SAN MARCOS TRAINING CENTER (EAST CARLSBAD 2.28) ANNEXATION Subject:
Statement of the Matter
The San Marcos County Water District made application to the Local Agency Formation Commission for annexation of 5 acres of land owned by the District and known as the San Marcos Training Center.
At its November 6, 1978 meeting, LAFCO approved the annex- ation (see LAFCO per attached Exhibit 1) and authorized the
City of Carlsbad to annex the territory without notice and
without election since the territory is uninhabited and all
land owners (the District) have consented to the annexation.
In order to complete the annexation, the City Council needs
to adopt a Resolution (see Exhibit 2) ordering the annexation.

RESOLUTION OF LOCAL AGENCY FORMATION COP/MISSION
APPROVING A PROPOSED ANNEXATION
TO THE CITY OF CARLSBAD
"San Marcos Training Center (East Carlsbad 2.28) Annexation"
On motion of Commissioner McClellan , seconded by
Commissioner Hamilton , the following resolution is adopted:
WHEREAS, a petition of landowners was submitted to this
Commission for annexation of territory to the
City of Carlsbad
(hereinafter referred to as the City), which petition was
certified sufficient by the executive officer on Sept. 12, 1978 ;
WHEREAS, the executive officer of this Commission has filed
his report on said proposed annexation, which report has been
considered by this. Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS as follows:
1. The territory proposed to be annexed (hereinafter
referred to as the Territory) is as described in
Exhibit A attached hereto.

The Commission finds, in accordance with the Negative
Declaration dated September 27, 1978, that this proposal
will have no significant effect on the environment,
The Cammission hereby approves the proposed annexation subject
to the proposed conditions, if any, as stated on Exhibit c -
attached hereto and incorporated herein,

The Commission hereby designates&'the City as the conducting
authority and authorizes the Legislative Body of said City
to initiate annexation proceedings in compliance with this
resolution, without notice and hearing and without an election.
The Executive Officer of this Commission is directed to mail and
file certified copies of this resolution in accordance with
Goverment Code Section 35159.
PASSED AND ADOPTED by the Local Agency Formation Commission of the
County of San Diego this 6th day of November, 1978 1

RESOLUTION NO. 5628
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ORDERING THE ANNEXATION OF TERRITORY KNOWN AS THE SAN MARCOS TRAINING
CENTER (EAST CARLSBAD 2.28) ANNEXATION.
WHEREAS, a petition of landowners was submitted to the Local
Agency Formation Commission for the annexation of territory to the
City of Carlsbad; and
WHEREAS, the Commission has determined that all landowners
of the territory to be annexed have consented in writing to the
proposed annexation; and
WHEREAS, the Commission has determined that the territory
includes 5.0 acres and is uninhabited; and a description of the
exterior boundaries of the territory to be annexed is attached
hereto as Attachment "A"; and
WHEREAS, the Commission has conditionally approved the annex-
ation, designated the City of Carlsbad as conducting authority,
and authorized the City to annex the territory without notice or
election; and
WHEREAS, as a condition of annexation the Commission in its
Resolution approving the annexation required the description of
the territory to be annexed be modified to conform with Attachment
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the description of the exterior boundaries of the
territory to be annexed have been modified to conform to Attach-
ment "A".

3. That the territory described in Attachment "A" is hereby
ordered annexed to the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, on the 5th
day of December , 1978, by'the following vote, to wit:
