Statement of the Matter
The City Council, at your June 6, 1978 meeting, directed
the City Attorney to prepare the necessary documents
to amend Title 21, Chapters 21.04, 21.07, 21.08, 21.09,
21.10 and 21.30 of the Carlsbad Municipal Code by the
amendment, deletion and addition of various sections to
revise the permitted use regulations regarding the keeping
of chinchillas, dogs and cats. The Ordinance adopting
Zone Code Amendment (ZCA-96) is attached.

6-20-78 Ordinance #9502 was introduced for a first reading, amending
Title 21 of the Municipal Code, to revise the permitted use
regulations regarding the keeping of Chinchillas, dogs andcats.

ORDINANCE NO. 9502
AN ORDINANCE OF THE CITY "COUNCIL OF THE CITY OF
• CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTERS
21.04, 21.07, 21.08, 21.09, 21.10 AND 21.30 OF
THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT,
DELETION AND ADDITION OF VARIOUS SECTIONS TO
REVISE THE PERMITTED USE -REGULATIONS REGARDING
THE KEEPING OF CHINCHILLAS, DOGS AND CATS.
CASE NO. ZCA-96.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 21, Chapter 21.04, of "the Carlsbad
Municipal Code is amended by the deletion of Section 21.04.180.
SECTION 2: That Title 21, Chapter 21.04, of the Carlsbad
Municipal Code is amended by the amendment of Section 21.04.195

to read as follows :
"21.04.195 Kennel. "Kennel" means a place where four or
more adult dogs or cats in any combination are kept, whether by
owners of the dogs and cats or by persons providing facilities
and care, whether or not for compensation. An adult dog or cat
is an animal of either sex, altered or unaltered, that has reached
the age 'of four months . "
• SECTION 3: That Title 2, Chapter 21.04 of the Carlsbad
Municipal Code is amended by the addition of Section 21.04.378
to read as follows:
"21.04.378 Veterinarian and Small Animal Hospital. "Veter-
inarian and Small Animal Hospital" means a place of business
operated by a qualified veterinarian for the treatment of small
domestic animals, where boarding, training and grooming of
animals are only incidental to such treatment."
SECTION 4: That Title 21, Chapter 21.07, Section 21.07.030
of the Carlsbad Municipal Code is amended by the deletion of
Subsection (2) and by renumbering Subsections 3 through 5 inclusive
to 2 through 4 inclusive. .
SECTION 5: That Title 21, Chapter 21.08, Section 21.08.010
of the Carlsbad Municipal Code is amended by the amendment of

Subsection (6)(C) to read as follows:
11 (C) The keeping of all domestic animals provided for in
this section shall conform to all other provisions of law governing
same, and no fowl or animal, or any pen, coop, stable or barn shall
be kept or maintained within forty feet of any building used
for human habitation located on the adjoining property or within
forty feet of any street or public property."
SECTION 6: That Title 21, Chapter 21.09, Section 21.09.030
of the Carlsbad Municipal Code is amended by the deletion of
Subsection (1) and by renumbering Subsections 2 through 1 inclusive
to 1 through 6 inclusive.
SECTION 7: That Title 21, Chapter 21.10, Section 21.10.010
of the Carlsbad Municipal .Code is amended by the amendment of
Subsection (5) to read as follows:
"(5) On each lot or combination of adjacent lots under one
ownership, there may be kept one horse for each ten thousand
square feet in the lot or lots; provided, however, that any such
horse may be kept only if it is fenced and stabled so that at no
time is it able to graze, stray or roam closer than fifty feet to
any building used for human habitation other than buildings on
the lot or lots and as to those buildings, no closer than forty
feet;
SECTION 8: That Title 21, Chapter 21.30, Section 21.30.010
of the Carlsbad Municipal Code is amended by the deletion of
Subsection (27).
SECTION 9: That Title 21, Chapter 21.44 of the Carlsbad
Municipal Code is amended by the addition of Section 21.44.084
to read as follows:
"21.44.084 Keeping of dogs, cats and household pets. Ordinary
household pets, including but not limited to dogs and cats, may
be kept in any zone. Not more than three adult dogs or cats in
any combination are permitted for each dwelling unit together with
offspring under four months of age. Such keeping shall conform
to the requirements of Chapters 7.04 and 7.08 of the Carlsbad
Municipal Code." .;' •
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
