Statement of the Matter
The City Council, at your December 5, 1978 meeting, directed
the City Attorney to prepare an amendment to the Planning
Moratorium to allow the processing of revisions to previously
approved Tentative Subdivision Maps under certain circumstances.

Recommendation

Council action:
12-19-78 Ordinance No. 7055, amending the planning moratorium to provide
for an exception to allow the processing of revisions to
previously approved tentative subdivision maps under certain
circumstances, was given a first reading only.
1-2-79 Ordinance No. 7655 was given a second reading and adopted by

ORDINANCE NO. 7055
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING ORDINANCE
NO. 7048 AS EXTENDED BY ORDINANCE NOS. 7050
AND 7053 TO A14END THE PLANNING MORATORIUM
TO PROVIDE FOR AN EXCEPTION TO ALLOW THE
PROCESSING OF REVISIONS TO PREVIOUSLY
APPROVED TENTATIVE SUBDIVISION MAPS UNDER
CERTAIN CIRCUMSTANCES.
WHEREAS, the City Council has,by the adoption of Ordinance
No. 7048, as amended by Ordinance No. 7049, and as extended by
Ordinance No. 7050, and as further amended by Ordinance No. 7051,
and further extended by Ordinance No. 7053, declared a city-wide
moratorium on the processing of discretionary approvals pu'suant
to Title 20 or Title 21 of the Carlsbad Municipal Code due to
the unavailability of sewer servicep and
WHEREAS, said moratorium is subject to a number of exceptions
to allow projects which will not result in any increased demands
on the City"s sewage treatment capacity to continue to process;
and
WIiEREAS, the City Council has determined that the public
interest requires amending said moratorium to add a further
exception to allow the processing of revisions to previously
!approved Tentative Subdivision Maps under certain circumstances;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Carlsbad, California, as follows:
SECTION 1: That Section 1 of Ordinance No. 7048 is amended
by the addition of Subsection 1.0 to read as follows:
"10. Applications for revision of an approved Tentative
Subdivision Map may be accepted and processed
provided the City Manager determines that no additional
sewer capacity will be required. Such revisions may
be approved if the City Council finds that, no

additional sewer capacity will be required, no
additional lots or dwelling units are proposed,
the subdivision boundaries are retained, and
it is consistent with zoning and applicable
general and specific plans."
EFFECTIVE DATE: This ordinance, shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
-adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 19th day of December __, 1973
and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council
held on the 2nd day of January , 1979 by the following
vote, to wit:
AYES: Councilmen Packard, Skotnicki, Anear,,Lewis and
Councilwoman Casler
NOES: None
ABSENT: None
