Statement of the Matter • At its meeting of December 19, 1978, Council instructed Staff' to, prepare documents to bring thp, City into compliance with federal guidelines on , Affirmative Action'. Section 3 ofthe Housing and Urban Development Act of 1968 requires recipients of -federal assistance for Community Development Block Grant Projects to train and employ lower income residents of she project areas and to utilize business firms owned by the project area residents and/or•located in the project area,• to the greatest extent feasible. As a•direct recipient'of Community Development Block Grant funds, the County of Fan -Diego is required to comply with Section 3 of the Housing and:Urban Development Act of 1968. The County is passing that compliance•requirement alcYg to all eligible cities that receive Block Grant funding under the County's•Urban Grant Application. Consequently, for the City to continue to receive this•allocation of funds ons must also forma the County' the City lly comply with the Section 3 re- froin quirements. Henthorn, Redevelopment Coordinator FROM: Andrew Aitken, Assistant Redevelopment Coordinator SUBJECT: AFFIRMATIVE ACTION PLAN FOR TRAINING, EMPLOYMENT AND BUSINESS OPPORTUNITIES CONNECTED WITH COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS Background As a recipient of Community Development Block Grant funds, the City must comply with Section 3 of the Housing and Urban Develop- ment Act of 1968. Section 3 requires developers and their sponsors of community %velopment block grant projects which are accomplished through financial assistance from the Federal Department of Housing and Urban Development- to do the following, to the greatest extent feasible: 1) Train and employ lower income residents of the project area, 2) Utilize business firms owned by project area residents, and 3) Utilize business firms located in the project area. The attached plan will require contractors and/or their sub- contractors to report their good faith effort to recruit, employ, and if necessary, to train project residents to the greatest extent feasible. The plan also will require contractors and/or their subcontractors to report their good faith efforts to plan their expenditures and advertise their bids in a manner that will utilize to the greatest extent feasible, business firms owned by project area residents and/or located in the project area. Existing Procedure Presently contractors and/or their subcontractors who utilize federal assistance are required to comply with the federal affirma- tive action programs. Before a contract can be let, a contractor and/or his subcontractor must show proof of compliance to the federal agencies. however, at this time there exists no mechanism to require contractors to show proof of compliance to the City. (It should be noted that contractors and/or their subcontractors have supplied copies of this information voluntarily to the City.) Because the City is being required to requirements, a plan should be adopted authority to require all applicants t o Analysis The City's existing Affirmative Action Program (Resolution No. 5043) pertains to "in-house" activity: i.e. the hiring and training of City employees. The adoption of this plea extends the sphere of influence of Affirmative Action to include those "non -in-house" projects. The administration of this plan will be implemented at no additional cost or personnel in the same manner as the existing voluntary policy. The adoption of this plan will indicate to the Federal Department of Housing and Urban Development a good faith effort on behalf of the City of Carlsbad to conform with the regulations relating to the content of an acceptable Section 3 Affirmative Action Plan. Furthermore, Council's adoption of the enclosed resolution will enable staff to implement the City of Carlsbad Affirmative Fair Marketing Plan for Community Development Block Grant Projects. Recommendation That the CounciL adopt the enclosed resolution which will establish the City of Carlsbad Affirmative Action Plan for training, employ- ment, and business opportunities in connection with Community Devejopment Block Grant projects. AA:jd 4/20/79 I RESOLUTION NO. 5774 2 RESOLUTION ESTABLISHING AFFIRMATIVE ACTION PLAN FOR TRAINING, EMPLOYMENT AND BUSINESS 3 OPPORTUNITIES FOR COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS 4 5 WHEREAS, the City of.Carlsbad is a recipient of community 6 development block grant funds from the United States Department 7 of Housing and Urban Development (HUD) under the Housing and 8 Community Development Act of 1974; and 9 WHEREAS, the Housing and Community Development Act of 1974 10 prescribes that Section 3 of the Housing and Urban Development 11 Act of 1968 requiring training, employment and business oppor- 12 tunities be made available to lower income persons in connection 13 with federal assistance programs shall apply to community develop- 14 meat block grant projects; and 15 WHEREAS, said Section 3 of the Housing and Urban Development 16 Act of 1968, as