SubJect: Amendment to Ordinance No. 9495 to Exempt R-2 conversions
from Moratorium, subject to certain conditions.
Statement of the Matter
The City Council at their March 21, 1978 meeting directed
the City Attorney to prepare an ordinance exempting R-2
conversions from the moratorium on condominium conversions
subject to certain conditions in the ordinance, including
the five.conditions as recorru~ended by the Planning Depart-
m~nt ~nd approved by the City Council. An ordinance in
that regard is attached.

AN ORDINANCE OF '!'HE CITY COUNCIL OF· THE
CITY OF CARLSBAD, CALIFORNIA, AMENDlNG
ORDINANCE NO. 9495 TO EXEMP.T R-2 CONVERSIONS
FROM THE MORATORIUM ON THE PROCESSING OF
SUBDIVISIONS FOR THE CONVERSION OF EXISTING
STRUCTURES TO CONDOMINIUMS.
WHEREAS, the City Council has by the adoption of Ordinance
7 No. 9495 declared a citywide mo~atorium on the processing of
a subdivision maps for the conversion of existing structures to
9 condominiums; and
10 WHEREAS, the City Council has determi11ed that pending the
ll development of a condominium conversion ordinance, the processing
12 of conversions on R-2 lots can be allowed to continue subject to
13 certain conditions without adversely affecting the purposes to
14 be achieved by the adoption of such ordinance.
15 NOW, THEREFORE, BE IT ORDAI-NED by the City Council of the
lo City of Carlsbad, California, as follows:
17 SECTION 1: That Section 1 of Ordinance No. 9495 is amended

"This ordinance shall also not apply to applications for
for subdivisions to convert duplexes in the R-2 zone to
condominiums provided applicant agre~s that the following
conditions shall be fulfilled prior to approval of the
final map:
1. Driveways and uncovered parking stalls shall be paved
with a minimum of two inches of asphalt concrete in
four inches of decomposed ground. Wheel stops shall be
placed two and one-half feet from the end of each
parking stall that abuts walls, buildings, walkways, or
sidewalks.

2. Outdoor recreation area shall not be less than 700
square feet per unit. This area shall be usable for
active recreation or patio use.
3-Separate gas and electric service shall be required
for each unit. Meters may either be at the unit or'an
easily l1cated cluster.
4. Separate water meters shall be required for each ,unit.
5. Separate laundry facilities of sufficient size to allow
for the installation of a clothes dryer and washer
shall be provided in each condominium unit. If pro-
vided for in the garage, it shall not encroach into
the required parking space.
9 EFFECTIVE DATE: This ordinance shall be effective thirty
