STATEMENT OF MATTER

Joan and Richard Caldwell have asked that the City Council relieve them
of the requirement to construct street improvements on 280 feet of
frontage on El Camino Real in conjunction with their minor subdivision.
They ask instead that a lien contract be substituted.
The City Code (Chapter 20.28) requires public improvements as a condition
of a minor subdivision, but states that fulfillment of construction
requirements shall not be required until at or after such time as a
building permit or grading permit is issued by the City, or at such time
as may be provided by an agreement. The subdivider must prepare plans
and specifications of the improvements which are made a part of the
agreement to improve.
Alternatively the City may accept a lien contract for improvements, as
proposed by the Caldwells. Under such a lien, the future owners of the
property may be requested to install improvements at such time as the
agreement requires. Under this arrangement, the buyer of the Caldwell's
lot would be obligated to fund over $25,000 of street improvements at an
unknown time in the future. Such a large lien against a two-acre residen-
tial lot seems inadvisable.

RECOMMENDATIONS
If the Council concurs, that the City accept an agreement for the
construction of improvements on Minor Subdivision 393 prior to issuance
by the City of a building or grading permit.
Council Action:
5-15-79 Council directed staff to determine if staff and developer can
agree to partial improvements at this time with a lien contract
on the remaining improvements.
