SUBJECT: CT 76-17 (CANON PARK)
ACCEPTANCE OF PUBLIC IMPROVEMENTS
STATEMENT OF.MATTER
The developer has requested acceptance of the secured public improvements included
within CT 76-17. City staff has determined that public improvements are acceptable,
as built drawings are on file in the Engineer's Department, and final accounting
is complete.
The developer has also requested the release of certain bonds and agreements for the
. installation and maintenance of an erosion control system, as required under Con-
dition 13 of the Planned Unit Development No. 7 approved by the City Council on
2-1-77, per Resolution No. 4081. The condition states that the bonds are to be held
until permanent landscaping is installed and maintained. Presently only Phase I and
a portion of Phase II have complied with this condition. The rest of Phase II and
all of Phase III have not been built on or landscaped due to the imposition of the
Leucadia County Water District Sewer Moratorium. -
As a result of the partial completion of the building construction within this
subdivision it is anticipated that a number of sidewalks, driveway approaches, and
curbs will be broken when sewer becomes available and housing construction resumes.
The Engineering Department will attempt to mitigate this problem by requiring the
contractor to post a cash bond with the City to cover public improvement repairs
prior to the issuance of a building permit.

RECOMMENDATIONS
If Council concurs, they should accept the improvements as completed and direct the
Utilities/Maintenance Director to commence their maintenance, the Finance Director
to close out the trust account, and the City Clerk to release bonds for public
street improvements.
If City Council further concurs, they should direct the City Clerk to release the
Erosion Control Bond for Phase I and authorize the reduction of the Phase II and III
Faithful Performance and Labor and Materials Bonds from $56,000 and $28,000 to
$10,000 and $5,000, respectively,
