STATEMENT OF THE MATTER:
The subdivision, The Seaport, along the west side of El
Camino Real, north of Batiquitos Lagoon is complete except
for the last phase of development, (Phase 5). This last
phase is approved presently as CT 76-7, but not yet finaled
The subject revision to this subdivision is to provide for
a new alignment of Arenal Road extension and modification
of interior residential streets. However, there is no
change in total number of residential lots previously
established by CT 76-7.
Staff and the Planning Commission found that the subject
revision is an improvement in a circulation system for
this area and therefore recommended approval.
In this recommended approval, staff and the Planning
Commission revised conditions of the original tract to
meet present standard wording and present requirements..
However, there is no change to the context of the original
approval except for the street modifications as requested.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING AP-
PROVAL OF A REVISION TO PREVIOUSLY APPROVED
SUBDIVISION CT 76-7 (RANCHO LA QUESTA PHASE 5,
THE SEAPORT).

WHEREAS, a verified application for certain property, to wit:
The south % of Section 26, Township 12 South,
Range 4 West, San Bernardino Base, excepting
therefrom that portion lying East of the West line
of Road Survey 1800-1 (El Camino Real) and the
West h of the Southwest % of Section 26,
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, an Environmental Impact Report (EIR-106) has been
certified for the previous entitlement (CT 72-34), which includes
Phase 5, and said project (CT 79-4) has been found to"be in
prior compliance with the Carlsbad Environmental Protection
Ordinance; and
WHEREAS, the Planning Commission did, on the 27th day of
June, 1979, hold a duly noticed, public hearing as prescribed by
law, to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering
the testimony and arguments, if any, of all persons who desired
to be heard, said Commission considered all factors relating to
the Carlsbad Tract (CT 79-4) and found the following facts and
reasons to exist:
1 1) The proposed map is consistent with the General Plan since
the project's density falls within the range allowable under
2 the current General Plan land use designations.
5 2) The design and improvement of the proposed subdivision is
consistent with the General Plan since:
4 a) The map revisions will enhance circulation within the
5 subdivision.
6 b) The proposed circulation system will adequately handle
traffic generated by the subdivision.

3) The proposed tentative tract map is consistent with applicable
8 City Public Facilities Policies and Ordinances because:
9 a) The Planning Commission finds that sewer service is not
available for this development as of the date of the
10 approval. However, sewer service may be available in the
future. The Planning Commission will by inclusion of an
11 appropriate condition to this Tentative Subdivision Map
approval, insure that the final map will not be approved
12 unless the City Council finds that sewer service is
available to serve the project. In addition, the
13 Planning Conmsssion will add a condition that a note
be placed on the final map providing that building
14 permits for lots in the subdivision unless the City
Engineer determines that sewer service is available.
15 Since.the final map cannot be approved unless sewer
service is available and building cannot occur within
16 • the subdivision unless sewer service remains available,
the Planning Commission is satisfied that the
17 requirements of the Public Facilities Element of the
General Plan have been met insofar as they apply to
18 this Tentative Subdivision Map approval.
19 b) All other public facilities are available or will
be required by conditions of approval.

4) The site is physically suitable for the type and density of
21 development since the site is adequate in size and shape to
accommodate residential development at the proposed densities.

5) The design of the subdivision and required improvements will
23 not cause any substantial environmental damage or, sub-
stantially and avoidably injure fish or wildlife or their
24 habitat since:
25 a) The project has been found to be in prior compliance
with a previously certified environmental impact report
26 (EIR-106) since it will result in only minor street
modifications and require less grading.

b) Adequate mitigation measures to reduce environment
28 impacts are required as part of the project.

