CARLSBAD TRACT 74-14(A) - Templin Heights, Unit 1
Statement of the Matter
MLM Development, Inc., has requested the acceptance of the public improvements
of the subject subdivision. A final inspection was conducted and the improve-
ments are found to be acceptable for maintenance. "As built" drawings are on
file in the Engineering Department, and final accounting is completed.
The City shall retain a $10,000 erosion control bond and a $40,000 bond for
the future extension of Elm Avenue which are currently being held by the
City Clerk. Release of these bonds shall be at the discretion of the City
Engineer upon compliance with the conditions of their respective agreements.

Recommendation:
If Council concurs, accept the Public Improvements as completed, direct the
Utilities/Maintenance Director to commence their maintenance, the City Clerk
to record the Notice of Completion and release the applicable bonds, and the
Finance Director to refund the balance of the Trust Account of 52,602.24 to
the developer.

Dear Mr. Flanigan:
Please initiate the necessary procedures that will lead to final
acceptance by the City of Carlsbad for the improvements required
within the boundaries of Tempi in Heights Unit I.
It is my understanding that your staff has finaled the project
in the field. Also Carlsbad Municipal Water District has review-
ed the plan, E. Brian Smith Engineers have made the necessary
corrections and a copy of the "as builts" are on file in your
office.