amended, requires recipients of community develop- 17 ment block grants to provide to the greatest extent feasible 18 training and employment arising from any project supported by 19 such funds to lower income persons residing in the area of such 20 project; and 21 WHEREAS, Section 3 also requires such recipients to provide 22 that to the greatest extent feasible contracts for work under 23 any such project be awarded to business firms located in or owned 24 in substantial part by persons residing in the area of such 25 project; and 26 WHEREAS, the Housing and Community Development Act of 1974 27 prescribes that community development block grant projects shall 28 be conducted and administered in conformity with the Civil Rights -1- 1 Act of 1964; and 2 WHEREAS, Executive Order 11246 and Executive Order 11375, 5 require federal contractors and subcontractors to establish 4 affirmative action programs to ensure equal employment opportuni- 5 ties; and '6 WHEREAS, the Equal Employment Opportunities Act of 1972 7 requires local governments to comply with Executive Order 11246 8 when contracting with the Federal government; and 9 WHEREAS, the attached Exhibit P, described the Affirmative 10 Action Plan for Training, Employment and Business opportunities 11 in Connection with Community Development Block Grant Projects i 12 establishes an affirmative action program in compliance with the 13 Housing and Urban Development Act of.1968, as amended, the Housing 14 and Community Development Act of 1974, and Executive Orders 11246 '15 and 11375; and 16 WHEREAS, the Council desires to take affirmative action in 17 accordance with such plan to assure compliance with said Section 3 18 and the Housing and Community Development Act of 1974; NOW 19 THEREFORi 20 IT IS RESOLVED AND ORDERED that the attached Exhibit A, 21 described as the Affirmative Action Plan for Training, Employment 22 and Business Opportunities in Connection with Community Develop- 23 ment Block Grant Projects, which sets forth rules, regulations 24 and administrative processes for affirmative action as mandated 25 by the Housing and Community Development Act of 1974 is hereby 26, approved and adopted by this Council. 27 IT IS FURTHER RESOLVED AND ORDERED that the Affirmative 28 Action Officer or his Agent shall review this Resolution -2- _a 1 beginning on July 1, 1984 and recommend to the City Council by 2 January 1, 1985 whether to continue, delete or revise it. 3 PASSED, ADOPTED AND APPROVED by the City Council of Ca£lsbad, 4 State of California, this 15th day of Mav ► 1979, by 5 the following vote: 6 AYES: Councilmen Packard, Skotnicki, Anear, Lewis and Councilwoman Casler 7 NOES: None 8 ABSENT: None 9 ' 10 RONALD C. RAUTENKRANZ, City C 1 13 ' (SEAL) 14 15 16 17 18 19 20 21 22 26 24 25 26 27 28 - 3- Exhibit "A" to Resolution 5774 CITY OF CARLSBAD AFFIRMATIVE ACTION PLAN FOR TRAINING, EMPLOYMENT AND BUSINESS OPPORTUNITIES IN CONNECTION WITH COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS CITY OF CARLSBAD AFFIRMATIVE ACTION PLAN FOR TRAINING, EMPLOYMENT AND BUSINESS OPPORTUNITIES IN CONNECTION WITH COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS I. PURPOSE This plan implements requirements of Section 3 of the Housing and Urban Development Act of 1968 as set forth in Title 24 of the Code of Federal Regulations, Part 135, to the greatest extent feasible, to provide training and employment opportuni- ties to lower income persons and to utilize certain business firms in connection with community development block grant projects: II. POLICY A. Agencies projects under th e B. Contractors and/or their subcontractors which submit bids or negotiate for community development block giant projects with the City of Carlsbad, eligible agencies shall agree to comply with this plan, to the greatest extent feasible, before contracts shall be awarded for such projects. C. Contractors/developers/or their sponsors shall agree and implement an affirmative fair housing marketing plan in coordination with the City of Carlsbad as a condition to receiving financial assistance for community development block grant projects, to the greatest extent feasible. III'. APPLICABILITY Section 3 requirements contained in this plan apply to all community development block grant projects, contracts/agree- ments or bids awarded, or entered into, by the City of Carlsbad, agencies, and to contractors and subcontractors who perform work or provide services or supplies in connection with the community development block grant projects. IV. DEFINITION OF TERMS A. Section 3 - The third section of the Housing and Urban Development Act of 1968. Section 3 provides that community development block grant projects which are ssistance by the Department being provided financial a B. C. a Im F. G. H. of Housing and Urban Development shall, to the greatest extent feasible, be accomplished by training and employ- ing lower income residents of the project area and by. utilizing business firms which are located in theareas of such projects or owned in