c) The map revision would reduce the amount of grading
necessary.
The design of the subdivision and type of improvements will
not cause any serious public health problems since the
project will be developed according to City Codes and stand-
ards.
The design of the subdivision and type of development will
not conflict with easements acquired by the public at large
for access through or use of the property within the sub-
division since no public easements exist on the property at
this time.
The remaining time to the expiration of this tentative map
shall be set at 324 days from the lifting of the sewer
moratorium pursuant to Section 20.12.100 of the Carlsbad
Municipal Code.
WHEREAS, the Planning Commission by the following vote
APPROVED CT 79-4, subject to certain conditions:
The approval is granted for the portion of land described in
the application, and as shown on Exhibit "A", CT 79-4, dated
6/5/79, on file in the Planning Department.
The applicant shall ensure adequate noise attenuations for
all portions of the site subject to ambient noise levels in
excess of 65 dB(A), subject to the approval of the Planning
Director and in accordance with the noise element of the
General Plan.
Park-in-lieu fees shall be paid to the City of Carlsbad for
park purposes as required by the Parks and Recreation,Director
All areas within the subdivision shall be designated as a
legal lot or public right-of-way.
All utilities, including provisions for Cable TV, shall be
placed underground and/or completely concealed from view.
At the time of filing for a final map, the applicant shall
provide the Planning Director with a list of at least three
alternate street names for the proposed street currently
labeled "Wisteria Court" on Exhibit A, dated 6/5/79. These
street names shall conform with the current City Council
policy regarding names.
All other street names shall be designated concurrent with the
final map filing, in accordance with the adopted City street
name ordinance and subject to the approval of the Planning
Director.

1 7. Minimum 15 gallon street trees shall be planted on all
streets. Said trees shall be of a variety listed on the
2 current tree list, and planted at a standard of no less
than one tree per forty feet.
3 8. In order to provide for reasonable fire protection during
4 the construction period, the subdivider shall maintain passabl
vehicular access to all buildings, and adequate fire hydrants
5 with required fire flows shall be installed as recommended by
the Fire Department.

9. Additional right-of-way shall be dedicated and street improve-
7 ments made to provide a standard 126 foot street section
including a Class II (striped) bike land for El Camino Real
8 from the northern boundary of the subdivision to Arenal Road.
The.subdivider shall also provide for the dedication and
9 improvement of a transitional section of roadway from Arenal
Road southward bound on El Camino Real to the satisfaction
10 of the City Engineer.
11 10. All public improvements shall be made in conformity to the
City of Carlsbad Engineering Design Criteria and Standard
12 Plans, the Subdivision Ordinance and other City standards
approved by the City Engineer, without cost to the City of.
13 Carlsbad, and free of all lien-s and encumbrances. All improve
ment plans for water and sewer system shall meet the require-
14 ments of the respective service districts.
15 11. The storm drainage shall be designed per the requirements of t
City Engineer and the San Diego County Flood Control District.
16 The final storm drain design shall be in substantial confor-
mance with the storm drain system as shown on Exhibit "A",
17 dated 6/5/79.
18 12. All drainage easements shall be improved by a culvert or
drainage channel of adequate size, whichever is required
19 by the San Diego County Department of Sanitation and Flood
Control. Where a drainage channel is required, such channel
20 shall be lined with a suitable material as specified by the
County Department of Sanitation and Flood Control. An access
21 easement shall be provided to each drainage system mainten-
ance access point directly accessible from a public road-
22 way. Said access easement shall be paved and aligned to the
satisfaction of the County Department of Sanitation and
23 Flood Control and the City Engineer.
24 13. Additional drainage easements and drainage structures shall
be provided or installed as may be required by the County
25 Department of Sanitation and Flood Control and/or the City
Engineer.

14. A desilting basin, within an adequate easement, and designed
27 to the satisfaction of th£ County Department of Sanitation
and Flood Control and the City Engineer will be required at
28 the outlet of the major drainage facility.

1 15. The subdivider shall post a separate grading and erosion
•control bond for the construction and maintenance of the
2 desiltation basin. Upon acceptance of the public improve-
ments for this subdivision the developer shall substitute a
3 sufficient bond, as determined by the City Engineer, for the
continued maintenance and eventual removal of the desiltation
4 basin. This bond shall be retained by the City until such
time as the City Engineer determines the slopes have been
5 satisfactorily stabilized and the desiltation basin has
either been removed or is accepted for maintenance by the City
6 pursuant to the recommendation of the master drainage plan
presently being compiled for the City.

16. All drainage and grading plans shall be submitted to the
8 City Engineer for approval. Cut and fill slopes shall be
a maximum of 2:1.

17. Immediately upon the completion of grading, all slopes
10 within the crosshatched area, as indicated on Exhibit "A" of
CT 79-4, dated 6/5/79, shall be stablized by hydroseeding,
11 mulching and fertilization.
12 18. The hydroseed mix shall be designed by an expert in the
field and shall be subject to .the approval of the Parks and
13 Recreation Director. The seed mix shall be designed so as
to include the maximum number of native plant species as
14 feasible, without reducing the effectiveness of the erosion
protection. The contractor shall submit proof of plant
15 species and quality of seed mix.
16 19. The hydroseeding, mulch and fertilization design shall be
determined by an expert in the field, based on a soil
17 analysis of the slopes taken at a maximum interval of 500
feet. In no case shall the mulch be applied at less than
18 2000 Ibs/acre or the fertilizer at less than 1000 Ibs/acre.
19 20. The developer shall obtain the approval of the Planning
Director for a detailed landscape and irrigation plan prior
20 to final map approval. The irrigation system shall be
installed immediately upon completion of rough grading.
21 The irrigation plan shall provide for temporary water con-
nections to be made prior to the installation of the required
•22 subdivision improvements.
23 21. All land and/or easements required shall be granted to the
City of Carlsbad without cost to the City, and free of all
24 liens and encumbrances. No easements shall be recorded prior
to recordation of each final map unless approved by t he City
25 Engineer.
26 22. Arenal Road shall be dedicated and improved on the basis of
a full 84 foot street section including a Class II bike lane,
27 in conformance with the circulation element of the General
Plan. Improvements shall be constructed from El Camino Real

to the west side of Columbine Drive subject to the approval
of the City Engineer. Dedication shall be for the entire
.Arenal Road within the subdivision boundary, and the
applicant shall provide off-site street right-of-way when
the street overlaps to the south boundary of the subdivision.
Dedication of Arenal Road shall include a waiver of direct
access rights from all lots shown on the final map abutting
thereon.
The applicant shall dedicate a 20 foot open space easement alo
the bank at th rear of lots backing up to El Camino Real.
The development of the property described herein shall be
subject to the restrictions and limitations set forth herein
which are in addition to all the requirements, limitations
and restrictions of all municipal ordinances and state and
federal statutes now in force, or which, hereafter, may be
in force, for the purpose of preserving the residential
characteristics of adjacent properties.
The applicant shall provide adequate methods of dust control
conforming to the City of Carlsbad's standard specifications
during all phases of construction.
Prior to the recordation of the final map, the subdivider
shall enter into a secured agreement for the completion of
one quarter of the cost of a traffic signal at the intersectio
of Arenal Road and El Camino Real.
Fire hydrants shall be installed at locations and with flow
rates approved by the Fire Chief or his representative.
This subdivision is approved on the express condition that the
final map shall not be approved unless the City Council finds
as of the time of such approval that sewer service is availabl
to serve the subdivision.
This subdivision is approved upon the express condition that
building or grading permits will not be issued for development
on the subject property unless the City Engineer determines
that sewer facilities are available at the time of application
for such permit and will continue to be available until time
of occupancy. If the City Engineer determines that sewer
facilities are not available, building permits will not be
issued.
This Tentative Subdivision Map shall be subject to any
further approval as may be necessary in connection with
such plan for the allocation of sewer service among competing
uses as the City Council may adopt. If an allocation plan is
adopted prior to final map approval, the applicant shall
satisfy the requirements of such plan as a further condition
of this Tentative Subdivision Map approval.

BACKGROUND
Location and Description of Property
The subject property is located adjacent to the west of El Camino
Real, north of the Batiquitos Lagoon. The 15 acre site is currently
vacant, with some signs of fill and grading activity. The land
consists of relatively steeply sloping hills and valleys, with
drainage courses that empty into the Batiquitos Lagoon. Phases
1-4 of CT 72-34 have been developed and border the subject property
to the north.

General Plan Information
The City's General Plan Land Use Element designates the subject
property for both low-medium density (O-4 du/ac) and medium
density (4-10 du/ac) residential development. The proposed 45
unit tract would result in a density of 3 du/ac, which is con-
sistent with the General Plan.
Environmental Impact Information
An environmental impact report, EIR-106, has been certified for
the previous entitlement (CT 72-34), which includes Phase 5.

