Amendment to Ordinance No. 9495 to Exempt R-2 Conversions
from -Moratorium, Subject to Certain Conditions
Statement of the Matter
On March 7, 1978 the City Council considered a request to amend
Ordinance No. 9495 to exempt conversion of duplexes to condominiums
in the R-2 Zone.
An amendment to Ordinance No. 9495 in this regard should require that
the following conditions shall be met prior to recording of the final
Minor Subdivision Map:
1. Driveways and uncovered parking stalls shall be paved with a
minimum of two inches of asphalt concrete in four inches of
decomposed ground. Wheel stops shall be placed two and one-half
feet from the end of Bach parking stall that abuts walls, buildings,
walkways, or sidewalks.
2. Outdoor recreation area shall not be less than 700 squarem-feet per
unit. This area shall be usable for active recreation or patio use.
3. Separate gas and electric service shall be•required for each unit.
Meters may either be at the unit or an easily located cluster.

4. Separate water meters shall be required for each unit.
S. Separate laundry facilities of sufficient size to allow for the
installation of a clothes dryer and washer shall be provided in
each condominium unit. If provided for in the garage, it shall
not encroach into the required parking space.

Recommendation
If Council concurs with the conditions to be met, direct City Attorney
to prepare appropriate documents.

SUBJECT: Conversion to Condominium Conditions
Recently the City Council adopted a moratorium on condominium
conversions and directed staff to prepare standards for development
of condominiums and for condominium conversions. The first draft
of this ordinance amendment has been completed and reviewed by the
interested departments. The final staff version is presently being
prepared for Planning Commission hearing.
At your last meeting City Council directed the City Attorney to
prepare an exception to the moratorium for duplexes in the R-2 zone
as per staff recommendation. In drafting this exception staff is
suggesting that conversion of duplexes are permitted provided certain
conditions are met. These conditions are based on the draft
condominium ordinance now being prepared by staff, and are contained

These conditions should be easily met by all new duplex developments.
However, some of the older duplexes possibly would not be able to meet
some of these conditions. Therefore, these conditions generally will
permit condominium conversions of new duplexes while retaining the
moratorium on older units.