substantial part by residents of the project areas. Section 3 Covered Project - Any nonexempt community vided development block grant project which is being pro financial assistance by the Department of Housing and Urban Development (11UD) except where the financial assist- ance is in the form of insurance or guarantee. Exempted Project - Any housing project under Section 235 and 236 of the National Housing Act and any public housing exceed program ft$50,000 OrOOnestimated lessonsuch andprojects. Section 3 Clause - The clause contained in Attachment A which shall be in all contracts in connection wi'h a Section 3 covered project. Lower Income Resident of the Project Area - Any individual who resides within a Section 3 covered project area and whose family income does not exceed 80 percent of the median income in the Standard Metropolitan Statistical Area in which the project is located. Business Firm Located in Project Area - Any business firm including a contractor, subcontractor or supplier within Depart - the Section 3 covered project area, listed on the Deeligi ment of Housing and Urban Development's registry -of eligible business firms, which qualifies as small under the small business size standards of the Small Business Administration. Business Firm owned in Substantial Part by Resident(s) of Project Area - Any business firm, including a contractor, subcontractor, or supplier which: 1. Is 51 percent or more owned by person(s) residing within the Section 3 covered project area who are considered by the Small Business Administration to be socially or economically disadvantaged: 2. Is listed on the Department of Housing and Urban Development's registry of eligible business firms; and 3. Qualifies as small under the small size standards of the Small Business Administration. Project Area - The area within the City of Carlsbad and -2- designated by the City of Carlsbad as an urban renewal area. I. Agency - A public agency or community organization which applies for or receives community development block grant funds from the City of Carlsbad. J. Contractor - Any entity which performs work in connection with a Section 3 covered project. K. Subcontractor - Any entity (other than a person who is an employee of the contractor) which has agreed or arranged with a contractor or another subcontractor to tndertake a portion of the contractor's or other sub- contractor's obligation for the performance of work in connection with a Section 3 covered project. L. Grantee - The City of Carlsbad or agencies which have agreed to participate in the accomplishment of a Section 3 covered project. M. Good Faith Effort - An affirmative action effort, docu- mented by records, to comply with this plan. N. Contract - An agreement, offer and acceptance, purchase order, lease or other arrangement creating an obligation between two cr more parties in connection with the accomplishment of a Section 3 covered project. V. GRANTEE COMPLIANCE RESPONSIBILITIES Each Grantee shall to the greatest extent feasible: A. Establish projection data for the utilization of project area business firms in format contained in Attachment E and maintain on file with contract documents. B. Insure that the Section 3 clause contained in Attachment A is incorporated in all contracts for work made with or between contractors and subcontractors and any other parties in connection with a Section 3 covered project. C. Insure that contracts which are typically let on a negotiated basis in areas other than Section 3 covered project areas are also let on a negotiated basis, when- ever feasible, within Section 3 covered project areas. D. Inform prospective contractors that they shall be required to provide prior to the award of a contract: 1. An executed Certificate of Compliance as contained in Attachment B (unless Section 3 requirements are a part of the contract document). 2. Projection data for the utilization of project area residents and.business firms as contained in Attachment F. 3. An executed assurance as contained in Attachment G that a clause will be included in any contract to sell, lease, or transfer land on which the Section 3 covered project work is being performed requiring the purchaser, lessee, or redeveloper to assume the same obligations as the initial contractor. (The Section 3 clause contained in Attachment A shall also be included in any such contract.) E. Insure compliance by contractors with this plan. F. Provide contractors with a copy of this plan. VI. CONTRACTOR AND SUBCONTRACTOR COMPLIANCE RESPONSIBILITIES Each contractor and subcontractor shall to the greatest extent feasible: A. In the Utilization of Lower Income Project Area Residents as Trainees/Apprentices and Employees: 1. Establish projection data for the utilization of lower income project area residents as trainees/ apprentices and employeees in format contained in Attachment F and submit such data to the project officer administering the contract in the City, eligible city, or agency for approval prior to beginning work on the project. 