SUBJECT: PUBLIC FACILITIES REQUIRING CONDITIONAL USE PERMIT. _ CASE NO: ZCA-100 _ (Public Hearing) _ STATEMENT OF THE MATTER Recently the City Council approved a Zone Code Amendment (ZCA-97) that modified various sections of the zoning code regarding public facilities. During this hearing it was noted that one of these sections needed further revision for clarification of terms; this was Paragraph J, of Section 21.42.010-2. The City Council, however, wished to adopt ZCA-97 at that time and not send it back to the Planning Commission for report on revision. Therefore, the City Council after adopting ZCA-97 directed the Planning Commission to hold a new public hearing to modify Paragraph J of Section 21.42.010-2. The Planning Commission has recommended approval of ZCA-100 as suggested by the City Council . Q _ *^~ZCA-1XLQ——^ 5 APPLICANT:" '"'"^""CTTYOF CARLSBAD 6 7 WHEREAS, the Planning Commission of the City of Carlsbad 8 did hold a duly noticed public hearing on September 13, 1978, 9 to consider the subject amendment; and 10 WHEREAS, the Planning Commission recieved all testimony and 11 arguments, if any, of all persons who desired to be heard, 12 and upon hearing and considering all factors relating to Zone 13 Code Amendment-100 found the following facts to exist: 14 1. On August 1, 1978, the City Council approved ZCA-97, which 15 modified various sections of the zoning code regarding the 16 processing of public facilities. One of the changes of ZCA-97 17 was Paragraph J, Section 21.42.010(2). 18 2. During the public hearing on ZCA-97 it was noted that some 19 of the terminology used in Paragraph J should be clarified. 20 WHEREAS, the Planning Commission by the following roll call 21 vote recommended APPROVAL of Zone Code Amendment 100 as follows: 22 "(j) Accessory public and quasi-public utility buildings and facilities, including, but not limited to water wells, 23 water storage, pump stations, booster stations, transmission or distribution electrical substations, operating centers, 24 gas metering and regulating stations, or neighboring telephone exchanges, with the necessary apparatus or appur- 25 tences incident thereto." 26 AYES: Rombotis, Schick, Marcus, Jose, Wrench, Larson 27 NOES: None 28 -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 * 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ABSENT: L'Heureux ABSTAIN: None NOW, THEREFORE, BE IT RESOLVED that the above recitations are true and correct. CASE NO: ZCA-100 On August 1, 1978, the City Council approved ZCA-97, which modified various sections of the zoning code regarding the processing of public facilities. One of the changes of ZCA-97 was Paragraph J, Section 21.42.010(2). Paragraph J establishes what public facility uses will be permitted in any zone by conditional use permit. In ZCA-97, the mod- ifications was to clarify that these uses would be for accessory public and quasi-public facilities. During the public hearing on this matter a representative of San Diego Gas & Electric indicated that some of the terms in subparagraph J should be updated. In addition, Fred Morey of La Costa Land Company suggested that "water reservoir" should also be included as to water treatment facilities. The City Council agreed with these changes, however, they preferred to adopt ZCA-97 and make the changes as suggested on a sub- sequent zone code amendment. Staff has prepared this amendment by adding as suggested by San Diego Gas & Electric "transmission or distribution electrical substation operating centers,"; and adding " water storage" as suggested by Mr. Morey. Deleted was "conversion plants", since the term is not commonly used and could be considered a power plant. The modified section is as follows: (J) "Accessory public and quasi-public utility buildings and facilities, including, but not limited to water wells, water storage, pump stations, booster stations, transmission or distribution electrical substations, operating centers, gas metering and regulating stations, or neighboring telephone exchanges, with the necessary apparatus or appurtenances incident thereto," Attachment: Ordinance No. 9507, ZCA-97. Recommendation; It is recommended that ZCA-100 be APPROVED as indicated above.
