DEPARTMENT: Water Pollution C. Mgr . Dept. Hd. 0£_ (J M^ SUBJECT: Amendment to the Agreement for Design of a Digester Mixing System at the Encina Water Pollution Control Facility. Statement of the Matter At their December 6, 1978 meeting, the Carlsbad City Council approved an agreement with C M Engineering for design of a mixing system for Digester No. 2 at a cost not to exceed $4,600. The project was advertised for bids twice resulting in no bids at the first opening and un- acceptably high bids at the second opening. Finally, the project was accomplished through the Carlsbad open market procedure. The various components of the project were separated and subcontracted. The mixing system was redesigned by the Engineers to accommodate a new support system and different pumps than those specified. During the procurement, fabrica- tion and installation of the components of the system, the Engineers assisted in developing installation methods, requesting quotations on pipe, fasteners, and equipment and in the actual intallation of the tube. Accordingly, the total expenses incurred under the original design contract were $5,973.33, or $1,373.33 in excess of the original fee. At the October 25, 1978 JAC meeting, the Advisory Committee unanimously approved a recommen- dation that the Agreement be amended to reflect the increased scope of work. Adequate funds are available in the Encina budget. Exhibits A. Resolution No V5s5' 71 approving the Amendment to the Agreement. Recommendation If Council concurs, they should adopt Resolution No.JTVf 7/ authorizing and directing the Mayor to execute the Amendment to the Agreement with C M Engineering for Design of a Digester Mixing System at the Encina Water Pollution Control Facility. That certain amendment to the agreement between the City of Carlsbad and C M Engineering Associates for design of a mixing system for Digester No. 2 at the Encina Water Pol Tut ion Control FaciIity, a copy of which is attached hereto, marked Exhibit "A", and made a part hereof, is hereby approved. « 2. The Mayor of the City of Carlsbad is-hereby authorized and directed to execute said amendment for and on behalf of the City of Carlsbad. TO AGREEMENT FOR DESIGN OF A MIXING SYSTEM FOR DIGESTER NO. 2 AT THE ENCINA WATER POLLUTION CONTROL FACILITY THE AGREEMENT for Design of a Mixing System for Digester No. 2 at the Encina Water Pollution Control Facility in the City of Carlsbad, California, dated December 6, 1977, consists of eighteen articles which are to remain in full force and effect except as amended herein. AMENDMENTS ARTICLE I - Scope of Consultant Services Add: "6. Redesign the draft tube assembly for floor supports rather than roof supports." «Add: "7. Redesign the piping and support system to accommodate MD pumps rather than Sutorbuilt pumps." ARTICLE V - Guaranteed Maximum Fee Change "$4,600.00" to read "$5,973.33".
