APPLICAN'I': DUPPY Statement of the Matter The City Council, at your meeting of June 5, 1979, directed the City Attorney to prepare the necessary documents approving Tentative Subdivision Map (CT 79-5) and Condominium Permit (CP-4). RESOLUTION NO. 5807 A RESOLUTION OF THE CITY COUrirCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING FOR A 24-UNIT CONDOMINIUM PROJECT AND APPROVING CONDOMINIUM PERMIT (CP-4) FOR SAID PROJECT ON 1-13 ACRES, GENERALLY LOCATED ON THE NORTH SIDE OF LA COSTA AVENUE, BETWEEN EL CAMINO'REAL AND VIEJO CASTILLO WAY. APPLICANT: R. A. DUFFY. WITH CONDITIONS TENTATIVE MAP (CT 79-51 WHEREAS, on May 23, 1979, the Carlsbad Planning Commission adopted Resolution No.1521 recommending to the City Council that Tentative Map (CT 79-5) and Condominium Permit (CP-4) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on June 5, 1979 held a public hearing to consider the recommendations of the Planning Cornkission and to receive all recommendations and hear all persons interested in or opposed to Tentative Subdivision Map (CT 79-5) and Condominium Permit (CP-4) : and WHEREAS, said Tentative Subdivision Map and Condominiu Permit have been declared to have a nonsignificant impact o the environment and a Negative Declaration has been prepare and filed in compliance with the requirements of the City of Carlsbad Environmental Protection'Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct, B. That the findingsof the Planning Commission in Resolution No. 1521 constitute the f'indings of the City Cou in this matter. C. That Tentative Map (CT 79-5) and Condominium Permit (CP-4) aore hereby approved subject to all applicablc * requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. Approval is granted for CT 79-5/CP-4 as describe1 in the applications, and any attachments thereto as shown on the site plan for CT 79-5/CP-4, labe Exhibit A, dated May 1, 1979, on file in the Planning Department and this project shall be developed as shown on Exhibit A. Final landscape and irrigation plans indicating recreational areas and facilities shall be submi and approved prior to issuance of a final map, These improvements shall be installed prior to final occupancy. All units shall be served with independegt utili systems and shall be separately metered in accorc ance with provisions of the Condominium Ordinancc 2. - 3. 9 4, Water service shall be provided by the Carlsbad Municipal Water District (CMWD) - The applicant shall comply with the rules and regulations of the CMWD regarding water service to condominiums Should extensions to the existing public water system be deemed appropriate by CMWD, the developer will be required to provide the complete system. The developer will be required to pay park-in-lic fees to the City as required by the Director of Parks and Recreation prior to approval of the final map. The applicant will provide school fees to mitigate conditions of overcrowding as part to be based on the fee schedule in effect at the time of issuance of the building permits. These fees 9, This subdivision is approved on the express .condition that the final map shall not be approt unless the City Council finds, as of the time of such approval, that-sewe: service is available t serve the subdivision and that building permits will not be issued for development on the subjec property unless the City Engineer determines tht sewer facilities are .available at the time of application for such permit and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not applicable, building permits will not be issued until arrangements, satisfactory to the City Counkil, can be made to guarantee that all necessary sewer facilities will be available prior to occupancy. The developer must receive the approval of the City Engineer for the improvement plans, enter into the appropriate improvement agreement, and post the required security for the construction of public improvements prior to the recordation of the final map. 15. In order to provide for reasonable fire protectio during the construction phase, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with requir fire flows shall be installed as recornended by 16. the Fire Department 17.
