SUBJ ECT : APPEAL OF THE CUP-l18(A) - Magee House ,* APPELLANT: CITY OF CARLSBAD PARKS & MCMATION COMMISSION , (Public Hearing) ' STATEMENT OF THE MATTER: The Parks and Recreation Commission requested an amendment to the Magee Park Conditional Use Permit. The basis of the amendment was to permit the use of the Magee House prior to completion as per the conditions set forth .. in the original conditional use permit resolution. The Planning Commission was sympathetic with the Park Department's desire to use the existing house at this time. However, they had reservations on the types of uses that the house should be put into. The Planning Commission felt that active uses that bring people in and out should be discouraged until all the public facilities and the parking lot was completed as per the approved CUP. . The Planning Commission approved the amendment only for storage and office use, provided the building met all fire and building requirements. The Parks and Recreation Department now desires to conduct indoor recreation type activities and classes, and display of historical society antiques for public viewing in this house and therefore has appealed the Planning Commission decision. 4.. If the City Council concurs with the appellant, action should be to return the case to the Planning Commission for further report regarding the use of the Magee House for recreational activities and classes. ! Council Action: 10-17-78 Council directed that the matter be returned to the Planning Commission for reconsideration of uti1 izing the requested rooms for classes, with a stipulation that there is no guaranty that such use will be continued on a permanent basis.
