Statement of the Matter
On February 7, 1978, the City Council approved Resolution No. 5
finding- that the particulate fallout problem at the SDG&E Encinc
Power Plant had been controlled to the satisfaction of the City Council and the Air Pollution Control Officer provided that the
company continue to pay damage claims resulting from the "falloi

to the satisfaction of the City Council of the City of Carlsbad and of the Air Pollution Control Officer and that Condition No.

damage resulting from the "fallout" and San Diego Gas and Elect

In order to develop thorough and independent data on the amount
damage allegedly caused by fallout from the Encina Plant, it wa
decided to conduct a survey of households in the Terramar area.
The SDG&E Company agreed to fund the cost of the survey. The
survey was to be performed by a firm selected by the City of Ca
In March, 1978, the firm of Economic Behavior Analysts, headed . Dr. Oscar Kaplan, was hired to survey the Terramar neighborhood
The field work for the survey took place between April 7 to May 1978. A report of the survey is attached as Attachment 2. The
individual survey sheets for each household contacted were retu
to the City of Carlsbad and analyzed in order to identify unres
complaints or claims. Upon analysis of the information on the
survey sheets, the San Diego Gas and Electric Company was asked
investigate complaints or possible complaints from sixty-nine ( households. After the company's preliminary review, a list of
twenty-one (21) households with complaints or unresolved claims
developed for further investigation. Only households with a sp
complaint were included for further investigation.

In order to establish the validity of the complaints and
unresolved claims, the services of an independent scientific
laboratory to conduct an investigation were required. The
San Diego Gas and Electric Company agreed to fund the cost of
this investigation and study and further agreed to pay for any
damages that the laboratory, as a result of its investigation,
attributed to fallout from the Encina Plant.
The firm of Truesdail Laboratories, Incorporated, Los Angeles,
was retained to perform the requested services, Truesdail has
extensive experience in forensic investigation and testing, as
well as pollution and fallout investigations related to power
plants. Mr. Ignas Bandziulis, Supervisor, Air Pollution Testin(
conducted the investigation and testing on behalf of Truesdail. In addition to the twenty-one (21) households referred to Truest for investigation, during the course of the investigation, four
additional households were also investigated. Mr. Bandziulis's
report is attached as Attachment 3.
A meeting was held in the City Hall Conference Room on July 11,
1978 to discuss the results of Mr. Bandziulis's investigation. In addition to Mr. Bandziulis and City Staff, Mr. Schatzinger,
representative of the San Diego Gas and Electric Claims Departr
was also present. The findings of Mr. Bandziulis's investigati
of the 25 households in question were reviewed and it was deter
that investigation had identified four households with apparent valid claims. After review of Mr. Bandziulis's findings, the c representative of SDG&E agreed to contact and attempt to settle the claims of three households that had property damage that tl?
investigation indicated were due to the fallout from the plant. The company's claim representative indicated that it would be useless to contact the fourth household at this time since the
homeowner had previously clearly indicated to Mr. Schatzinger t
he was not willing to settle the claim. In the other 21 cases
investigated, there were a few allegations of damage, but since
they could not be attributed to fallout damage from the plant,
further settlement discussion by the SDG&E Company were request

Mr. Schatzinger, was contacted regarding the result of his attc
to settle the claims referred to him at the August 11, 1978 me€

in the Terramar area regarding possible fallout damage claims.

of one sort or another. Mr. Schatzinger indicated that the
following action to settle claims resulted from contacting those
households making claims:
46 Autos - cleaned and/or polished to remove stains.
9 Houses - a portion or all of the woodwork was repaint
1 Auto - fully repainted.
1 Auto - plastic window replaced.
1 Swimming Pool - cleaned,
4 Cash settlements.
Mr. Schatzinger further indicated that during the past calendar
years, the following amounts have been disbursed in settlement c
fallout damage claims attributed to the Encina Plant:
1976 - $15,032
1977 - $ 4,329
1978 - $10,850
As a result of the door-to-door survey of the Terramar area, all households with current claims of fallout damage have been
identified. Based on the information produced by the survey and
Truesdail Laboratories' investigation, it appears that in all bu one instance, the SDG&E Company has reached a settlement with th

The field work of the Carlsbad Air Quality Survey took place
April 7 to May 8, 1978,
Five interviewers, none of whom resided in Carlsbad, visited
all of the 227 homes in the Terramar area during the period April
7 to April 17, After Making three personal visits, if resident3
were not at home,the interviewers were permitted to make telephon
interviews, A minimum of five telephone calls at different times
of day and week were made.

Dear Mr. Bussey:
As YOU are a7aie, the APCD Hearing Board found SCG&E in yiolation of Section 41700 of the Health and Safety Code
and District Rule 51'(publ_ic nuisance) and as a result of
that finding issued an Order of Abatement on June 10, 1976.
SDGStE proposed to comply with the Order primarily through the use of a magnesium based fuel oil additive. Due to-:
concerns on the part of the District over possible health implications of additive use, it was found necessary to
extend the final compliance date of the Order and provide
fox extensive testing to resolve this question. The State
Department of Public Health (Dr. John Goldsmith) was
requested to 'advise the District on this issue -
Extensive testing on "fallout" abatement has demonstrated that the use of the fuel oil additive and supplemental
control efforts have been successful in substantially
reducing (greater than 90%) the incidence of acid parti- culate fallout.

Householder Complaints of Property Damages
I RESULTS
An investigation of property damage allegedly caused by particulates
and aerosols fallout from the Encina Power Generating Station of the San
Diego Gas and Electric Company, was conducted on June 7, 8, 9 and 10, 1972
by Ignas Bandziulis, representing Truesdail Laboratories, Inc. Additional
investigations were conducted on July 6 and 11, 1978. I
The City of Carlsbad supplied the Truesdail Laboratories, Inc., repre
sentative with a list of 21 names of the homeowners in the Terremar area t
be contacted and their damage claims investigated. A total of 24 homes WE
investigated. In addition, the City supplied the results of a Carlsbad Ai
Quality Survey, April, 1978.
The investigation consisted of a visit by the Laboratories representa
tive to the listed homes and an inspection of the damage claims. Where it
was possible, samples were collected for further analysis in the laborator
as follows:

The homes investigated are located within a one mile radius from the
plant, and within one half mile distance from the beach. The fallout in-
vestigation was complicated by the ocean spray. The ocean spray contains
large amounts of sodium and magnesium salts. Sodium chloride is a strong
corrosive agent.

often, so that there was little accumulation of the fallout particles,
nor was there a clear cut definite effect of the fallout on the cars.
That is, a fallout particle sitting directly on the corrosion spot. In
most cases, the cars are kept quite clean and all of the fallout particles
are washed off .
Some answers to the complaints are given in this report. The typical I sea water analysis is given at the end of the report.

Microscopic examination of window sill deposits indicated mostly sea sand
and vegetable material (common dust). There were carbon cenospheres pre-
sent also, but they were in small numbers. No acidic fallout was found
by the on-site examination nor later in the laboratory during the collect

The relative humidity is quite high in the mornings and at night and many
particles may appear surrounded by liquid. The liquid disappears during
the day, when the relative humidity is lower.
Lounge discoloration The green covers are spotted in a similar manner as

Paint discoloration The carbon cenospheres, as analyzed, contain some
water extractable iron salts. Due to the condensed moisture at night, thl

1. Black particles on the horizontal wood work surfaces. The
particles appear to be mostly black soot and is deposited
almost daily.
Painted copper rain gutters - from the ocean side, there is
quite strong corrosion. There appears to be not much adher-
ance of paint to the metal.
The gutters and the woodwork was repaired about eighteen
months ago. The painted surfaces show deterioration -
particularly on the upper surfaces. Woodwork on the deck
was painted in 1976.

On site examination: Microscopic analysis using 30X magnification.
There are quite a few carbon cenospheres and carbon cenosphere aggre-
gates. Some of the aggregates showed disintegration upon impact. No
acid fallout particles were found.
Mr. William Barlow offered the following suggestions:
1. The soot is continuous problem in this neighborhood.
soot blowing should be started only when sufficient strength of
wind is present and in the directions to the East: or the West
only, where the fallout would cause the least harm.

is a retired seaman and is of an opinion that this discharge is
not necessary.

The last car, '70 Buick Station Wagon. The acid corrosion was quite
strong. September, 1977, he repainted at the cost of $470.00. The pittin
appeared again. At the end of March, 1978, he gave away this car to the
Carlsbad Boys Club.
New Mercury, 1978, Lic. No. 920 UQS, white, was at the garage door.
Some fallout particles were found on this car. Several small carbon ceno-
spheres were found on the hood of the car. There were also several reddis
stains.
Microscopic examination of the hood showed several aggregates of carbon
cenospheres. There were two spots that gave strong acid reaction with a
pH paper.
Claims: No claim now. Mr. E. L. Valentine intends to leave his car in th,
driveway until the corrosion is strong enough, then settle his

Complaint: It used to be slippery (oily) on the front patio in the
mornings due to fallout. Now it disappeared during the
last few months.
Claims: None.
Note: Mrs. D. Pederson requested another visit to her property. The
visit was made on July 6, 1978, at 3:OO p.m. The house was
washed before the 4th of July celebration and the samples were
gone. General complaint was of the black deposits on the window
screens at the lower portion of the window, on the north side of
the house.
No samples were collected during this visit. The cement on the
beach balcony appeared to be stained by iron oxide.

Complaint: Mrs. Spivey collects samples of the fallout. Generally, the
fallout is washed from the roofs and the cemented surfaces.
Due to the indentation in the backyard cement floor, the pool
of water stays there. Upon evaporation, she collected the
black residue into plastic bags.

kelp). This makes the deposit float on water. Among this vegetable material

1. The house was painted in August, 1975. Paint condition is bad,
in particular, the woodwork. The painting was done by a profes- 1 sional painter.

Cadillac and white burrs are formed on the black paint.

Remarks :
The soiling of the surfaces is quite visible. The usual claim is
that this fallout is caused by the neighboring plant. People lived on
the seashore further down the coast and this fallout was not as great
as in this location. Fallout, in this case, includes all of the dust
settling on the properties.
The investigation did not uncover the plant as being the major
contributor to the fallout. Most of the fallout dust is of the common
variety: sand or clay particles and vegetable origin matter. The

Sea salt spray has a strong corrosive action on aluminum window or
screen frames. Only well, anodized aluminum frames would resist the wea-
thering. It is most difficult to distinguish the differences between the
ocean spray and plant fallout corrosion. Ocean water also contains sulfat
as does the plant fallout material. One of the tests of anodized aluminum
quality control is a submission of aluminum test panels to the salt water
fog in a test chamber.
Unless the actual fallout particle is found on the frame in an acid
corrosion pit, one cannot say that the aluminum corrosion was caused by
the plant fallout. On the other hand, the cubic salt crystals were always
present on the aluminum frames or in the screens. The cubic form is typi-
cal for salt (NaC1) crystals.
The almost complete absence of cenosphere aggregate particles indicat
that most of the plant fallout is from a normal plant operation. The heal
iest fallout particle population is reached during so-called soot blowing
operations in the plant. Apparently, this operation is handled during the favorable wind conditions,
the larger particles and cenosphere aggregates. These particles are prodt
by depositing a particulate matter (soot) on the heat exchange surfaces ir
side the boiler and later blowing them off, thus resuspending these deposj
in the flue gas stream during the soot blowing operations. This resuspenc
particulate matter is carried out into the atmosphere through the stack.

The soot blowing operation usually causes most of the fallout in the
neighborhood due to the increased particle size and the increased particle
numbers. During the normal plant operation, the particles emitted are
smaller in size and it takes time for these particles to reach ground from
the top of the stack level. The group of this type of particles is tagged
by single cenospheres (not aggregated). This last group of particles have
a much smaller percentage of acidic particles than the particles from soot
blowing operation emissions.
Particles as a health hazard is a very remote possibility. The healt
hazard is created by the particles of 5 microns or less (usually 2 microns
or less) and in the concentrations above 5 mg/m . These particles act al- 3 I most like gases.
A tall stack insures the flue gas emission at a fairly high level
above ground. Settling rate of the small particles is very slow. During
that time, either they are dispersed by the wind or slowly aggregate and
settle (fallout) as a larger particle. Therefore, the fear of the health
