Statement of the Matter
Robert Sonneborn made application to the Local Agency Formation Commission for annexation of 186.7 acres of land owned by Chandler-
Zimmerman Investments and known as Tootsie K Ranch.
At its January 8, 1979 meeting, LAFCO approved the annexation (see LAFCO Resolution attached as Exhibit 1) and authorized the City
of Carlsbad to annex the territory without notice, hearing and elec-
tion since the territory is uninhabited and all land owners (Chan-
dler-Zimmerman Investments) have consented to the annexation.
In order to complete the annexation, the City Council needs to
adopt a Resolution (see Exhibit 2) ordering the annexation. Lafco made no changes in the legal description.

RESOLUTION OF LOCAL AGENCY FORMATION COMMISSION
APPROVING A PROPOSED ANNEXATION TO THE
CITY OF CARLSBAD
"East Carlsbad (2.27) Annexation"
On motion of Commissioner Hamilton « seconded by Commissioner
Karn , the following resolution is adopted:
WHEREAS, a petition of landowners was submitted to this Commission
for annexation of territory to the City_jof Carlsbad
(hereinafter re-ferred to as the City), which petition was certified
sufficient by the executive officer on Mav 9. 1978 ;
WHEREAS, the executive officer of this Commission has filed his
report on said proposed annexation, which report has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS as follows:
1. The territory proposed to be annexed (hereinafter referred
to as the Territory) is as described in Exhibit A attached hereto.
2. The description of the boundaries of the Territory is not
definite and certain, but may be made so if modified to conform to
Exhibit B attached hereto.
3. The description of the boundaries of the Territory does
conform to lines of assessment and ownership.
^' All owners of land within the Territory have consented in
writing to the proposed annexation.
5. The Territory includes ^86.7 acres and is Un inhabited.
ft. The Territory proposed to be annexed is hereby designated
(-he "East Carlsbad (2.27) Annexation" .
7. The Commission certifies that it has reviewed and considered
the information contained in the EIR prepared by the City of Carlsbad.
The Commission finds that mitigation measures to reduce the significant
effects identified in the EIR are the responsibility of the City of
Carlsbad and not LAFCO, and that such measures can and should be
adopted by the City of Carlsbad.
8. The Commission hereby approves the proposed annexation subject
to the proposed conditions, if any as stated on Exhibit C attached
hereto.
9. The Commission hereby designates the City as the conducting
authority and authorizes the Legislative Body of said City to
initiate annexation proceedings in compliance with this resolution,
without notice and hearing and without an election.
10. The Executive Officer of this Commission is directed to
mail and file certified copies of this resolution in accordance
with Government Code Section 35159.

WHEREAS, a petition of landowners was submitted to the Local Agency Forma- )
tion Commission for the annexatfon of territory to the City of Carlsbad; and
WHEREAS, the Commission has determined that all landowners of the territorj
to be annexed have consented in writing to the proposed annexation; and
WHEREAS, the Commission has determined that the territory includes 186.7
acres and is uninhabited; and a description of the exterior boundaries of the
territory to be annexed is attached hereto as Exhibit "B"; and
WHEREAS, the Commission has conditionally approved the annexation, desig-
nated the City of Carlsbad as conducting authority, and authorized the City to
annex the territory without notice, hearing or election; and
WHEREAS, as a condition of annexation the Commission in its Reso
