Subj ect:REQUEST FOR SEWER ALLOCATION FROM PALOMAR FORTY FIVE ASSOCIATES
FOR CODED COMMUNICATIONS, Inc.
Statement of the Matter
Application is being made by Palomar Forty Five Associates (PFFA) for the
addition of 2 minimum restrooms at 6231 Yarrow Drive, Suite D. The applicant
is requesting that the Council find the request is consistent with Ordinance
No. 8074(10)which provides an exception from the building permit moratorium
under certain conditions. Condition Number 3 provides, "those portions of the
structure for which the building permit would be issued pursuant to this sub-
section have not been previously occupied." PFFA states in their letter of
application that the building has been leased since November 1, 1977, and it
appears that the exception under the ordinance is not applicable. However,
the City Council could allocate sewer capacity under the second revision of
the First Phase Sewer Allocation System.
Due to a change in use, from warehouse-office to manufacturing-assembly,
additional toilet facilities are required. Coded Communications, Inc. (CCI)
is presently occupying Suite D, a shell building with an area of 10,797 square
feet, without toilet facilities. CCI is presently using the 2 minimum toilets
in Suite C, an adjacent office area of 1,208 square feet which CCI will take
over shortly.
In evaluating the request, the new EDU definition was used in determining the
additional EDUs required. The EDU determination is as follows:
EDU with present use _ 80 persons x 30 gal/pers/day = 3 89 EDU
(manufacturing-assembly 270 gal/day/EDU
EDU with normal use _ 12,005 sq.ft. _ fi fi7(office-warehouse) 1800 sq.ft./EDU '
ADDITIONAL EDUs .= 2.2
The allocation on May 9, 1978 of 30.1 EDUs to the Koll Company leaves 35.9 EDUs
available in the industrial category. The three requests for sewer allocation
before the City Council on June 7, 1978 do not exceed the capacity available.

Recommendation:
If the City Council concurs, direct the City Attorney to prepare the necessary
documents allocating sewer capacity of 2.2 Equivalent Dwelling Units under the
second revision of the First Phase Sewer Allocation System as requested, subject
to building permit issuance.

We represent the current owners of the 40,000 square foot
industrial building known as Palomar Airport Business Park
Building No. 5, located at 6231 Yarrow Drive, Carlsbad.
A plat map of the side is enclosed as Exhibit "A".
We hereby respectfully request that you authorize us to
obtain permits for the installation of an additional
restroom to contain two water closets and two lavoratories
as shown in the enclosed sketch, Exhibit "B".
These facilities would be installed in the westerly quarter
of the building in space recently leased to Coded Communica-
tions Incorporated.
This request is consistent with your Ordnance No. 8074
which provides an exception from the building permit
moratorium under the following conditions:
"10. The City Council may grant exceptions for certain
private projects involving building permits for work within existing
structures where the Council in its sole discretion finds that:
1) The building permit is for work to be performed
within the exterior walls and roof of an existing
structure;
2) Said structure was constructed prusuant to a
building permit issued prior to April 19, 1977;
3) Those portions of the structure for which the
building permit would be issued pursuant to this
subsection have not been previously occupied;
4) That the purpose of the building permit is to
make internal modifications to the structure
as necessary to accommodate occupancy by a first
user of the space. "

The building structure was completed as a shell approximately
two years ago, well before the April 19, 1977 jcut-off date.
The subject space, Suite D, had never been leased prior
to Nov. 1, 1977, when it was lease to Coded Communications.
The lessee's initial intended use was soley for warehouse
storage space but their requirement has changed to manufacturing.
The manufacturing personnel require the requested restroom
faci1ities .
Coded Communications now use this space for approximately 140
employees; approximately 80 on the day shift and approximately
60 during the evening shift. The work force on each shift
is comprised of approximately 30% males and 70% females.
Mr. Bernard Gilmore, Manager of Pal.omar Airport Business Park,
the original owners of the building, states that application
for additional restroom was not made prior to leasing this space
to Coded Communications because the original warehouse useagev;n
did not necessitate restrooms. Coded Communications'present
useage obviously requires restrooms.
Coded Communications employs approximately 200 people of which
approximately 60 work in the adjacent Palomar Airport Business
Park Building No. 4. Recent contracts have required increasing
their staff to the current level.
Your approval of our request would , in our opinion, be consistent
with Ordnance No. 8074, and would go far towards stabilizing
the Carlsbad employment base.

forthcoming Lf\ri 1 16, 1978 meeting agenda.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18,
CHAPTER 18.05 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 18.05.020 TO PROVIDE
AN EXCEPTION FROM THE BUILDING PERMIT MORATORIUM
FOR WORK INSIDE EXISTING STRUCTURES, WHICH HAVE
NEVER BEEN OCCUPIED, NECESSARY TO ACCOMMODATE
-THE FIRST USER OF SPACE THEREIN.
The City Council of the City of Carlsbad, California does
ordain' as follows:
SECTION 1: That Title 18, Chapter 18.05 of the Carlsbad
Municipal Code is amended by the addition o f Subsection (10) to
Section 18.05.020 to read as follows:
"10. The City Council may grant exceptions for certain
private projects involving building permits for work within existing
structures where the Council in its sole discretion finds that:
- 1) The building permit is for work to be performed
within the exterior walls and roof of an existing
structure;
2) Said structure was constructed pursuant to a
.building permit issued prior to April 19, 1977;
3) Those portions of the structure for which the*
building permit would be issued pursuant to this
subsection have not been previously occupied;
4) That the purpose of the building permit is to
make internal modifications to the structure
as necessary to accommodate occupancy by a first
- user of the space."
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption and the City Clerk shall certify to the
adoption of this ordinance and cause it-to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.
