DEPARTMENT: Fire C. Mgr. Subject: Agreement Between City of Carlsbad and the Regents of the University of California, San Diego Campus, for Paramedic Training. Statement of the Matter In anticipation of sending one of our people to the University for paramedic training in January of 1979, it is necessary that we enter into an agreement with the University for this training. In the past the cost for the paramedic training was supported by San Diego County through a Federal Grant, which expired in November of 1977. As these funds are no longer available, the County of San Diego no longer contracts with the University for paramedic training. F Therefore, it is necessary for each agency to sign an agreement with the University. The agreement covers a five month period from January 11, 1979 through June 30, 1979 and calls for $675.00 per student. The agreement also calls for certain liability and professional mal-practice insurance to be provided by the City. The agreement also covers, in detail, the course of instruction to be given. Rauscher, MD CARLSBAD FIRE DEPARTMENT MEMORANDUM TO: CITY MANAGER DATE: 12-27-78 FROM: FIRE CHIEF SUBJECT: Paramedic Training This is a request to send one firefighter to paramedic training starting on January 11, 1979, and running through June, 1979. During the next six months we will have two captains eligi- ble for retirement. One is a mandatory age retirement and the other has indicated to me he will be requesting retire- ment when eligible. In planning for these possible vacancies the department recently conducted a Captains examination to establish a promotional list, of which three qualifying candidates are paramedics. No decision has been made as to selection for promotion; however, with the possibility of a paramedic being promoted or the possibility of someone not wishing to recertify this year as a paramedic, I feel we should have an additional firefighter trained for backup. I have tentatively made a reservation for one of our people to attend paramedic training starting in January, 1979. The next class does not start until April of 1979 and would not meet the needs of the department. RAUTENICRANZ, City clerk 25 (SEAL) 26 s j 27 a' t 28 i AGREEMENT THIS AGREEMENT, made and entered into this day of , 1978, by and between THE REGENTS OF THE UNIVERSITY OF CALIFORNIA., on behalf of The Department of Anesthesiology, School of Medicine, University of California, hereinafter called "University", and Carlsbad Fire Department hereinafter called "Agency", WITNESSES: WHEREAS, University has determined it is in the public's interest to provider paramedic training service; and WHEREAS, Agency has need to train Agency personnel in compliance with the provisions of California State Health Safety Code, Section 1480-1485, Wedworth— Townsend Act, and the Department of Transportation, National Highway Traffic Safety Administration, National Training Course; and • "• WHEREAS, University possesses the facilities and the professional qualifications to provide the said training; and WHEREAS it is to the mutual benefit of the parties hereto that students in the Agency Paramedic Program receive their training at University; NOW, THEREFORE, in consideration of the covenants, conditions and stipulations hereafter expressed and in consideration of the mutual beneftr to be derived therefrom the parties hereto agree as follows: , 1. That University has established an approved training program of special t.ainiug for paramedic interns,. hereinafter referred to a.s"students", and such program requires bona :ide students enrolled therein to obtain their learning experience as set forth in th,_ ,,Idelines for selection of interns, performance standards and the curriculum entitle ? "Mobile Intensive Care Paramedic of the County of San Diego", attached hereto as Exhibit "A" and by this reference made a part hereof this Agreement. 2. That the paramedic trainee's course of instruction shall consist of the following: a. Didactic; Classwork conducted at the EMS Training Office scheduled approximately seven hours/day, Monday through Friday, for approximately - eight weeks. Additional personal study time of approximately four hours/day will be required, b. Clinical: A full-time experience divided between the training facility (University Hospital) and the base station hospitals in the county for approximately four weeks. Personal study will also be required. c. Field Internship: On -the• job training -at a paramedic provider agency in the county where interns are supervised by certified paraznedica and instructors from the EMS Training Office, Schedules are usually 24-hour _ •7 shifts (56/week) for approximately eight weeks. • 3. That all schedules and time -frames are approximate as the core training program is a competency -based learning experience in which a student does not progress from one phase to the next until competency has been demonstrated in each .phase of the course. Additional supervised tutoring may be required at any time by the teaching staff, including weekends, evenings and holidays. 4. That during the five -month training program, students inust comply, with, the San Diego County EMS Training, Paramedic Performance Standards, Exhibit A.. .5. That due to the accelerated rate of the training course it is not possible for a student to enter training after initial orientation. 6. That the University shall, at the commencement of the student's training, provide thorough orientation as to University's administrative policies, standards and tr<.1ning requirements. 7• That University and the Agency agree that selection and placement of students in the training program shall be without regard to race, creed, color, sex or age. 8. That Agency shall notify each student that he/she is responsible for; a. following the administrative policies, standards and practices Of the University; b. his or her own transportation and living arrangements; C. reporting to University on time and Following all established regu- lations during the regular scheduled training hours of the University; and d. conforming to the standards and practices established by the Agency while training at the University. 9. That students are required to purchase smocks, books, folders, and supplies as deemed necessary by the EMS Training Office. 10. That upon payment of training charges, the University will commit a position in class for the agency/student in compliance with the Guidelines for Student - Selection, Exhibit A. 11. That in the event a student should drop out: or be dropped by the University -- for not meeting performance standards, Exhibit A, at any time during the --five month course the student training charge shall not be refunded. 12. That in consideration of the training described hereinabove to be rendered by the University, Agency shall pay University the sum of $675.00 for each bona. fide student the Agency enrolls for the training, said sum to be paid in full -prior to a student's participation in class orientation which is held approximately one week prior to the first day of course instruction. 13. That Agency shall provide Worker's Compensation coverage for its students during the entire period the student participates in the training program. 14. The Regents and Agency shall provide policies of insurance issued by insurance companies licensed to do business in the State of California insuring against the risks of bodily injuries, personal injuries, professional malpractice and property =3- damages. The Regents and Agency shall maintain such insurance in full force and effect during the term of this Agreement with a limit of liability of not less than two million dollars 02, 000, 000) . The Regents and Agency, within thirty (30) days of the date of this Agreement, shall furnish each other With certificates of insurance evidencing coverage in amounts required and for the risks listed above, and such certificates shall show that each party is named as am additional insured as the policy of the other. Such certificates of insurance shall also specify that the coverage indicated will not be cancelled or reduced unless the parties to this Agreement have been given written notice not less than thirty (30) days in advance of such cancellation or reduction. 7n the event either party fails to obtain or maintain.. such insurance coverage, then this Agreement shall, as of the date of such non- compliance, terminate. 15. Agency agrees to defend, indemnify and hold harmless The Regents, its officers, physicians, agents and employees from and against all losses and expenses,. including costs and attorneys' fees, by reason of liability imposed by law upon The Regents for damages because of bodily injury, personal injury, including death at any- time resulting therefrom, sustained by any person or persons, or because of damage to property, including loss of use thereof, arising out of or in consequence of the performance of this Agreement, provided such injuries to persons on: damages to property are due or claimed to be due to the negligence of Agency, its officers, students, agents or employees. 16. The Regents agree to defend, indemnify and hold harmless Agency, its officers, students, agents and employees from and against all losses and expenses, including costs and attorneys' fees, by rea»on o' liability imposed by law upon Agency for damages because of bodily injury, personal injury, including death at any time resulting therefrom, sustained b; any person or persons, or because of damage to property, including loss of use thereof, arising out of or in consequence of the -4- performance of this Agreement, provided such injuries to persons or damages to property are due or claimed to be due to the negligence of The Regents, its officers, Physicians, agents or employees. 17. That the term of this Agreement shall commence on the Ilth day of January 197 9, and end the 30th day of :tune I.g79 however, either party shall have the right to terminate this Agreement upon, six (b) months written notice to the other party. 18.
