Mgr. 5 Subject: APPROVING TEMPORARY SEWER EASEMENT Statement of the Matter The City operates two lift stations which pump in series on Sunnyhill. stations are eighteen years old and maintenance requirements are extremely high. Recent development has completed constructi.on of a sewer in Hillside Drive, which is approximately 600 feet from the end of Sunnyhill. Corporation owns the intervening property. (Schematic diagram is at Exhibit A). Pannonia Investment has agreed to grant a temporary easement for t!ie installation of a temporary sewer line connecting the Sunnyhill Lift Station and the Hillside sewer line, thus allowing sewerage to gravity flow. This will allow the lift stations to be placed in an inactive status, thus reducing the maintenance costs. The agreement provides that the City will abandon/remove the temporary sewer line when development occurs on the Pannonia Properties. that time provide for the permanent connection between Sunnyhi 11 and Hi 11 side. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That a certain agreement between the City of CarJsbad, Cal i forni a , and Pannoni a Investment Corpora tion for a temporary sewer easement, a copy of which is attached hereto marked Exhibit "A" and made a part hereof, is hereby approved. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. 2. - PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad, California, held on the 18th day of May , 1978 by the following vote, to wit: AYES : Councilmen Packard, Skotnicki, Anear and NOES: None Councilwoman Casler ABSENT: None ATT E si': - i4ARGARET E.
