Statement of the Matter
The State of California enacted the State Beach, Park, Recreational and Historical Facilities Bond Act of 1974, which provides funds to counties and local governmental agencies for the acquisition and development of needed outdoor recreation and historical areas. This grant assistance
request is for the City’s allocation of $83,048.
The Land and Water Conservation Fund Program (LWCF) provides 50% reim-
bursement grants to states, federal and local agencies, for outdoor recreation projects. This grant assistance request is for half the project’s cost of $93,500.
The Parks and Recreation Commission unanimously ’recommends submission
of the applications for grant assistance for both grant programs.
Funding of the project is contain‘edin the 1978-79 Budget.

SUBJECT: La Costa Canyon Park
La Costa Canyon Park is a 9.0 acre park and is split into two stages of development. The initial development of 1.5 acres of the park was approved by Council June 21, 1977, to include many outdoor recreation facilities. It was approved for a $50,850 Land and Water Conservation Fund grant to cover approximately half of its estimated cost of $100,000.
The second stage of the park will include the development of the additional 7.5 acres of the park and was approved by both the Parks and Recreation Commission and the Council (AB 5111, Supplement 3, June 6, 1978) for application to the Land and Water Conservation Fund and the 1974 Bond Act for grant assis- tance monies. Its estimated cost is $187,000.
The Land and Water Conservation Fund provides 50% reimbursement grants for outdoor recreation projects. We must be assured of funds other than Land and Water Conservation Funds to cover the entire cost of the project with $93,500 (50%) to be reim- bursed upon the project's completion.
Under the 1974 Bond Act our allocation is $83,048, which was initially designated for funding Hosp Grove. Council approved the substitution of La Costa Canyon Park for Hosp Grove (AB 5111, Supplement 3, June 6, 1978) and the San Diego County Board of Supervisors adopted a resolution adding the project to the Priority Plan for Expenditure at their August 1, 1978 meeting. We may receive an advance of 90% of the grant amount ($74,743) upon State approval of the application, plans and specifications.
The applications for both Land and Water Conservation Fund and the 1974 Bond Act must be submitted in their entirety prior, to

September 15, 1978. Complete applications must contain reso- lutions from the governing body approving the application.

The applicant hereby assures and certifies that it will comply with the regulations, policies, guidelines and requirements as they

It possesses legal authority to apply for the grant, and to finance, acquire, and construct the proposed project; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body,
authorizing the filing of the application, including all understandings and assurances contained therein, and directing and
authorizing the person identified as the official representative of the applicant to act in connection with the application and to provide such additional information as may be required.
Sufficient funds will be available when construction is completed to assure effective operation and maintenance of the faciliiy
for the purposes constructed.
It will' provide and maintain competent and adequate architectural engineering supervision and inspection at the construction
site to insure that.the completed work conforms with the approved plans and specifications; that it will furnish progress reports and such other information as the State may require.
It will operate and maintain the facility in accordance with the minimum standards as may be required or prescribed by the applicable State and local agencies for the maintenance and operation of such facilities.
It will give the State's authorized representative access to and the right to examine all records, books, papers, or documents
related to the grant.
It will cause work on the project to be commenced within a reasonable time after receipt of notification from thestate that funds have been approved and that the project will be prosecuted to completion with reasonable diligence.
It will not dispose of or encumber its title or other interests in the site and facilities without permission from the State Legislature. -
It will comply where applicable with provisions of the California Coastal Zone Conservation Act, the California Environmental Quality Act and the California Relocation Assistance Act.
It is aware, and will be in accord with the California Outdoor Recreation Resources Plan and thestate Environmental Goals and Policy Report.

