S U B J E C T : CONSTRUCTION OF STREET RESTORATION IMPROVEMENTS IN PORTIONS .OF TAMARACK AVENUE, EL CAMINO REAL AND PALISADES DRIVE - COh'TRACT NO. 1066
STATEMENT OF MATTER
On May 23, 1979, the City Clirk opened bids for restoration of storm
damaged streets on Tamarack, El Camino Real and Palisades Drive. Two bids were received, both of which were substantially in excess of the Engineer's estimate.
The primary di-Eficulty in getting a responsive bid for the project is the unknown involved in bid items 10, 11, and 12 which involve cleaning and restoring the storm drain.
Engineering staff has cdntacted a contractor who has special expertise in storm drain cleaning and believes this portion of the work can be accomplished at a cost much less than the bid price.
The California Code (Title 4, Division 3, Part 2, Chapter 6)"provides that Open-Market Purchase procedures may be utilized when all bids are rejected. The Council must approve the use of Open-Market procedures by four-fifths vote.

RECOMMENDATION
If Council concurs, adopt Resolution No. JfOd/ rejecting all bids and authorize the use of the Open-Market proce ure for accomplishment of the restoration project.
Council Action:
4-5-79 Council directed the City Attorney to prepare Resolution No. 5801 , accepting the bid of the Griffith Co. of San Diego, and authorizing the execution of the contract for construction of improvements called for in Contract No. 1066.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE EXECUTION OF
CONTRACT NO. 1066 FOR CONSTRUCTION OF STREET RESTORATION
IMPROVEMENTS IN PORTIONS OF TAMARACK AVENUE, Et CAMINO REAL
AND PALISADES DRIVE
WHEREAS, bids have been received by the City of Carlsbad for the con-
struction of street restoration improvements in portions of Tamarack Avenue,
El Camino Real and Palisades Drive, Contract No. 1066; and
WHEREAS, the low bid received for this construction was submitted by the
Griffith Company in the amount of $44,152.50; and
WHEREAS, funds are avai lable in Account No. 1-125-2450 for this project;
as follows: NOW, THEREFORE, BE IT RESOLVED by the City Counci
1. The above recitations are true and correct.
2. The bid of $44,152.50 by the Griffith Company
for the construction of street restoration improvements
for Contract No. 1066
in port:lons of Tamarack
Avenue, El Camino Real and Palisades Drive is hereby accepted, and the Mayor
and City Clerk are hereby authorized to execute a contract therefor.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad
