Mgr.fc SB 201 — NEW SCHOOL FEE LAW Statement of the Matter The City Council, at your April 4, 1978 meeting, indicated your intention to concur in the findings of overcrowding made by the Encinitas, San Dieguito and San Marcos School Districts pursuant to SB 201. The City Attorney was directed to return with the appropriate resolutions. A resolution for each of the school districts is attached. WHEREAS, the Governing Board of the Encinitas Union School District, by adoption of a resolution on January 24, 1978, made a series of factual findings regarding conditions of overcrowding in certain school attendance areas and methods of mitigating such conditions pursuant to California Government Code Section 65971; and WHEREAS, the Governing Board of the Encinitas Union School District has notified the City Council of the City of Carlsbad of said findings by forwarding a copy of said resolution which is on file with the City Clerk and incorporated by reference herein; and WHEREAS, the City Council at their April 4, 1978 meeting considered said findings and the factual support therefor contained in said resolution; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the Governing Board of the Encinitas Union School District has made the findings contemplated by Government Code Section 65971 and that said findings are supported by clear and convincing evidence as reflected in the resolution adopted by said District on January 24, 1978. 2. WHEREAS, the Governing Board of the San Dieguito Union High School District, by adoption of a resolution on February 9, 1978, made a series of factual findings regarding conditions of over- crowding in certain school attendance areas and methods of mitigating such conditions pursuant to California Government Code Section 65971; and WHEREAS, the Governing Board of the San Dieguito Union High School District has notified the City Council of the City of Carlsbad of said findings by forwarding a copy of said resolution which is on file with the City Clerk and incorporated by reference herein; and WHEREAS, the City Council at their April 4, 1978 meeting considered said findings and the factual support therefor contained in said resolution; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.
