Statement of the Matter
The City Council at your meeting of November 21, 1978
directed the City Attorney to prepare the necessary
documents approving Planned Unit DeveloGment (PUD-11)
A resolution in that regard is attached.

Council action:
12-5-78 Council adopted Resolution 5633, approving a Planned Uni Development permit (PUD-11) for four units on property c approximately 2.22 acres generally located on the west 5
of El Camino Real between Chestnut and Tamarack Avenues.
In addition, Council requested an additional report wit1 regards to the frontage road referenced in the project.

WHEREAS, the Planning Commission of the City of Carlsk
on October 25, 1978 hold a duly noticed public hearing to c
the application of R. E. Wilkinson for a Planned Unit Devel
Permit for four units on property generally located on the
side of El Camino Real between Chestnut and Tamarack Avenue
particularly described as:

to Map thereof No. 823, filed in the Office of the
County Recorder of San Diego County on November 5, 18! and
WHEREAS, the Planning Director has determined that sa:

NOW, THEREFORE, BE IT RESOLVED by the City Council of
City of Carlsbad as follows;
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 1482 constitute the findings of the City Coui
in this matter.
C. That the Planned Unit Development Permit is grantc
for the reasons set out in this resolution and subject to a
applicable requirements of the Carlsbad Municipal Code and
satisfaction of the following conditions:

10. No building shall be occupied until an occupan
permit is issued for such building.
11. CC&R's shall be submitted to the City for appr

The proposed project is a Planned Unit Evelopent (PUD) , tentative parcel
map ad grading plan for four units on about 2.2 acres of land. property is generally located on the west side of El Camin0 Real htween Chestnut ard Tamarack Avenues. The site is surrourxled by low density sb

Presently, the property is covered with typical gra:;ses, shrubs and other natural vegetation, ad presumably is the habitat for sm small animals
and wildlife. Hower, neither the vegetation nor wildlife is considered
unique or unusual, and its elimination will not result in the loss of significant species.
The grading propsed involves about 3,000 cubic yards of earth mvment.