PRIORITY PLAN FOR EXPENDITURE OF STATE BEACH,
PARK, RECREATIONAL, AND HISTORICAL FACILITIES BOND ACT
OF 1974 FUNDS
.. ON MOTION of Supervisor Hamilton , seconded by Supervisor Moore ,
. the following resolution is adopted:
WHEREAS, the San Diego County Board of Supervisors on August 20, 1974
adopted the San Diego County Priority Plan for Expenditure of State Bond
Funds upon complying with provisions of the State Beach, Park, Recreational,
-and Historical Bond Act of 1974; and
WHEREAS, an adjustment of the priority plan is necessary to meet certain
administrative requirements of the State of California; and
WHEREAS, the priority plan now includes grant-in-aid funding for six parks
in the City of Carlsbad; and
WHEREAS, the City of Carlsbad now wishes to use their full grant-in-aid
funding from the State Beach, Park, Recreational, and Historical Facilities
Bond Act of 1974 for a project not included on the priority plan;
NOW THEREFORE, BE IT RESOLVED that the San Diego County Priority Plan
for the expenditure of the allocation of funds under the State Beach, Park,
Recreational, and Historical Facilities Bond'Act of 1974, be amended accord-
ing to Exhibit "A" attached.
PASSED AND ADOPTED by the Board of Supervisors of the County of San Diego,
State of California, this 1st day of August , 1978, by the following vote:

1974 State Bond Act for the development of outdoor recreation facilities. However, due t.0 time constraints, the City will not be applying for funding for any projects listed on the San Diego County Priority Plan for Expenditure.
It is the City's intent to apply our allocation under the 1974 -Bond Act to the La Costa Canyon Park Expansion project. PART V - ASSURANCES
’ The applicant hereby assures and certifies that he will comply with the regulations, policies, guidelines and
requirements, including A-95, FMC-74-4, and FMC-74-7, as they relate to the application, acceptance and use of
Federal funds for this federally-assisted project. Also, the applicant gives assurance and certifies with respect to the
’ grant that:
1. It possesses legal authority to apply for the grant, and to finance and construct the proposed facilities; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant’s governing
body, authorizing the filing of the application, including all understandings and assurances contained therein, and
directing and authorizing the person identified as the official representative of the applicant to act in connection
with the application and to provide such additional information as may be required.
2.
Executive Order 11288, relating to the prevention, control, and abatement of water pollution.
It will comply with the provisions of Executive Order 11296, relating to evaluation of flood hazards, and
3. It ‘will have sufficient funds available to meet the non-Federal share of the cost for construction projects.
Sufficient funds will be available when construction is completed to assure effective operation and maintenance . of the faciliiy for the purposes constructed.
4. It will provide and maintain competent and adequate architectural engineering supervision and inspection at
the construction site to insure that the completed work conforms with the approved plans and specifications; that
it will furnish progress reports and such other information as the Federal grantor agency may require. ..
5. It will operate and maintain the facility in accordance with the minimum standards as may be required-or
prescribed by the applicable Federal, State and local agencies for the maintenance and operation of such facilities.
6. It will give the grantor agency and the Comptroller General through any authorized representative access to
and the right to examine all records, books, papers, or documents related to the grant. ..
7. It will require the facility to be designed to comply with the “American Standard Specifications for Making
Buildings and Facilities Accessible to, and Usable by, the Physically Handicapped,” Number A1 17.1-1961, as
modified (41 CRF 101-17.703). The applicant will be responsible for conducting inspections to insure
compliance with these specifications by the contractor.
8. It will cause work on the project to be commenced within a reasonable time after receipt of notification
from the approving Federal agency that funds have been approved arid that the project will be prosecuted to
completion with reasonable diligence.

