PARKING CITATION POLICY - NORTH COUNTY MUNICIPAL COURT
Statement of the Matter
The Judges of the North County Municipal Court have decided that effective
August 14, 1978, the court will no longer process citations that do not
have signed promise to appear or a formal signed complaint.
This means that the six cities in the court's jurisdiction, Carlsbad, Del
Mar, Escondido, San Marcos, Oceanside and Vista, must each establish a
system for processing parking citations and collecting the bail.
This change in the court's policy causes wasteful duplication and defeats
the desire for efficient government.
The cities involved are expressing their displeasure with this by adopting
resolutions to be forwarded to the court.

Effective July 1, 1978, the North County Municipal Court shall
accept only citations with a signed promise to appear or signed
formal complaint.
You should take whatever steps necessary to process unsigned
citations—such as parking violation notices—through your
facilities.
We apologize for the short notice of this action but have no
alternative in light of passage of Proposition 13.
This notice is sent you at the direction of the Court.

RESOLUTION NO. 5490
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA OPPOSING THE NORTH COUNTY MUNICIPAL COURT'S
DECISION TO PROCESS ONLY SIGNED CITATIONS. '
WHEREAS, the North County Municipal Court is financed through
the County's General Fund; and
WHEREAS, every taxpayer within the County pays an equal tax
to the County's General Fund; and
WHEREAS, it would be in the best interest of every taxpayer
within the County to avoid duplication of service; and
WHEREAS, if the North County Municipal Court ceases to
process unsigned citations it would require six cities within the
North County area to set up systems to process their own unsigned
cititions; and
WHEREAS, this would be a duplication of service and increased
burden on some taxpayers within the County.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Carlsbad, California go on record as being strongly
opposed to the North County Municipal Court's decision to process
only signed citations and urge the judges of the Court to reconsider
their decision.
PASSED AND ADOPTED by the City Council of the City of Carlsbad,
California, this 1st day-of August , 1978, by the
