C, Mgr- K, Subject: PUBLIC HEARING J PROPOSED UNDERGROUND UTILITY DISTRICT NO. 6 Statement of the Matter The City Council by adoption of Resolution No. 5347 called for a public hearing at 7:30 p.m. on the proposed underground utility district. of the hearing have been mailed to affected property owners and utility com- pan i es as requ i red by ord i nance. If the district is formed, San Diego Gas & Electric ,wi 1 I prepare plans, ob- tain permits and start construction in January, 1979. The dates when prop- erties must disconnect from the overhead lines and when the lines will be removed will be established by the City Council when a definite construction schedule has been established. The estimated cost of the project is $445.,000, not including customer con- versions (paid by property owners). Funds allocated by San Diego Gas.& Electric in the amount of $460,000 will be available for expenditure in January, 1979. These funds will include the allocation for calendar year 1979. REQUIRE THE FORMATION MADISON, JEFFERSON AND HAWING STREETS OF AN UNDERGROUND UTILITY DISTRICT ON GRAND AVENTJE, WEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides for the formation in the City of Carlsbad of underground utility districts to accom- plish the orderly removal of existing overhead facilities and the construction of new underground facilities; and WHEREAS, the City staff has consulted with the affected utilities and has conducted preliminary studies and made investigations concerning the feasibility of such a district in an area generally on Grand Avenue, Madison, Jefferson and Harding Streets; and WHEREAS, said studies and investigations indicate that further proceed- ings pursuant to Chapter 11.08 are warranted to determine whether or not the district should be established; NOW, THEREFOREy BE IT RESOLVED by the City Council of the City of Carlsbad, as follows : 1. The Council hereby expresses its intent to initiate proceedings for the formation of an underground utility district for the above-described area to be known as Underground Utility District No. 6. 2. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Carlshad on April 18, 1978 at the hour of 7:30 p.m in the Council Chambers of the City Hall, Carlsbad, California, to ascertairi whether the public health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures, and the underground in- stallation of wires and facilities for supplying electric, communication or similar associated service in the area hereinabove described and to determine 1 2 3 4 5 6 7 8 9 10 . 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "ihether or not the City should continue ijroceedings to create and implement an inderground utility district to accomplish said removal and installation. 3. At said hearing all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 4. The area to be included within the proposed District No. 6 is shown upon that certain map, entitled "Map of Proposed Underground Utilities District No. 6", dated March 17, 1978, which is on file in the office of the City Clerk Df the City of Carlsbad, and which is incorporated by reference herein. 5. The City Clerk shall give notice of the time'and place of the hearing to all property owners within the District as shown on the last equalized as- sessment rolls or as known to the City Clerk and to each public utility within the District by mailing a copy of this Resolution to such property owners and such utilities at least ten (10) days prior to the date thereof. PACURD, Mayor ATTEST: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5383 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, OF SAID CITY AS UNDERGROUND UTILITY DISTRICT NO. 6 AND MAKING ORDERS IN REGARD THERETO CALIFORNIA, DECLARING AND DESIGNATING A CERTAIN PART WHEREAS, on March 21, 1978, the City Council of the City of Carlsbad adopted Resolution No. 5347 expressing its intent to initiate proceedings pursuant to Chapter 11.08 of the Carlsbad Municipal Code and calling a public hearing to determine whether or not the public health, safety or welfare re- quires the formation of an underground utility district in a portion of Carls- bad; and WHEREAS, pursuant to Resolution No. 5347, a public hearing was held on April 18, 1978, at the hour of 7:30 p.m., in the Council Chambers in the City Hall, Carlsbad, California, to ascertain whether the public health, safety or we1 fare requires the removal of poles, overhead wires and assochted overhead installation of wires and facilities for sup- or similar or associated service, within that bed as follows: structures and the underground plying electric, communication certain area of the City descr Grand Avenue from the easterly boundary of Underground Utility District No. 4 to the westerly right-of-way line of Hope Avenue; Madison, Jefferson and Harding Streets from the northerly boundary of Underground Uti I ity Di s- trict No. 2 to the northerly boundary of the district as shown on that certain map entitled "Map of Proposed Under- ground Utility District No. 6", dated March 17, 1978, on file in the Office of the City Clerk and incorporated by reference herein. That the above recitations are true and correct. 2. That the Council of the City of Carlsbad hereby finds and determines that the public health, safety and welfare require the removal of poles, over- head wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in the above-described area. 3. That said area is hereby declared to be an underground utility dis- trict, and is designated as Underground Utility District No. 6 of the City of Carlsbad. is a map delineating the boundaries of said Distrlct. Attached hereto, as "Exhibit A" and incorporated by reference herein 4. That the City Council finds that said District is in the public in- terest for one of the following reasons: A. by the general public and carry a heavy volume of pedestrian or vehicular traffic. B.
