Statement of the Matter
Southwest Bank is appealing to the City Council to allocate 0.5 equivalent
dwelling units to provide sewer capacity for a proposed expansion of their
bank at 675 Elm Avenue. Southwest Bank submitted a building permit appli-
cation on July 24, 1978 and was informed on August 9, 1978 the building
permit was being denied on the grounds the proposed remodeling included a
945 -square foot expansion of floor area and was not exempt.from the sewer
moratorium.
The sewer allocation system provides for Council's allocation of sewer ser-
vice for projects within the redevelopment area from the contingency reserve.
Based on the proposed floor plan the City Engineer has determined that 0.5
EDUs are required. The Redevelopment Coordinator reviewed the proposed
plans and requested that "in the event Council approves the allocation, it
should be conditioned upon a reorientation of the walk-up service and as-
sociated parking from Elm Avenue to the existing parking lot."

Recommendation
If the City Council concurs, direct the City Attorney to prepare the neces-
sary documents allocating 'sewer capacity of 0.5 equivalent dwelling units
from the contingency reserve to Southwest Bank and subject to the elimination
of an existing driveway approach and a parking area fronting on Elm Avenue
and the reorientation of a proposed walk-up service from Elm Avenue to the
existing parking lot.

Council Action;
9-5-78 Council directed the City Attorney to prepare the necessary
documents allocating sewer capacity of 0.5 Equivalent
Dwelling Units from the contingency reserve to Southwest Bank

, remodeling of Southwest Bank, which included the enclosing
of an-existing canopy and some miscellaneous interior items.
We were informed today that the permit application has been
rejected because of the current sewer situation.
We were told that it would be necessary to request from the
City Council a one-half E.D.U. hookup capacity for the work

SUBJECT: SOUTHWEST BANK EXPANSION - SEWER ALLOCATION APPEAL
Introduction
I have reviewed the request noted above and found the proposed expansion
use to be generally acceptable in light of the preliminary redevelopment
plan as adopted by the Planning Commission. The proposal would result
in a higher and better use of the total site than the vacated drive-
thru which currently occupies the expansion area.
Although the proposed use would generally benefit the redevelopment
effort, the site plan, if approved as submitted, could result in a
worsening of the traffic situation on Elm Avenue between Madison and
Roosevelt.
In the event that Council desires to grant the appeal, this "good
news/bad news" situation could be eliminated by attaching conditions
to the sewer allocation. I recognize that Council has not conditioned
sewer permits in the past. However, the intent of the redevelopment
effort is to eliminate design deficiencies and substandard situations
toward the end of upgranding the area. Conditional approval as
noted above would accomplish that end.
Critique
Exhibit "A" is a copy of a portion of the site plan submitted by
the applicant. As depicted the walkup area and night depository are
located so that access is taken from Elm Avenue. Discussion with the
architect indicates that the parking is to service the night
depository while the walkup window is primarily for the convenience
of the pedestrian. The site plan provides for no direct link to
the Elm Avenue sidewalk necessitating pedestrian-vehicular conflict.
Additionally, the parking area increases the movement at the inter-
section of Elm and the alley, thereby increasing the accident
potential.
Staff will attempt to discuss these issues with the applicant prior
to the meeting of September 5.
Recommendation
That the Council consider the conditional approval of the appeal
for 0.5 E.D.U.s as follows:
A. Reorientation of the walkup area to the south side of the
expansion area or connection of the area to the sidewalk via a
route avoiding the parking area.
B. Provision of one parking space clearly marked "for depository
use only" and taking access from the alleyway, as shown on
Exhibit "B". This results in the elimination of one space
not required to meet ordinance standards.
C. Removal of the existing curb cut on Elm Avenue which previously
serviced the drive-thru. This minimizes the accident increasing
potential of the proposal.
