Mgr. p,\ Subject: CONSTRUCTION OF WATERLINE IMPROVEMENTS AT THE ELM RESERVOIR AND IN AN EASEMENT FROM PARK DRIVE EASTERLY TO EL CAMINO REAL - CONTRACT NO. 1047 Statement of the- Matter Bids for Contract No. 1047 were opened at 3:OO P.M. on May 24, 1978 in the Office of the City Clerk. Two bid proposals were submitted; see Exhibit 1, Bid Summary, for results. The Engineer's estimate for the project was $20,000 and the low bid was sub- mitted by Joe Openshaw & Sons, Poway, in the amount of $18,529.50. Budgeted funds in the amount of $13,300 are available for this project in Account No. 51-244-3970. the advertisement of bids, a fund transfer in the amount of $6,700 is requested from the Water Fund balance, Account No. 51-000-0900 to the Contract No. 1047 account for implementation of the .work. As set forth previously in Agenda Bill No. 5427, authorizing The project was declared categorically exempt from the requirements of the Carlsbad Envi ronmental Protection Ordinance of 1972. . MEMORANDUM - May 25, 1978 TO : City Manager FROM : Roger Greer , Uti 1 i ties/Mai ntenance Di rector SUBJECT: RECOMMENDATION FOR ADDITIONAL FUNDS TO IMPLEMENT CONTRACT No. 1047 The construction of waterline improvements at the Elm Reservoir and in an easement from Park Drive easterly to El Camino Real was initially esti- mated in the 1977-78 Capital Improvement Program to cost approximately $13,300. However, after the actual plans were completed the Engineer's estimate of $20,000 was far more realistic. The low bid received was in the amount of $18,529.30. Water Fund balance in the amount of $6,700 are available for the shortage of funds and any possible change orders. Number 64, in the amount of $6,700 is on file in the Finance Department for use on Contract No. 1047. Monies from the A Transfer of Funds Request, Therefore, I recommend we proceed with the award of contract to Joe Openshaw & Sons of Poway, California. Reference is here- by made to said specifications for full particulars and description of said work. No bid will be received unless it is made on a proposal form fur- nished by the Engineering Department. Each bid must be accompanied by cash, certified check or bidder's bond made payable to the City of Carlsbad for an amount equal to at least ten percent of the amount bid. Such guaranty to.be forfeited should the bidder to whom the contract is awarded fail to furnish the required bonds and to enter into a contract with the City within the period of time provided by the bid requirements. All bids are to be compared on the basis of the Engineer's estimate, The estimated quantities are approximate only, being given sol.ely as ., a basis for the comparison of bids. No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of Chapter 9, Division 3 of the Business and Professions Code. The City of C'arlsbad reserves the right to reject any or all bids and to waive any minor irregularity or informality in such bids. A project tour will he conducted by the City of Carlsbad Engineering Department at 1o:OO a.m. on May 18, 1978 The genehal prevailing rate of wages for each craft or type of work:.- man needed to execute the contract shall be those as determined by the Director of Industrial Relations pursuant to the State of Cziifornia Labor Code, Part 7, Chapter 1, Article 2, Sections 1770, 1773 and 1773.1. Pursuant to Section 1733.2 of said Labor Code, a current copy of applicable wage rates are on file in the Office of the City Clerk of the City of Carlsbad. It shall be mandatory upon the Contractor to whom the contract is awarded to pay not less than the said specified prevailing rates of wages to all workmen employed by him in the execution of the contract, Also, the prime contractor shall be responsible to insure compliance with provisions of.Section 1777.5 of the Labor Code of the State of California for all occupations with apprenticeships as required on public works projects &Love thirty thousand dollars ($30,000) or twenty working days. The amount of the bond to be given for the faithful performance of the contract for the said work, shall be one hundred percent of the contract price therefor, and an additional bond in the amount equal to fifty percent of the contract price for said work shall be given to secure the payment of the claims for any material or supplies furnished for the performance of the work contracted to be done by the contractor for any work or labor of any kind done thereon.
