(CASE NO: ZCA-100) Statement of_ the Matter The City Council at your meeting of October 3, 1978 directed the City Attorney to prepare the necessary documents amending Title 21 of the Carlsbad Municipal Code by the amendment of Section 21.42.010(2)(J) to revise the Conditional Use Permit provisions regarding accessory public utility uses. The ordinance adopting the zone code amendment is attached. Exhibit Ordinance No. Js'G 9 Recommendation If the Council concurs, Ordinance No. ^^O J should be introduced. COUNCIL OF THE OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.42 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 21.42.010 TO REVISE THE CONDITIONAL USE PERMIT PROVISIONS REGARDING ACCESSORY PUBLIC UTILITY USES. (ZCA-100) The City Council of the City of Carlsbad, California does ordain as follows: SECTION Is That Title 21, Chapter 21.42, Section 21.42.010 of the Carlsbad Municipal Code is amended by the amendment of Subsection (2) (J) to read as follows: " (J) Accessory public and quasi-public utility buildings and facilities including, but not limited to, water wells, water storage, punp stations, booster stations, transmission or distribution electrical substations, operating centers, gas metering and regulating stations, or neighboring telephone exchanges, with the necessary apparatus or appurtenances incident thereto." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the |7t;h day of October r 1978 and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held on the 7th day of November , 1978 by the following vote, to wit: AYES: Councilmen Skotnicki, Anear, Lewis and Council woman CaslerNOES: None ABSENT: Councilman Packard ^RONALD C.
