Subject: CITATIONS FOR PARKING IN FIRE LANES Statement of the Matter Shopping center parking areas generally have a 20! to 30! fire lanes for use by the fire department in case of eme access roadway in front and rear of building and are deemed encies. rg- We have a continuing problem of people parking their vehicles in front of the store, blocking not only access to the stores but in many cases blocking the access road itself. The fire department has prepared an amendment to the City Code which would allow either the fire or police department to have the vehicle removed or to cite for violation. l;xhlbit Ordinance No. 0 3 Recommendation If Council concurs, introduce Ordinance No. p 3,3 for first reading. Council Action: 4-3-79 Council introduced Ordinance No. 2033, amending the Carlsbad Municipal Code to provide for access roadways for fire apparatus and to prohibit parking in such fire lanes, as modified by Council. 4-17-79 Council adopted Ordinance No. 2.033. A5 ORDINANCE NO. 2033 2 AN ORDINANCE 07% THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA 3 AMENDING TITLE 17, CHAPTER 17.04 OF THE CARLSBAD MUNICIPAL CODE BY 4 THE AMENDMENT OF SECTION 17.04.060 TO PROVIDE FOR ACCESS ROADWAYS FOR 5 FIRE APPARATUS AND TO PROHIBIT PARKING IN SUCH FIRE LANES. 6 The City Council of the City of Carlsbad, California 7 8 9 10 hereby ordains as follows: SECTION 1: That Title 17, Chapter 17.04 of the Carlsbad Municipal Code is amended by the amendment of Section 17.04.060 to read as follows: 11 17.04.060 Section 13.208, Subsection(b) amended-- 12 Access roadways for fire apparatus. Section 13.208 of the Uniform Fire Code is amended by the amendment of Subsection(b) 13 to read: '(b) The required width of access roadways shall not 14 be obstructed in any manner, includintj the parking of vehicles. Curbs along roadways shall be painted red. The entrance to 15 all access roadways shall be posted with signs not more than fifty feet apart and not more than nine feet high, to have 16 six inch high letters. The sign shall read: "No Parking -- Fire Lane", and/or other wording deemed appropriate by the 17 Fire Chief. This sign shall also contain a warning that violators are subject to tow -away. 18 No person shall stop, park or leave standing any vehicle in a fire lane. This prohibition shall not apply in 19 any respect to any vehicle owned or operated by a Fire Department and clearly marked as a Fire Department vehicle. 20 Any person violating this section is guilty of an infraction and shall pay a fine of no less than $25.00. 21 In addition to other available means of enforcing this code, obstructions to required access roadways shall be 22 subject to removal.