2. Inform lower income residents of the project area of training and employment opportunities by advertising in local news media, posting signs at the proposed project site and by contacting community organizations (see Attachment C). 3. Promptly notify the project officer in the city or agency when: a. The union(s) with which the contractor or subcontractor has a collective bargaining agreement do not refer back to the contractor or subcontractor a lower income resident worker sent by the contractor or subcontractor to the union(s); and b. The contractor or subcontractor has her information that the Manion referral process has impeded efforts to comply with this plan. A. Participate in training programs appropriate to employment needs such as programs sponsored by community organizations and public and private institutions operating within or serving the project area. S. Disseminate an equal employment opportunity policy by including it in any policy manual; publicizing it in company newspapers, annual reports, etc; conducting staff, employee, and union representative meetings. 6. Substantiate a good faith effort in accordance with Paragraph VIII, s i B. In the Utilization of Project Area Business Firms: 1. Establish projection data for the utilization of project area business firms in format contained in Attachment F and submit such data to the project officer administering the contract in the city or agency for approval prior to beginning work on the project. 2. Advertise for subcontractors' bids in available .project area news media. 3. Inform project area business firms of opportunities to be considered for contracts for work ythe padvertising in local news media, posting signs roposed project site and by contracting community ograniza- tions (see Attachment D).. 4. Substantiate a good faith effort In accordance with paragraph VIII. VII. ADDITIONAL CONTRACTOR CODIPLIANCE RESPONSIBILITIES Each contractor shall: A. Insure that the Section 3 clause contained in Attachment A is included in all contracts with subcontractors performing work on a Section 3 covered project. B. Tnform subcontractors of their responsibility to comply with this plan. C. Insure, to the greatest extent feasible, compliance by subcontractors with this plan. VIII. CONTRACTOR AND SUBCONTRACTOR GOOD FAITH EFFORT REQUIREMENTS Each contractor and subcontractor shall, as a minimum, take the following actions tosubstantiate that a good faith effort plahas been made to comply w h this wer ncome ts A. Document the trainees/aps pto utilize prentices employeeso(seerparagraph1VlnA). as trainees/app • B, Document the steps taken to utilize project area business firms (see paragraph VI - B): C. Compile and maintain a list of all lower income residents -5- who have applied for training or employment, along with documentation that individuals were assigned to trainee positions or were employed, provided they were eligible and vacancies existed. (Justification will be documented for any such persons not assigned to training positions or not employed. If vacancies do not exist, applicants for training or employment shall be assigned to the first available vacancy). D. Maintain .a record of jtstification that any vacant trainee i and employment positions filled immediately prior to undertaking project work were not filled to circumvent this plan. E. Appoint a member of the contracting firm to be the person responsible for insuring the contractor's compliance with this plan. This individual shall also be responsible to submit reports and maintain records required by Para- graph XI. ; i IX. ADDITIONAL CITY OF CARLSBAD RESPONSIBILITIES The City of Carlsbad shall: A. Assist agencies and contractors and subcontractors, when necessary, in the implementation of this plan. B. Monitor agencies, contractors and subcontractors perform- ing work on contracts let by the City of Carlsbad fcr compliance with this plan. Compliance shall be based on results achieved and documented in good faith efforts. C. Compile data and prepare reports to recommend sanctions and penalties, if required, as provided for in paragraph XIII. X. ADDITIONAL ELIGIBLE AGENCY REPONSIBILITIES Eligible agencies shall: A. Assist contractors and subcontractors, when necessary, in the implementation of this plan. B. Monitor contractors and subcontractors performing work on contracts let by the eligible city or agencies for compliance with this plan. Compliance will be based on results achieved and documented good faith efforts. C. Compile data and prepare reports to recommend sanctions and penalties, if required, as provided for in paragraph XIII. -6- I XI. CONTRACTOR AND SUBCONTRACTOR REPORTS AND RECORD KEEPING' t Contractors and subcontractors shall: A. Submit a report to the grantee which let the contract (City of. Carlsbad or eligible agency) each six months. from the date the project is approved, or as specified in the contract, until the project is completed. Upon completion of the project, a final report shall be submitted to the grantee. Each report