DECLARING RESULTS OF THE SPECIAL MUNICIPAL
ELECTION OF JUNE 5, 1979
Statement of the Matter
Canvassing of the ballots was completed by the City Clerk on
June 8, 1979, and the results have been certified.
Exhibit:
1. Resolution No. 5803.
Recommendation:
Adopt Resolution No. 5803, reciting the fact of a Special
Municipal Election held in the City of Carlsbad on the 5th dag of
June, 1979, declaring the results thereof, and such other matters as
are provided by law.

RESOLUTION NO. 5803
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, RECITING THE FACT OF A
SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON
THE 5TH DAY OF JUNE, 1979, DECLARING THE RESULT
THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED
BY LAW
WHEREAS, a Special Municipal Election was held and conducted
in the City of Carlsbad, County of San Diego, State of California,
on Tuesday, the 5th day of June, 1979, as required by law; and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by law, that voting
precincts were properly established, that election officers were
appointed and that in all respects said election was held and
conducted and the votes cast thereat, received and canvassed and
the returns made and declared in time, form and manner as re-
quired by the provisions of the Elections Code of the State of
California for the holding of elections in cities; and
WHEREAS, pursuant to Section 22932.5 of the Elections Code
of the State of California, City Council Resolution No. 5727,
adopted the 20th day of March, 1979, authorized the City Clerk
of the City of Carlsbad to canvass the returns of said election; an
WHEREAS, pursuant to the Elections Code said canvass has
been completed by the City Clerk of the City of Carlsbad, who
has certified the results to this City Council, said results
are attached and made a part hereof as "Exhibit A".
NOW, THEREFORE, the City Council of the City of Carlsbad,
California, does resolve as follows:
1. That the above recitations are true and correct.
2. That at said Special Municipal Election, the following
1 measure was submitted to the electors of said City, to wit:
2 "Shall Ordinance No. 6059 be adopted amending Title
5 of the Carlsbad Municipal code by the addition of
3 chapter 5.09 to impose a license tax on all new con-
struction in the city for the purpose of providing
4 public facilities?"
5 3. That the whole number of votes cast in said City was
6 4,540.
7 4. That the measure voted upon at said election is as
8 follows:
9 "Shall Ordinance No. 6059 be adopted amending Title
5 of the Carlsbad Municipal code by the addition of
10 chapter 5.09 to impose a license tax on all new con-
struction in the city for the purpose of providing
11 public facilities?"
12 5. That the number of votes given at each precinct for
13 and against the measure were as listed in "Exhibit A" attached.
14 6. That as a result of said election, a two-thirds (2/3)
15 majority of the qualified voters voting on said measure did not
16 vote in favor thereof, and that said Proposition was not carried,
17 and shall not be deemed adopted and ratified.
18 7. The City Clerk shall enter on the records of the City
19 Council of said City, a statement of the result of said election,
20 showing:
21 (1) The whole number of votes cast in the City;
22 (2) The measure voted upon;
23 (3) The number of votes given at each precinct
24 for and against each measure;
25 (4) The number of votes given in the City for
26 and against each measure.
27 8. That the City Clerk shall certify to the passage and
28 adoption of this Resolution, shall enter the same in the book of

original Resolutions of said City; and shall make a minute of the
passage and adoption thereof in the records of the proceedings
of the City Council of said City, in the minutes of the meeting at
which the same is passed and adopted.
PASSED, APPROVED AND ADOPTED at an Adjourned Regular Meeting
of the Carlsbad City Council, held on the 12th day of June, 1979
by the following vote, to wit:
AYES: Councilman Packard, Anear and Lewis
NOES: None
ABSENT: Councilman Skotnicki and Cojjjacil woman Casler
