Statement of the Matter
The contractor, G. Spikes Masonry C, Cement Contractor, completed the work on subject contract on September 1, 1978. The contract comple- tion date of January 1, 1978 was not met because the City did not com- plete site'preparation work (removal of trees, stumps and damaged con- crete) in a timely manner.
Due to the extended contract time, the contractor was subjected to increased costs of labor and materials, Contractor is requesting to be reimbursed for the increased costs which occurred after the con-
tract completion date.
The final contract amount of $31,034.67 (not -including the change order) was less than the original contract price of $45,426.50. This was due to an error in estimating the amount of concrete replacement actually required. .

Recommenda t ion
If Council concurs, approve Change Order No. 1, accept the work and direct the City Clerk'to record the Notice of Completion and release the. bonds thirty-five (35) days after recordation.
Council Action:
10-17-78 Council approved Change Order No. 1, accepted the work and
directed the Clerk to record the Notice of Completion and release the .bonds at appropriate time.

Due to the delay of preparation by the City of Carlsbad
on above Contract, I, Gabe Spikes have suffered the lost
of time, and due to increases in labor and material have

not able to give breakdowns on.
