Jk^ DATE: March 20, 1979 DEPARTMENT: Public Works SuBiect:SEWER ALLOCATLON/LINCOLN-MERGURY AND CHRYSLER CORPORATION Statement of the Matter The City Council, on October 3, 1978, approved Resolution No. 5543 allocating sewer capacity to a Lincoln-Mercury dealership and to a Chrysler dealership. Paragraph 2(b) of the resolution set forth times by which all permits, includ- ing building permits, must be obtained or the allocation would be revoked. The time limits have been met by Lincoln-Mercury and construction is underway. Chrysler indicates that they have received Coastal Commission permits and have received Planning Commission approval of their site plans. They are experiencing some internal problems including a change of project architects. Things appear to have been straightened out, but an extension of the compli- ance date is needed. They ask that tlie date'be changed from April 3, 1979 to July 15, 1979. Bussey City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 Dear Mr. Bussey: Reference:Chrysler sewer allocation, Car Country Resolution No. 5543 As you know, Lincoln-Mercury has drawn its sewer permit per terms of the Resolution and construction is well underway on that dealership. Chrysler has been delayed slightly by the Coastal Com- mission application and the lot split map for the portion of Lot 7 upon which its dealership will be located. As a result, we are requesting an extension of the date of April 3, 1979, which is set forth in paragraph 2.(b) of the Resolution for revocation of the allocation if all permits including the building permit are not obtained by that date. We have accomplished two of the three required permits. 1. The Coastal Commission Permit was received yester- day for both the development and the lot split. It may be of interest that two members of the Coastal Commission voted to take the project off the consent calendar with Commissioner Hedgecock remarking that Car Country should never have been built in the first place - that it should have stayed agri- cultural. 2. Planning Commission concept approval of Chrysler's proposed building and overall development was obtained at the February 14, 1979 meeting subject to future approval of the detailed landscape plan. The building permit cannot be sought until a bid has been accepted on the contract. Chrysler has had a reorganization with a new architect taking over for the previous one who is no longer with Chrysler. The company did not want to go forward Mr. Paul D. Bussey -2- March 7, 1979 with bids until Coastal Commission approval and the lot split were final. Lot split is now dependent on the pro- cessing of the final map through the City Engineer's office and that process is underway. In addition, Chrysler is wrestling with the requirements of the Energy Conservation Act and the Architectural Standards of Car Country to reduce the high cost of construction caused primarily by having to build an inner wall behind the required slump block exterior. The net result is a request for an extension of the April 3, 1979 date to July 15, 1979. Chrysler expects to be under construction before that date, but the July 15 deadline is a margin which gives them some flexibility. I assume this is a matter for Council action as an agenda item. Asam 1 RESOLUTION NO. 5721 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, EXTENDING THE COMPLIANCE DATE FOR OBTAINING 3 A BUILDING PERMIT FOR A PROPOSED CHRYSLER-PLYMOUTH DEALER- SHIP PURSUANT TO THE THIRD REVISION TO THE FIRST PHASE 4 SEWER ALLOCATION SYSTEM 5 WHEREAS, the City Council of the City of Carlsbad, by Resolution No. 5543, 6 allocated 14.6 EDU's to the Chrysler Realty Corporation; and 7 WHEREAS, said allocation was conditioned upon compliance with the permits 8 and fees provision of the Third Revision to the First Phase Sewer Allocation 9 System as adopted by Resolution No. 5542, except that Chrysler Realty Corpora- 10 tion was given until April 3, 1979 to obtain their Coastal Commission approvals 11 and conditional use permits and building permits; and 12 WHEREAS, Chrysler Realty Corporation has requested an extension of time 13 for compliance to said conditions until July 15, 1979; 14 NOW, THEREFORE BE IT RESOLVED as follows: 15 1. That the above recitations are true and correct. 16 2. That the City Council hereby authorizes an extension of time to the 17 Chrysler Realty Corporation until July 15, 1979 for obtaining their building 18 permit.
