds with furniture, equipment, or necessary apparatus of a permanent nature. (4) The permanent improvement of the school grounds. (5) The purchasing of school sites. (6) The carrying out of the projects or purposes authorized in Section 39613 of the Education Code (sewers and drains). SECTION 4. That the whole number of votes cast in said City (except absent voter ballots) was 5203. That the whole number of absent voter ballots cast in said City was 116, making a total of 5319 votes cast in said City. (2) 1 SECTION 5.. That the names of persons voted for at said 2 election for Mayor are as follows: 3 ' Ronald C. Packard Anthony J. Skotnicki Allen C. Bowen 5 Allison E. Gilbert ^ That the names of persons voted for at said election for n Member of the City Council of said City are as follows: 8 Girard "Lefty" Anear 9 Claude "Bud" Lewis 10 That the names of the persons voted for at said election 11 for City Clerk of said City are as follows: 12 Maragaret E. Adams 13 That the names of the persons voted for at said election 14 for City Treasurer of said City are as follows: 15 Frank C. Rice 16 That the measure voted upon at said election is as 17 follows: 18 SAN MARCOS UNIFIED SCHOOL DISTRICT BOND 19 That the number of votes given at each precinct and the 20 number of votes given in the City to eaclrof such persons above 21 named for the respective offices for which said persons were 22 candidates and for and against the measure were as listed in 23 Exhibit "A" attached. 24 SECTION 6. The City Council does declare and determine 25 that: 26 RONALD C. PACKARD was elected as Mayor of said City for 27 the full term of four years; 28 . GIRARD "LEFTY" ANEAR, was elected as Member of the City (3) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Council of said City for the full term of four years; MARGARET E. ADAMS was elected City Clerk of said City for the full term of four years; FRANK C. RICE was elected City Treasurer of said City for the full term of four years; That as a result of said election, a majority of the qualified voters voting on said measure relating to San Marcos Unified School District, did not vote in favor thereof, and that said proposition was not carried, and shall not be deemed adopted and ratified. SECTION 7. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: (1) The whole number of votes cast in the city; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each ' person, and for and against each measure; (6) The number of votes given in the city to each person, for and against each measure. SECTION 8. That the City Clerk shall immediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office (4) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to which they have been elected. SECTION 9. That the City Clerk shall certify to the pass- age and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. PASSED, APPROVED AND ADOPTED at an adjourned regular meeting of the City Council of the City of Carlsbad, California, held on the 14th day of March . 1978, by the following vote, to wit: AYES: NOES: ABSENT: None Councilmen Frazee, Lewis, Skotnicki and Councilwoman Casler None /ROBERT C.