10. It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and in accordance with Title VI of

I Statement of the Hatter
La Costa Canyon Park is a 9.'0 acre park, and is split into two staGes. The
initial development of 1.5 acres of the park was approved by Council to in- clude many outdoor recreation facilities. Land 'and Water Conservation Fund grant to cover part of its cost.
The second stage of development will include the development of an additiona 7.5 acres of the park to include two tennis courts, two picnic and view area hiking trails, rest stops, planting and irrigation. The park is contained i the Parks and Recreation Element of the Carlsbad General Plan and will ful- fill the needs for an active neighborhood park.
The estimated cost for Stage Two of the park's development is $157,000. -The
are two possible sources of funds for the project: the Land and Water Con- .servation Fund (LlVCF) and'zhe State Bond Act of 1974. - The 1974 Bond Act. fun yere-previously approved for Hosp Grove PaTk, but because of time con'straint La Costa Canyon Park could be substituted for Hosy Grove. The Par-ks .* and Recreation Coinmission rcxommends the substitution.
If Council concurs, and the La Costa Canyon Park is approved for funding under both grant programs,. $176,548 will be available for the park's' develop
ment in July 19SO.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPROVING THE APPLICATION FOR 1974 STATE GRANT MONIES FOR LA COSTA CANYON PARK DEVELOPMENT PROJECT
I .~
WHEREAS, the people of the State of California have enacted
the State Beach, Park, Recreational and Historical Facilities
Bond Act of 1974, which provides funds to the State of California
and its political subdivisions for acquiring lands and fgr
developing facilities for public outdoor recreation and
historical purposes; and
WHEREAS, the State Department of Parks and Recreation has
been delegated the.responsibility for the administration of the
program within the state, setting up necessary procedures
governing application by local agencies under the program; and
WHEREAS, said procedures established by the State Department
of Parks and Recreation require the applicant to certify by
resolution the approval of applications prior to submission of
said applications to the state; and
WHEREAS, said applications contain assurances that the
applicant must comply with; and
WHEREAS, said procedures further require the applicant to
possess an adopted plan showing parks and recreation lands and
facilities, existing and proposed; and
WHEREAS, the City's Parks and Recreation Element of the
General Plan was first adopted by the city council on June 17,
1975; and

WHEREAS, the proposed La Costa Canyon Park Development
project appears on the city's plan, is consistent with the
California Outdoor Recreation Resources Plan, and is in conformit
with the State Environmental Goals and Policy Report; and

WHEREAS, the project must be compatible with the land use
plans of those jurisdictions immediately surrounding the project;

NOW, THEREFORE, BE IT RESOLVED that the city council hereby:
Approves the filing of an application for 1974 state grant
assistance; and
Certifies that said agency understands the assurances in the
application; and
Certifies that said agency has or will have sufficient funds
to operate and maintain 'the project; and
Certifies that said agency meets the planning requirements
and that the project is compatible with the land use plans
of those jurisdictions immediately surrounding the pr,oject;
and
Appoints the Director of Parks and Recreation Department as
agent of the city to conduct all negotiations, execute and
submit all documents including but not limited to applica-
tions, agreements, amendments, payment requests, and so on
which may be necessary for the completion of the aforemen-
tioned project.

RESOLUTION OF THE CITY COUNCIL CITY OF CARLSBAD APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS LA COSTA CANYON PARK EXPANSION DEVELOPMENT PROJECT - *_
WHEREAS, the Congress under Public Law 88-578 has authorized
the establishment of a Federal Land and Water Conservation Fund
Grant-In-Aid Program, providing matching funds to the State of
California and its political subdivisions for acquiring lands and
developing facilities for public outdoor recreation purposes; and
WHEREAS, the State Department of Parks and Recreation is
responsible for the administration of the program within the State
setting up necessary rules and procedures governing application by
local agencies under the program; and
WHEREAS, said adopted procedures established by the State
Department of Parks and Recreation require the applicant to certif
by resolution the approval of applications and the availability of
local matching funds prior to submission of said application to
the State; and
WHEREAS, Part V of said applications contains assurances
that the applicant must comply with; and
WHEREAS, the proposed La Costa Canyon Park Expansion Develop-
ment project is consistent with the California Outdoor Recreation
Resources Plan; and
WHEREAS, the project must be compatible with the land use
plans of those jurisdictions immediately surrounding the project;
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby;
1. Approves the filing of an application for Land and Water
Conservation Fund assistance; and

2. Certifies that said agency understands the assurances
in Part V of the application and certifies that it will comply
with the regulations, policies, guidelines, and requirements,
including A-95 FMC 74-4 and FMC 74-7, and as they relate to the
application.

Certifies that said agency has matching funds ‘from the
following sources(s) operating funds and can finance 100 percent
of the project, half of which will be reimbursed, and
4. Certifies that the project is compatible with the land
use plans of those jurisdictions immediately surrounding the
project; and
5. Appoints the Director of the Parks and Recreation Depart.
ment as agent of the City to’conduct all negotiations, execute
and submit all documents including but not limited to application!
agreements, amendments, billing statements, and so on which may bc
necessary for the completion of the aforementioned project.