shall be cumula- tive and shall contain the information outlined in Attachment H. B. Maintain records required by paragraph VIII to document a good faith effort and such other records as are deemed necessary for good project administration. These records shall be made available to the city eligible agency, state and federal authorities upon request. XII. FILING A GRIEVANCE OR COMPLAINT A. A grievance or complaint may be filed on behalf of any lower income resident or eligible business firm of the project area alleging noncompliance with Section 3 covered project requirements. B. Such grievance or complaint shall be filed by mailing it or presenting it within 90 days from the date of the action (or omission) upon which the grievance or compliant is based to one of the following: 1. The City of Carlsbad, Contract Compliance. 2. The eligible agency which let the community develop- ment block grant project. 3. The San Diego Equal Opportunity Office of the Depart- ment of Housing and Urban Development. a 4. The Assistant Secretary for Equal Opportunity, Depart- ment of Housing and Urban Development, washingtor., D.C. 20410. XIII. SANCTIONS AND PENALTIES A. Failure or refusal to comply within the requirements of this plan and give satisfactory assurance of future compliance with this plan shall be the basis for applying sanctions and penalties. B. The City of Carlsbad City Council may apply any of the following sanctions and penalties: Y 1. Cancellation, termination or suspension in whole or in part of the grant, contract or agreement. -7- i 2. A determination of ineligibility of disbarment from ' ! any further assistance or contracts until satisfactory j assurance of future compliance has been received. C. The Department of housing and Urban Development may apply such sanctions and penalties as are specified by the grant or loan agreement or contract through which federal assistance is provided, as well as such sanctions as are specified by the rules, regulations or policy governing the program. AM jd 4/20/79 -8- ATTACHMENT "A" SECTION 3 CLAUSE A. The work to be performed under this coi ract is on a project assisted under a program providing direct federal financial assistance from the Department of Housing & Urban Development Act of 1968, as amended, 12 USC 1701U. S-ction 3 requires that, to the greatest extent feasible, opportunities for train- ing and employment be given to lower income residents of the project area and contracts for work in connection with the project be awarded to business concerns which are located in or owned in substantial part by persons residing in the area of the project. B. The parties to this contract will comply with the provisions of said Section 3 and the regulations issued pursuant thereto by the secretary of Housing & Urban Development set forth in 24 CFR, 135, and all applicable rules and orders of the Department of Housing & Urban Development issued hreunder this prior to the execution of this contract. The parties contract certify and agree that they are: under no contractual or ether disability which would prevent them from complying with these requirements. C. The contractor will send each labor organization or represen- tative of workers with whom he/she has a collective bargaining agreement or other contract or understanding, if any, a notice advising the said labor organization or workers' representative of his/her commitments under this Section 3 clause and shall post copies of the notice in conspicuous places available to employees and applicants for employment or training. D. The contractor will include this Section 3 Clause in every subcontract for work in connection with the project and will, at the direction of the applicant for or recipient of federal financial assistance, take appropriate action pursuant to the subcontract upon a finding that the subcontractor is in viola- tion of regulations issued by the Secretary of Housing & Urban Development, 24 CFR, 135. The contractor will not subcontract with any subcontractor where he/she has notice or knowledge that the latter has been found in violation of regulations under 24 CFR, Part 135, and will not: let any subcontract unless the subcontractor has firsu provided it with a preliminary statement of ability to comply with the requirements of these regulations. E. Compliance with the provisions of section 3, therulregulations set forth in 24 CFR, 135, and all.app icable s and orders of the Department of Housing & Urban Development issued there- under prior to the execution of the contract shall be a condition of the federal financial assistance provided to the project, binding upon the applicant or recipient for such assistance, its successors and assigns. Failure to fulfill these require- ments shall subject the applicant or recipient, its contractors and subcontractors, its successors and assigns to those sanc- tions specified by the grant or loan agreement or contract through which federal assistance is provided and to such sanc- tions as are specified by 24 CFR, 135.
