Mgr. 3 Processing of Calavera Hills Proposed Sewage Treatment Fgc i 1 ity Subject: ~ -~ Statement of the Matter Many complex issues have arisen concerning the processing of Calavera Hills proposal to construct a satellite sewage treatment facility. Staff feelsit is necessary to apprise Council of these issues. It is suggested that this matter be discussed at a work session on March 28, 197%. Staff will have a written report prior to that date. In the interest of processing in a positive manner, and in a way that all of the City's con- cerns can be answered satisfactorily, we are submitting a pro- posed processing schedule along with a suggested format for hearings on this matter. It has become apparent to us, and, we believe, to members of your Staff, that policy direction in this matter should now coxe from the City Council on how best to proceed. In our judgment, two major decisions must be made by your body if Lake Calavera Hills is able to proceed with its first development. The first is a decision by the Council on what constitutes a feasible alternative waste water treatment facility for future projects in Carlsbad (i.e., what alternative or alternatives are acceptable). evaluation of a specific proposal (i.e., Lake Calavera Hills project). To assist the Council in determining a feasible alternative, City Staff, in conjunction with Lowry & Associates, have prepared a report entitled "Overview of Waste Water Treatment Opportunities in the City of Carlsbad". waste water treatment facilities in Carlsbad could be a feasible alternative. Assuming the policy decision on the alternative system is a positive one, the next step would be to analyze, and eventually decide on specific proposals such as the Lake Calavera Hills project. While we concur with the City Staff that the ordinances are un- clear on how best to proceed in this area, we believe that a reasonable interpretation of the ordinance does give a rational approach that meets the intent and purpose of the City's code (i.e., assuring that future projects are compatible with existing land uses , are environmentally sound and meet City development standards). The proposed location of the satellite waste water treatment facility in Lake Calavera Hills is in a designated open space area (based on the existing Master Plan for the property). Secondly, the existing Master Plan is currently undergoing tech- nical changes principally to allow the plan to conform to recent changes in the ordinance (i.e., no changes are proposed in land use designations). Prior to approval of these technical changes, uses are permitted in P.C. areas subject to the provisions of the E-A exclusive agricultural zone. Both designated open space areas and E-A zones permit the location of public utility facil- ities subject to the filing of a Conditional Use Permit. We believe this would be an appropriate vehicle to have our specific proposal come before the Planning Commission and City Council. We are aware that Conditional Use Permits normally do not come before the City Council.
