Attyd- 9- - I THIRD REVISION TO THE FIRST PHASE SEWER ALLOCATION SYSTEM -- ALLOCATION OF PERMITS Statement of the Matter The City Council, at your September 19, 1978 meeting, indicated your intention to reserve not less than 75 EDU's for City capital improvements projects and failing septic tanks. Given the 21.2 EDU's which the Council indicated they wished to allocate to Car Country, there remains a balance of 6.3 units. The attached resolution makes 21.2 EDU's available to Car Country, reserves the 75 EDU's and provides that the remaining 6.3 units are available to be allocated as the Council sees fit on a case by case basis. A RESOLUTION OF THE. CITY couraxr, OF THE CITY OF CARLSRAD , CALIFORNIA, APPROVING A THIRD REVISION TO THE FIRST PHASE SET9ER ALLOCATION SYSTEM. WHEREAS, the Cj-ty Council has adopted a First Phase Sewer Allocation System (Resolution No. 1599) and revised it on several occasions by the adoptions of Resolution No. 5259, Resolution No. 5303 and Resolution No. 5371; and WHEREAS, the City Engineer, in a memorandum dated September 1978, has reported further to the City Council on the remaining unallocated EDU's; said memorandum is on file in the office of the City Clerk and incorporated by reference herein; and WHEREAS, the City Council wishes to make provisions for the allocation of the City's remaining capacity in the Encina Sewer Treatment Plant; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1, That the above recitations are true and correct. 2. That the City Council finds that it has remaining from all sources sewer capacitv in the amount of 102.5 EDU's. 3. That 21.2 EDU's is hereby made available for allocation fcr auto dealerships located in Car Country. 4. That 75 EDU's are hereby reserved for City projects to be allocated on a case by case basis by the City Council. 5. That the remaining 6.3 EDU's shall be available for all.ocation by the City Council on a case by case basis. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad on the 3rd day of 8
