Statement of the Matter
The City Council, at your meeting of June 5, 1979, directed
the City Attorney to prepare the necessary documents
approving Precise Development Plan 1. A resolution in that
regard is attached.

2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
3 WITH CONDITIONS PRECISE DEVELOPMENT
PLAN 1 FOR THE EXPANSION OF THE
4 ENCINA WATER POLLUTION CONTROL FACILITY
(FROM 13.75 TO 18 MGD) AND UPGRADING
5 TO SECONDARY TREATMENT IN ORDER TO
COMPLY WITH FEDERAL AND STATE, ON
6 PROPERTY GENERALLY LOCATED WEST OF
1-5 BETWEEN POINSETTIA LANE AND
7 PALOMAR AIRPORT ROAD. - APPLICANT:

9 WHEREAS, on May 9, 1979 the Carlsbad City Planning
10 Commission adopted Resolution No. 1514 recommending to the
11 City Council that Precise Development Plan 1 be conditionally
12 approved; and
13 WHEREAS, the City Council of the City of Carlsbad on
14 June 5, 1979, held a public hearing to consider the
15 recommendations of the Planning Commission and to receive .
16 all recommendations and hear all persons interested in or
17 opposed to Precise Development Plan 1; and
18 WHEREAS, an Environmental Impact Report was certified as
19 complete for a previously issued entitlement for this project,
20 and the Planning Director has found the Precise Development
21 Plan 1 to be in prior compliance with the City of Carlsbad
22 Environmental Protection Ordinance of 1972; and
23 NOW, THEREFORE, BE IT RESOLVED by the City Council of
24 the City of Carlsbad as follows:
25 A. That the above recitations are true and correct.
26 B. That the findings of the Planning Commission in
.27 Resolution No. 1514 constitute the findings of the City
28 Council in this matter.

C. That said Precise Development Plan, together with
the provisions for its design and improvement and subject
to the conditions of this resolution, is consistent with all •
applicable general and specific plans of the City of Carlsbad.
D. That Precise Development Plan 1 is hereby approved
subject to all applicable requirements of the Carlsbad
Municipal Code and to the satisfaction of the following
conditions:
1. Development of the site shall occur as shown
on PDP-1 Exhibits A and B, dated April 11, 1979, and
Exhibit D, dated April 9, 1979; except for modifications
that are contained herein, and minor modifications approved
by the Public Works Administrator.
2. In addition to the approval of the development
indicated in the exhibits noted in Condition No. 1, all other
requirements listed in this approval shall be indicated .on
I the final Precise Development Plan.
3. Grading plans shall be approved by the Public
Works Administrator or his designee, prior to the issuance
.of a building permit. Said plans shall include provisions
to limit grading to the.minimum area necessary for construction
of the facilities. .
4. Surfaces shall be graded to direct runoff toward
designed drainage facilities and away from cut and fill slopes.
5. Land shall not be cleared of vegetation except
immediately before grading, and all slopes shall be established
for erosion control immediately upon completion of such
grading. Native vegetation shall be retained wherever
feasible.
6. Landscape and irrigation plans shall be submitted
for the entire facility and subject to the approval of the
Planning Director. The landscaping shall be designed to
screen facilities from views along 1-5, and surrounding
properties. Plans shall include fast growing tall trees, as
well as a combination of shrubs and ground cover. Plants
shall be drought tolerant to the maximum extent feasible, and
fire retardant where necessary. Said landscape and irrigation
shall be installed immediately upon completion of construction
except that all screening landscaping-shall be installed
upon completion of grading, prior to any construction.

7. A noise study shall be performed by a qualified noise
expert in order to establish acceptable noise levels at
the property line of the treatment facility. Based on this
study and subject to the approval of the City Engineer, all
noise, producing mechanisms and facilities shall be shielded -
and buffered in such a manner so as to reduce noise levels
to the acceptable level.
8. All influent wastewater shall be pretreated in order
to remove odors. * In addition,.the screening structures, grit
removal tanks, primary sedimentation tanks, and all open
channels, including primary effluent channels, shall be
covered and ventilated in order to remove odors.
9. Odor removal towers are required and shall be
delineated on the final Precise Development Plan, subject
to the approval of the Public Works Administrator.
10. Fire hydrants shall be placed on the site as required
and approved by the Fire Marshal.
11. All necessary public improvements shall be installed
subject to the approval of the City Engineer. Said improvements
shall include the extension of the existing 10" water line
along Avenida Encinas, from the northerly boundary of the
treatment facility to its southerly boundary.
12. All storm drain and channel designs shall be subject
to the approval of the City Engineer.
13. The placement of equipment'on any roof tops shall
be screened from views along 1-5 and from adjacent properties
and subject to the approval of the Planning Director.
14. All lighting shall be designed in a manner that will
not adversely affect nearby residences or public roadways.
A lighting plan shall be subject to the approval of the
Planning Director.
15. Upon approval, the applicant shall submit a
reproducible copy of the Precise Development Plan which
incorporates all requirements of the approval to the City
Manager for signature. Pr,ior to signing the final Precise
Development Plan, the City Manager shall determine that all
applicable requirements have been incorporated into the plan
and that all conditions of approval have been satisfactorily
met or otherwise guaranteed. The final signed Precise
Development Plan shall be the official site layout plan for the
property and shall be attached to any application for a
building permit on the subject property.
16. Special provisions to control dust which is generated
by grading activities shall be approved by the City Engineer
prior to commencement of grading.

17. A "sludge disposal alternative" study shall be
prepared by a qualified person, and subject to the approval
of the Public Works Administrator or his designee. The
most feasible sludge disposal alternative which would reduce
the greatest number of negative impacts shall be incorporated
into the subject project.

the Carlsbad City Council held on the 19th day of June ,
