Statement of the Matter
The City Council at your meeting of July 18, 1978 directed
the City Attorney to prepare an ordinance providing for
the waiver of a parcel map for the Encina 5 financing
transaction. The ordinance is attached.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AMENDING
TITLE 20, CHAPTER 20.24, SECTION 20.24.150
OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SUBSECTION 20.24.150 (a) (4)
AND BY THE AMENDMENT OF SUBSECTION
20.24.150(b) TO PROVIDE FOR A WAIVER
OF A PARCEL MAP FOR EXISTING POWER
PLANTS.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Tile 20, Chapter 20.24, Section 20.24.150(a)
of the Carlsbad Municipal Code is amended by the addition of
Subsection (4) to read as follows:
"(4) A minor subdivision resulting from any sale, lease or
financing of land which, no later than January 1, 1979, is used
for an electric plant (as defined in the California Public Utility
Act) which is subject to the jurisdiction of the California Public
Utilities Commission."
SECTION 2: That Title 20, Chapter 20.24, Section 20.24.150
of the Carlsbad Municipal Code is amended by the amendment of
Subsection (b) to read as follows:
"(b) An applicant for a subdivision pursuant to subsections
(a)(1) and (a) (2) of this section shall file a tentative parcel
map pursuant to this chapter together with a written request that
the parcel map requirement be waived. An applicant for a subdivisior
pursuant to Subsection (a) (3) or (a) (4,) of this section shall pay
the fee prescribed by Section 20.08.060 for tentative parcel maps
and shall file an application and request for parcel map waiver
which shall contain sufficient information in the opinion of the
city engineer to enable the city engineer, or on appeal the city
council, to make the finding required by this section. The pro-
cessing of any application pursuant to subsection (a)(3) or
(a)(4) of this section shall be subject to the same time require-
ments and appeal procedures as are provided in this title for
tentative parcel maps. In any case, where waiver of the parcel
map is granted by the city engineer, or on appeal by the city
council, the city engineer shall cause to be filed for record
with the county recorder a certificate of compliance pursuant to
Chapter 20.48 of this title."
EFFECTIVE DATE: This ordinance shall be effective thirty

days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 1st day of August r 1978,
and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council
held on the 15th day of August / 1978 by the following vote,
to wit:
