DATE: March 20. 1979 DEPARTMENT: City Manager Subject: REQUEST TO ADDRESS COUNCIL - TED L. VALLAS Statement of the Matter The City Council, on September 20, 1977, denied a request by the County for sewer capacity to allow for construction of a new facility. The County then proceeded to authorize construction with sewer service to be provided by an evapo-transpiration unit. Subsequent to that action, the problems with the design and construction of evapo-transpiration units became known and it was established that the system for the airport building would require a much larger spreading bed with an attendent increase in construction cost. The building, which began construction prior to annexation of the airport, is essentially complete. The sewage disposal system is not constructed. It is believed that this is the basis for their request for emergency con- sideration. Exhibits 1. Letter to City Council dated March 8, 1979 requesting time to address Council 2. Supporting documents mentioned in above letter Recommendation Although the circumstances of this development problem were created by the -County and .developer, the Council may, at this stage, wish to treat the problem as a failed septic system and authorize the staff to provide a sewer connection. If not, the request may be denied by minute motion. Our building consisting of approximately 40,000 square feet, is completed with the exception of some office space that is presently in the construction stage. Vallas TLV:j ELCO SMR P.O.Box 550 Rancho Santa Fe, Ca.92067 March 15, 1979 Mr. Paul Bussey City Manager Carlsbad, Ca. 92008 Dear Mr. Bussey: Attached please find backup material for my request to appear before the City Council regarding emergency sewer hook-up at Palomar Airport. The following facts are offered to better with my problem. acquaint you and the Council 1. On April 5, 1978 a permit was granted by the County of San Diego approving a mini sewer plant. 2. On May 5, 1978 approval was granted by the San Diego Coast Regional commission for the construction and land use. 3. Building permits were granted by the County and construction was started. 4. About the time that we were 80% complete on the construction we received a letter from the Department of Public Health informing us that due to numerous failures of the type of sewer system approved for our project they would require a re-design. With a provision that should there be a failure we would be required to have the system pumped by a licenced septic tank pumper. The permit had never been revoked. 5. During the periods from the original approvals through this date we have spent in excess of $^50,000. 6. We have been attempting to resolve the sewer problem since receiving the county health department letter but were unable to get the required criteria for the change. The feeling of the Department is that since we are now in the City of Carlsbad we should be able to hook up to the Carlsbad system due to the obvious potential failure of the approved system, and the fact that Carlsbad does not allow (by their ordiance) any transpiration system. 7. We have at the request of the Health Department made all the necessary tests to determine whether or not a septic system acceptable to Carlsbad could work on the property. These tests proved negative. - 2 - 8. We presently have not only the burden of invested capital but also contractual obligations to tenents.
