STREET LIGHTING MAINTENANCE DISTRICT NO. 1 .(ANNUAL LEVY)
STATEMENT OF MATTER :
The City Council, at its June 21, 1977 meeting adopted Resolution No. 5123
forming Street Lighting District No. 1. Ont June 20, 1978, the City Council
approved annexations to the Street Lighting District.
Annually, the City Engineer must prepare a report for the next fiscal year
to develop funds to maintain Street Lighting District No. 1 improvements.
The required report includes: • . ,
1. An Estimate of the Costs of Improvements to be Maintained for the
period July 1, 1979 to June 30, 1980. The Cost Estimate is attached
as Exhibit 1. ^.
2. A Diagram of the Street Lighting District. The Diagram is on file
in the City Engineer's Office and will be displayed in the Council
Chambers during the June 5 meeting.
3. An Assessment Schedule showing assessments levied against each lot or
parcel shown on the Diagram. There are three copies of the Assessment
Schedule, one of which is on file in the City Clerk's Office, and the
others are on file in the City Engineer's Office. Two copies will be
available during the June 5 Council Meeting.
The Cost Estimate for the original District was $146,789.66 or $54,545 less
than this year. The increase in the Cost Estimate is due to the cost of
maintaining the improvements in the annexed areas.

ANNUAL REPORT OF THE CITY ENGINEER
Pursuant to direction from the City Council, submitted herewith
is the "Report," consisting of the following documents pursuant
to the provisions of Division 14, Part 1 of the Streets and
Highways Code of the State of California, and specifically
Section 18091 thereof.
1. AN ESTIMATE OF THE COSTS of the improvements to be main-
tained for the ensuing twelve-month period, being from
July 1, 1979 to June 30, 1980
2. A DIAGRAM of the Street Lighting District. Said Diagram
shall show the exterior boundaries of the Street Lighting
District, the boundaries of any zones within the Street
Lighting District, the lines and dimensions of each lot
or parcel within said Street Lighting District, and each
parcel shall be identified by a distinctive number or
letter. The lines and dimensions of each lot shall con-
form to those shown on the County Assessor's map for the
fiscal year to which the "Report" applies.
3. AN ASSESSMENT SCHEDULE showing the.proportionate amount
of the assessment to be charged in proportion to the
benefits to be received by each lot or parcel as shown
on the above referenced Diagram.
All lots and parcels of land known as public property,
as defined under Section 18014 of Part 1 of Division 14
of the Streets and Highways Code of the State of California,
as amended, have been omitted and are exempt from any
assessment under these proceedings.

WHEREAS, this City Council has previously adopted its Resolution
of Intention and taken all steps necessary, pursuant to the pro-
visions of the "Street Lighting Act of 1919," being Division 14,
Part 1 of the Streets and Highways Code of the State of California,
for the formation of a Street Lighting District in said City,
said District having been designated as
STREET LIGHTING DISTRICT NO. 1
(hereinafter referred to as the "DISTRICT") .

WHEREAS, at this time a report has been prepared pursuant to
Section 18091 of the Streets and Highways Code of the State of
California, and said report, contemplates the filing of an
Assessment Schedule showing the proportionate amount of the
assessments: to be charged in proportion to the benefits to be
received by each lot or parcel of land as shown on the Diagram
for the ensuing twelve-month period, being the period commenc-
ing on the 1st day of July, 1979 _ and ending on

NOW, THEREFORE, I, Lester G. Evans _ _ , as
City Engineer of saTd City, by virtue of the power vested" in
me by said Act and by direction of the City Council of this
City, hereby set forth the Assessment Schedule showing the
apportionment of the costs and expenses in proportion to the
benefits to be received. Attached hereto find an Estimate of
the Costs showing the costs and expenses of the improvement
for the next ensuing twelve-month period as above set forth.
As required by law, a Diagram showing the Assessment District
and the boundaries and dimensions of each parcel has been
prepared, a copy of which is on file in the office of the
City Engineer.

I, as City Engineer, do hereby assess and apportion said total
amount to be assessed upon the several parcels of land within
said Street Lighting District liable therefor and benefited
thereby in proportion to the estimated benefits to be received
by said parcels, respectively, from said maintenance works of
improvement and appurtenances, and said parcels are hereinafter
numbered to correspond with the numbers appearing on said
attached Diagram.
The assessment parcels herein may refer to the County Assessment
Roll for a description of the lots or parcels, in which case
that Roll shall govern for all details concerning the descrip-
tion of the lots or parcels. '• .
The net amount to be assessed upon the lands may be apportioned
by any formula, and, in my opinion, as City Engineer, said
formula and apportionment is in direct proportion to the esti-
mated benefits to be received from the maintenance works of
improvement.
Where, and if applicable, different zones for different areas
of benefit have been established, a different method of spread
will be used for differing degrees of benefit.
This Assessment has been prepared pursuant to the "Street
Lighting Act of 1919."

RESOLUTION NO. 5797
RESOLUTION OF THE CITY COUNCIL PROVIDING
FOR THE ANNUAL LEVY OF ASSESSMENTS FOR A
STREET LIGHTING DISTRICT.
WHEREAS, this City Council has previously initiated and conducted
proceedings for the formation of a street lighting district in
said City under the terms and provisions of the "Street Lighting
Act of 1919", being Division 14, Part 1 of the Streets and High-^-
ways Code of the State of California, said street lighting district
having been designated as ., • •
STREET LIGHTING DISTRICT NO. 1
(hereinafter referred to as the "Street Lighting District"); and,
WHEREAS, at this-time, this City Council is desirous, pursuant to
the provisions of Section 18090 of the Streets and Highways Code
to provide for the annual levy of the assessment in the same manner
and on the same lots or parcels of land the respective assessment
costs to pay the cost of annual maintenance for the street lighting
improvements to be maintained within said Street Lighting District;

WHEREAS, at this time there has been presented to the City Council
a "Report", setting forth the following: •
A. An estimate of the costs and expenses for maintaining
the improvements for the ensuing fiscal year;
B. A diagram showing the Street Lighting District and
boundaries of said parcels; ,
C. A schedule showing the proportionate amount of
. assessments to be charged in relation, to benefits
received by each lot or parcel within the boundaries
of the proposed Street Lighting District. ' '•
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE, .
CITY OF CARLSBAD
CALIFORNIA, AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That this City Council hereby levies the annual
assessment for the Street Lighting District pur-
suant to the schedule as submitted herein showing
the proportionate amount of the assessment to be
charged in proportion to the benefits to be re-
ceived by each lot or parcel shown on the diagram
as presented to this City Council.
SECTION 3. That this levy and confirmation of assessment as
hereby made by this City Council covers the period
commencing on the 1st day of July, _ 1979 _r
and ending on the 3Qth daY of June... _19Rf)
SECTION 4. Upon the levy of this assessment, the City Clerk
is hereby directed to transmit a copy of the annual
assessment to the County Auditor and County Tax
• Collector. A certified copy of the assessment dia-
gram and schedule of individual assessments shall
also be on file in the Office of the City Engineer,
with a duplicate copy on file in the Office of the
City Clerk.
