Certain properties within the City of Carlsbad have been identified as t ing weeds
and rank growth thereon. A list of the names of property owners, addres~es, and
parcel numbers has been compiled and is on file in the City Clerk's office.
The Carlsbad Girls Club has requested the City to absorb the cost for
weed abatement on their property at 3368 Eureka Place. Council may
wish to consi~er their request at this time.

REC0MMENUATION
If Council concurs, adopt Resolution No.~ to accomplish the following:
1. That City Council establish June 13, 1979 at 6:P00 1 clock p.m. as the
Public Hearing meeting to hear objections to the declaration .of
referenced list of parcels_a5 public nuisance.
2. That staff be authorized to notify the owners ·of the r~ferenced list
of parcels of the public meeting.
3. If Council wishes to take some action relative to the
Girls.Club Request, they should do so at this time.

SUBJECT: Status qeport; Weed Abatement 1979

512 parcels were identified as potential abatement ,,roblems by visual
inspection in early March. A letter, attached, was ~ent to the owners
of these parcels in early May explaining the Weed Ab~tement Program
and information relating to fees, etc. A postcard was also included
to facilitate the owners advising us of what action they intended to
take. A total of 57 parcel owners have indicated that the City should
abate the parcel and they will pay the $10 administrative fee. 170
parcel owners have completed abatement efforts at their own expense at
this time. We have received no information or abatement has not yet
been accomplished on 285 parcels at this time and will require official
noticing as a nuisance.
Council will hear objections to this declaration at their meeting of
June 19. Abatement by the City can proceed after that date. The
attached list includes those parcels that will be declared a nuisance
by Council at the June 5 meeting.

The City of Carlsbad has conducted a survey of all parcels having weed growth
which may become a fire or health hazard by early summer. Parcel number as
noted on mailing label, of which you are the owner of record, is one of those
parcels which poses this potential hazard.
Your parcel should be cleared of weeds no later than June 4, 1979 to preclude
them being declared a public nuisance by the City Council at their meeting of
June 5. You may abate these weeds yourself, or contract for the service. Note
enclosed contractors list which you may contact to have the weeds cut prior to
June 4. I have also included a postcard which you may return should you prefer
that the City make ar.·angements for the abatement of your property, 't'OU WIU. BE

The Carlsbad Girls Club has received a notice from the City
to comply with the weed abatment program on our property
at 3368 Eure~a Place.
The Girls Club is a non-profit organization, and does not
receive revenue from United Way, We derive our funds from
the community and fund-raisers. Our budget expenditures
are very specific, and currently it would be a financial
strain to remove the weeds.
For this reason, we would like to request that the City
perform the service of weed ren:oval free of charge. After
the weeds are cleared, the Club Will continue With regular
maintenance. Your support and cooperation would be of great
value to our agency. Please contact rr.e at 729-2032 for
further information.

RESOLUTION NO. 5802
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY. OF CARLSBAD DECLARING AS PUBLIC
NUISANCES, RUBBISH AND REFUSE UPON PRIVATE
PROPERTY IN THE CITY OF CARLSBAD.
The City Council of the City of Carlsbad does hereby resolve as
follows:
1. That this resolution, and all action taken subsequent
hereto in connection herewith, is taken pursuant to the pro-
visions of California Government ·code Section 39560, et seq.
(Article 2, Alternate Procedures Under Chapter 13, Weed and
Rubbish Abatement).
2. Words used in this resolution and its subsequent action in
12 connection herewi'th shall be defined as outlined in said Code
13 Sections.
14 3. The City Council of the City.of Carlsbad hereby declares
15 I as public nuisances rubbish and refuse upon those vertain parcels
16 of private property in the City of Carlsbad desc:,ibed on Exhibit
17 "A", attached hereto, and by this reference incorporated herein.
18 4. The City Council of the City of Carlsbad hereby declares its
1~ intention to cause the removal of said rubbish and refuse. A
20 Public Hearing will be held in the City Council Chambers at 1200
21 Elm Avenue, Carlsbad, California on June 19, 1979 at 6:00 o'clock
22 p.m., to consider objections of property owners to said proposed
23 removal of rubbish and refuse.
24 5. The City t!lerk of the City of Carlsbad is hereby directed to
25 mail written notices of the proposed abatement of said nuisances
26 to all perso?ls owning property des er ibed in this resolution.
