Mgr. :) ABATEMENT OF OUTDOOR ADVERTISING STRUCTURES (SB 462) Statement of the Matter The Carlsbad sign regulations do not permit outdoor advertising (billboards). Existing billcoards are considered non-conforming, which means they can't be expanded or replaced. It has been the intention of the City to abate these non-conforming signs in the future if they are not voluntarily removed. Recently the California Supreme Court approved abatement with amori- tization as a constitutional and lawful means of eliminating non- conforming uses. Possibly at the suggestion of the outdoor advertising industry, a bill has been drafted that would require statewide regulation in the area of outdoor advertisement (SB 462) The City of El Cajon recently adopted a Resolution opposing EB 462 since they feel statewide regulation of outdoor advertisement would severely limit the ability of a city to deal with its particular problems and would constitute an unwarranted interference with matters of local concern, and an invasion of local police powers. WHEREAS, the appearance of a community and the health, safety and welfare of its inhabitants is solely a matter of local concern; and WHEREAS, regulation of outdoor aCvertisement can have? direct effect on the appearance ·of a community, which thus impacts the economy and the welfare of its citizens; and WHEREAS, the antique characteristics of communities through- out California require individualized zoning treatment; and WHEREAS, statewide regulation of -~gning and outdoor adver- tisement cannot adequately deal with lo~al needs; and WHEREAS, abatement of non-conforming uses through the exercise of the police power with a period of amortization has been recognized by municipalities and the courts as a reasonable procedure for many years; and WHEREAS, the elimination of said right of cities without remuneration to the property owner would have a serious adverse lmpact on the economy of cities desiring to enhance their environments; and WHEREAS, the hereinafter proposed legislation would provide a windfall to one particular type of property owner without any reasonable justification therefore; and WHEREAS, the supreme Court of the Stc.te of California has recently approved abatement.with amortizacion as a constitutional and lawful means of eliminating non-conforming uses; atd WHEREAS, senate Bill No. 462 (Zenevich), by requiring state- wide regulation·in the area of outdoor advertisement would severel limit the ability of a City to deal with its particular (zoning) problems and would constitute an unwarranted interference with mattP.rs of local concern, and an invasion of local police powers.
