Statement of the Matter
No decision has been made on lawsuits currently pending in the courts concerning
Proposition 13. Two resolutions have been prepared to assist the Council pursuant
to Section 51508 of the Government Code of the State of California to fix the
amount of revenue from property taxes necessary to support the departments of
the City of Carlsbad and fixing the amount of revenue from property taxes necessary
to pay the bonded indebtedness of the 111962 Sewer Bonds, Series A, B,'and C" and
"1966 Library Bonds" for 1978-79 Fiscal Year.

8-22-78 Resolution #5513 was adopted, setting the tax rate
in tax district #1 at .93 and 87 in tax district #2,
and staff directed to adjust all other figures accordingly.
Resolution #5512 was adopted, and staff directed to adjust
all figures to correspond with that which would be raised
under Resolution #5513.

3 AMOUNT OF REVENUE FROM PROPERTY TAXES
NECESSARY TO SUPPORT THE DEPARTMENTS OF
4 THE CITY OF CA-nSBAO AND FIXING THE AMOUNT
OF REVENUE FROM PROPERTY TAXES NECESSARY
TO PAY THE BONDED INDEBTEDNESS OF THE
5 "1962 SEWER BONDS, SERIES A, B, AND C"
6 AND "1966 LIBRARY BONDS" FOR 1978-79
FISCAL YEAR.

8 WHEREAS the City Council of the City of Carlsbad recognizes that
9 there are lawsuits concerning Proposition 13; and whereas, there has
10 been no directive concerning how to handle taxes in the event of
3.1 failure of Propostion 13 in the Courts; and whereas, if Proposition 13
12 is ruled invalid it will be necessary for the City Council of the
13 City of Carlsbad to set a tax rate for the 1978-79 fiscal year;
3.4 now therefore be -it resolved by the City Council of the City of„
15 Carlsbad, as follows:
16 SECTION 1: The City Council of the City of Carlsbad, pursuant'
17 to Section 51508 of the Government Code of the State of California,
18 does hereby fix the amount of revenue from property taxes necessary
19 to support its departments for the fiscal year commencing July 1, 1978,
20 and ending June 30, 1979, to be in the amount of $2;100,S50.
21 SECTION 2: The City Council of the City of Carlsbad, pursuant to
22 Section 51508 of the Government Code of the State of California, does
23 hereby fix the amount of revenue from property taxes necessary to pay
24 the bonded indebtedness of the "City of Carlsbad 1962 Sewer Bonds,
25 Series A,B, and C" for the fiscal year commencing July 1, 1978, and
26 ending June 30, 1979, to be in the amount of $146,550.
SECTION 3: The City Council of the,.City of Carlsbad, pursuant

28 I to Section 51508 of the Government Code of the State of California,
I does hereby fix the amount of revenue from property taxes necessary
2 to pay the bonded indebtedness of the "City of Carlsbad 1966 Library
3 Bonds" for the fiscal year commencing July 1, 1970, and ending June 30,1975,
4 to be in the amount of $24,425.
5 SECTION 4: That the total amount of revenue from property taxes
6 necessary for all purposes parsuant to Section 51508 of Sections 1, 2,
7 and 3 hereinabove is $2,27.1;525.
8 SECTION 5: The City Clerk shall certify to the passage of this
9 resolution and cause the same to be published, as required by Section
10 36936.1 of the Government Code, once within fifteen (15) days of its
3.1 passage in the Carlsbad Journal, a newspaper of general circulation
12 printed and published -in the City of Carlsbad.

2 A RESOLUTION OF THE CITY COUNTIL OF THE
CITY OF CARLSBAD, CALIFORNIA, SETTING THE
TAX RATE FOR THE 1978-79 FISCAL YEAR.
4 WHEREAS the City Council of the City of Carlsbad recognizes that there
5 are lawsuits concerning Proposition 13;,and whereas, there has been no

7 Proposition 13 in the Courts; and whereas, if Proposition 13 is ruled
g invalid it will be necessary for the City Council of the City of
9 Carlsbad to set a tax rate for the 1978-79 fiscal year; now therefore
10 be it resolved by the City Council of the City of Carlsbad, as follows: 1
11 SECTION 1: For the fiscal year 1978-79, commencing July 1, 1978,
12 there is hereby assessed, levied, and ordered collected upon each $100.00
13 of assessed value of taxable property within general tax district no. 1,
14 which shall consist of all taxable property within the City of iArlsbad
15 except the taxable property in general district no. 2 as described below,
16 taxes in the following listed amounts and for the following listed purposes:

SECTION 3: This resolution is a resolution fixing the rates

of taxes to be leveed in the City of Carlsbad for the fiscal year

1978-79 pursuant to the provisions of Section 51511 of the Govern-

ment Code of the State of California and for providing the county

auditor, as required by said section annually before September 1,
16
1978, the rates of taxes to be adopted.

SECTION 4: The City Clerk shall certify to the passage of

this resolution and cause the same to be published, as required by
19
Section 36936.1 of the Government Code, once within fifteen (15)

days of its passage in the Carlsbad Journal, a newspaper of general

circulation printed and published in the City of Carlsbad and shall
