Draft ordinances have been prepared following the completion of preparation for presentation to Council next r?.onth. In order to ensure continuation of the interim ordinance provis and to ensure adequate time for Council consideration, public hearings, etc., it is necessary to extend the interim ordinance RECOMMENDATION If Council concurs in finding that the interim ordinance should extended in order to permit consideration of a permanent ordinance it should introduce Ordinance No. 7543 . planning studies and are currently unGergoing staff review in Council action 8-1-78 Following the-pub1 ic hearing Ordinance #9503 was introducl adopted as an urgency measure pursuant to Government Code Section 65858. The Planning Director indicated that although a single pawn shop would not in his opinion have a detrimental effect ~n, ",he village area of the City, that there are varicus tyszs of uses which if allowed to group'or become numerolls wcald. be detrimental or cause a blight effect in the village area Some such uses are: - Thrift shops - Bars as separate uses - Adult entertainment,e.stablishments (including - Massage parlors - Card rooms movie houses, books stores, etc.) In some &ties alcoholic beverage licenses are only allo~!& downtown after the city had approved a conditional use perm the city only zpproved those conditional use permits for bonafide eating establishments with full.kitchens and menus It is my concern that if during the period of studying the- downtown area for redeveloFment a number of these uses were established, they coulc! be counter-prod*uctive in trying to have a downtown revitalization program: If the Council agrees that there is a possible problem with these and othe similar considerations of uses, there are various means in which they can address the particular issue. Council may wish to consider limiting the number of these uses in locat which have a close prosimity to each other or to the absoli numbers, or CounciJ. may require a conditional use permit requiring public hearings and review before any such new u: can be established in the City of Carlsbad. CERTAIN COPlMERCIAL DEVELOPMENTS IN THE DOWNTOWN REDEVELOPMENT STUDY AREA. 9486 PROHIBITING WHEREAS on August 2, 1977, the City Council adopted Ordinance No. 9486; and WHEREAS said Ordinance No. 9486 is attached hereto as "A" and incorporated herein as though fully set forth; and WHEREAS, in order to permit Council adequate time to k. public hearings and consider findings of certain planning studies it is necessary to extend the provisions of Ordinar 9486 as provided by the California Government Code for a pr of not to exceed one year from the effective date of this Ordinance.
