J Subject: ADOPTION BY REFERENCE OF THE COUNTY CODE ON RABIES, ANIMAL CONTROL AND REGULATION Statement of the Matter The City Council at your March 7, 1978 meeting directed the City Attorney to prepare the necessary ordinance to bring our code into accord with the new County regulations on wild animals and zoos. After review it appears the changes are extensive enough that it is advisable to readopt the County Code as amended by reference rather than including amendments in our Municipal Code. An ordinance in that regard is attached. The County's changes also necessitated amendment to certain zoning ordinances. The appropriate ordinance has been prepared and forwarded to the Planning Department with a request that they set the matter to hearing before the Planning Commission. Exhibit Ordinance No. 3// 4 - Recommendation If the City Council concurs, your action is to read the title of the attached ordinance and then, by motion, set a public hearing to consider its adoption. The hearing should be set at least 15 days from the date of this meeting. The City Clerk should be directed to publish the required notices containing the statement that copies of the ordinance adopting the code and the code are on file with the Clerk and available to the public. Notice should also contain a description of the purposes and subject of the ordinance and the code. Council action 4-4-78 Title to Ordinance #3110 was read, adopting by reference Chapter 6, Division 2, of Title 6 of the San Diego County Code regarding Rabies, Animal Control and Regulation, and the matter set to public hearing on May 2, 1978. S-16-78 A second reading was given Ordinance #3110 and adopted, In addition, staff to furnish Council with a report as to the County's current method of disposing of animals, and the possibility of changing same. NOTICE OF PUBLIC HEARING RE: ADOPTION BY REFERENCE OF THE COUNTY CODE ON RABIES, ANIMAL CONTROL AND REGULATION. NOTICE IS HEREBY GIVEN the the City Council of the City of Carlsbad will hold a Public Hearing on Tuesday, May 2, 1978, in the City Council Chambers, 1200 Elm Avenue, Carl'sbad, California, at 7:00 P.M. to consider amending Title 7, Chapter 7.08, by the amendment of Section 7.08.010 to adopt by reference Chapter e Division 2, of Title 6 of the San Diego County Code providing for Rabies, Animal Control and Regulation. - ORDINANCE NO. 3110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 7, CHAPTER 7.08, BY THE AMENDMENT SECTION 7.08.010 TO ADOPT BY REFERENCE CHAPTER 6, DIVISION 2, OF TITLE 6 OF THE SAN DIEGO COUNTY CODE REGARDING RABIES, ANIMAL CONTROL AND REGULATION. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 7, Chapter 7.08 of the Carlsbad Municipal Code is amended by the amendment of Section 7.08.010 to read as follows: "7.08.010 Adopted by reference - Rabies, Animal Control and Regulation. Title 6, Division 2, Chapter 6 of the San Diego County Code of Regulatory Ordinances, as adopted by San Diego County Ordinances through No. 5003(N.S.) providing for Rabies, Animal Control and Regulation, is adopted by reference and incorporated as part of this code except wherever the provisions thereof'refer to a County of San Diego board, territory, area, agency, official, employee or otherwise, it shall mean the corresponding board, territory, area, agency, official, employee or otherwise of the City of Carlsbad and if there is none, it shall mean that the County is acting in the same capacity on behalf of the City of Carlsbad." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. C INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 2nd day of May I 1978 and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held on the 16th day of May , 1978, by the following vote, to wit: AYES: NOES: Councilmen Packard, Skotnicki, Anear and Councilwoman Casler None ABSENT: None (iiszJ4d @q RONALD C.
