The City Council, at your March 20, 1979 meeting, directed
the City Attorney to prepare an ordinance prohibiting the
operation of motor vehicles on private property without
written permission from the property owner. An ordinance
substantially similar to one adopted by Oceanside is
attached.

Council Action:
4-3-79 Ordinance No. 3113, amending the Carlsbad Municipal Code to
prohibit the operation of motor vehicles on private property
without permission of the owner, was introduced.
4-17-79 Council adopted Ordinance No. 3113.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA
AMENDING TITLE 8, CHAPTER 8.28 OF THE
CAR~SBAD MUNICIPAL CODE BY THE AMEND
MENT OF SECTION 8.28.040 TO PROHIBIT
THE OPERATION OF MOTOR VEHICLES ON
PRIVATE PROPERTY WITHOUT PERMISSION
OF THE OWNER THEREOF.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: That Title 8, Chapter 8.28 of the Carlsbad
Municipal Co~e is amended by the amendment of Section 8.28.040
to read as follows:
11 8.28.040 Driving motor vehicles on private propertv
12 prohibited. (a) It shall be u..nlawful for any person to
operate or drive or leave any vehicl~ in, over, or upon any
13 private property without the written permission of the owner
thereof, or the person entitled to the immediate possession
14 thereof, or the authorized agent of either •.
(b) Whenever any person is stopped by a peace officer
15 pursuant to this section, he shall, upon the request of such
peace officer, display said written pe:i;-mission."

EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall
certify to the adoption of this ordinance and cause it to be
published at least once in the Carlsbad Journal within
fifteen days after its adoption.
INTRODUCED ANP FIRST READ at a regular meeting of the
Carlsbad City Council held on the -.3-r_d __ day of April
1979 and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 17th day of_A~p_r_i~l ____ , 1979 by