Since CT 79-4 involves only minor street modifications and, as
a result, less grading, the project has been found to be in
prior compliance with the Carlsbad Environmental Protection
Ordinance.
Public Facilities
Although sewer is not available for the Phase 5 units, the City's
Planning Moratorium Ordinance allows applications for revisions
of an approved tentative subdivision map, if no additional sewer
capacity is required.
Park-in-lieu fees have been paid for Phases 1 through 4 of the
subdivision. Phase 5, however, has yet to be assessed for such
fees. Also, an agreement regarding school fees covering all phases
of the subdivision has been reached with the Carlsbad Unified School
District.
History and Related Cases
CT 72-34: City Council Resolution No. 3180 approving a tentative
map for 278 single-family lots, 100 duplex condominium lots, and
3 commercial lots (approved August 7, 1973) .
CT 72-34 included Phases 1 through 5 of the Rancho La Questa
(Seaport) subdivision. This tentative map has received two
extensions, due to litigation with the California Coastal Commission.
Under the last extension, the applicant was directed to instigate a
zone change in order to bring a multi-family residential boundary,
shown on the original CT 72-34, into alignment with the established
zoning boundary shown on the City Maps. The applicant elected to
change the multi-family residential area to single-family (R-l)
zoning.
ZC-179: City Council Ordinance No. 9457, approving a zone change
over 48 acres from RD-M to R-l, approved June 15, 1976.
This ordinance allowed a zone change from multi-family residential
to single family, over a portion of the subject property.
CT 76-7: City Council Resolution No. 3998 approving a 45 lot
subdivision (Phase 5) of Rancho La Questa, approved September 7,
1976.
CT 76-7 was submitted in order to keep the tentative map for
Phase 5 valid, since only Phases 1 through 4 were finalized under
CT 72-34. This was necessary in the event that sewer easements
for Phase 5 were not acquired in time, and thus the tentative
map might then expire before final map approval. It should be

noted that CT 76-7 applied only to Phase 5, and made no changes
in this phase as previously approved under CT 72-34.
Major Planning Considerations
1) Does the proposed street revisions enhance circulation within
the subdivision, and reduce potential traffic conflicts?
2) Is the proposed extension and alignment of Arenal Road
consistent with its existing alignment (on the east side of
El Camino Real) , and also with plans for this area?
3) Would the proposed revisions reduce the need for grading,
and thus potential impacts on the lagoon?
4) What off -site improvements should be required for Arenal Road?
DISCUSSION
In order to enhance circulation within the Rancho La Questa
(Seaport) subdivision, the applicant is proposing several revisions
to the previously approved tentative map (CT 76-7}. These revisions
include a minor realignment of the Arenal Road extension, and
modification of interior residential collector streets and cul-de-
sacs. However, there will be no change in the total number of
residential lots previously established by CT 76-7.
Since the Arenal Road extension is designated on the General Plan
as a secondary arterial, reducing points of conflict along this
road is important. CT 79-4 would reduce the number of residential
collector streets which would intersect Arenal Road, from three
to one. Also, the revised map would eliminate the long linear
residential streets which often result in increased traffic speeds.
The County Park Development Division has been contacted regarding
the proposed alignment of the Arenal Road extension since this
road would extend through the proposed North Shore Regional Park.
They have not indicated any adverse reaction to the alignment.
Another important aspect of the project is that it would reduce
the overall amount of necessary grading. This is considered
important given the project's close proximity to the Batiquitos
Lagoon. Under CT 76-7, approximately 100,000 cu. yds. of grading
would have been necessary in order to develop the Phase 5 lots
and the public street system serving them. As a result of the
revisions proposed in CT 79-4, the applicant has indicated that
approximately 5000 cu. yds. less cut and 25,000 cu. yds. less fill
would be required.

Also, an erosion control-desilting basin is being proposed on
the adjacent property which is currently owned by the applicant.
Since Phases 1 through 4 have been previously approved and
developed, it appears as though the basic developmental trend
has been established for the area. Therefore, staff believes
that Phase 5 would be an appropriate extension of this subdivision.
It should be noted that the California Coastal Commission has
approved the project with a condition that the "applicant agrees
to comply with the conditions imposed by the City of Carlsbad in
approval of Tentative Map (CT 76-7) regarding landscaping and,
erosion and siltation control."
STAFF RECOMMENDATION
Staff recommends that the Planning Commission forward a recommendation
of approval of CT 79-4 to the City Council, based on the following
findings and subject to the following conditions:

1) The proposed map is consistent with the General Plan since

a Class II (striped) bike land for El Camino Real from the
northern boundary of the subdivision to Arenal Road. The sub-
divider shall also provide for the dedication and improvement of
a transitional section of roadway from Arenal Road southward
bound on El Camino Real to the satisfaction of the City Engineer.
10. All public improvements shall be made in conformity to the
City of Carlsbad Engineering Design Criteria and Standard
Plans, the Subdivision Ordinance and other City standards
approved by the City Engineer, without cost to the City of
Carlsbad, and free of all liens and encumbrances. All improve-
ment 'plans for water and sewer system shall meet the require-
ments of the respective service districts.
11. The storm drainage shall be designed per the requirements of the
City Engineer and the San Diego County Flood Control District.
The final storm drain design shall be in substantial confor-
mance with the storm drain svstem as shown on Exhibit "A",
dated June 5, 1979.
12. All drainage easements shall be improved by a culvert or
drainage channel of adeouate size, whichever is required
by the San Diego County Department of Sanitation and Flood
Control. Where a drainage channel is required, such channel
shall be lined with a suitable material as specified by the
County Department of Sanitation and Flood Control. An access

easement shall be provided to each drainage system mainten-
tenance access point directly accessible from a public road-
way. Said access easement shall be paved and aligned to the
satisfaction of the County Department of Sanitation and Flood
Control and the City Engineer.
13. Additional drainage easements and drainage structures shall
be provided or installed as may be required by the County
Department of Sanitation and Flood Control and/or the City
Engineer.
14. A desilting basin, within an adequate easement, and designed
to the satisfaction of the County Department of Sanitation
and Flood Control and the City Engineer will be required at
the outlet of the major drainage facility.
15. The subdivider shall post a separate grading and erosion
control bond for the construction and maintenance of the
desiltation basin. Upon acceptance of the public improvements
for this subdivision the developer shall substitute a suffi-
cient bond, as determined by the City Engineer, for the con-
tinued maintenance and eventual removal of the desiltation
basin. This bond shall be retained by the City until such time
as the City Engineer determines the slopes have been satis-
factorily stabilized and the desiltation basin has either been
removed or is accepted for maintenance by the City pursuant
to the recommendation of the master drainage plan presently
being compiled for the City. ;;
16. All drainage and grading plans shall be submitted to the City
Engineer for approval. Cut and fill slopes shall be a maximum
of 2:1.
17. Immediately upon the completion of grading, all slopes
within the crosshatched area, as indicated on Exhibit "A" of
CT 79-4, dated 6/5/79 shall be stabilized by hydroseeding,
mulching and fertilization.
18. The hydroseed mix shall be designed by an expert in the
field and shall be suject to the approval of the Parks and
Recreation Director. The seed mix shall be designed so as
to include the maximum number of native plant species as
feasible, without reducing the effectiveness of the erosion
protection. The contractor shall submit proof of plant
species and quality of seed mix.
19. The hydroseeding, mulch and fertilization design shall be
determined by an expert in the field, based on a soil analysis
of the slopes taken at a maximum interval of 500 feet. In no
case shall the mulch be applied at less than 2000 Ibs/acre or
the fertilizer at less than 1000 Ibs/acre.
20. The developer shall obtain the approval of the Planning Director
for a detailed landscape and irrigation plan prior to final

map approval. The irrigation system shall be installed
immediately upon completion of grading. The irrigation plan
shall provide for temporary water connections to be made
prior to the installation of the required subdivision improvements
21. Prior to consideration of the final map and Improvement Plan, a
grading and plot plan of the tract with all proposed dwelling
units located thereon, and showing appropriate setback dimen-
sions, shall be submitted to the Planning Department for approval
to insure that adequate area requirements can be met.
22. All land and/or easements required shall be granted to the
City of Carlsbad without cost to the City, and free of all
liens and encumbrances. No easements shall be recorded prior
to recordation of each final map unless approved by the City
Engineer.
23. Arenal Road shall be dedicated and improved on the basis of
a full 84 foot street section including a Class II bike lane,
in conformance with the circulation element of the General
Plan. Improvements shall be constructed from El Catnino Real
to the west side of Columbine Drive subject to the approval of the
City Engineer. Dedication shall be for the entire Arenal Road
within the subdivision boundary, and the applicant shall provide
off-site street right-of-way when the street overlaps to the
south boundary of the subdivision.
24. Dedication of Arenal Road shall include a waiver of direct
access rights from all lots shown on the final map abutting
thereon.
25. The applicant shall dedicate a 20 foot open space easement along
the bank at the rear of lots backing up to El Camino Real.
26. The development of the property described herein shall be
subject to the restrictions and limitations set forth herein
which are in addition to all the requirements, limitations
and restrictions of all municipal ordinances and state and
federal statutes now in force, or which, hereafter, may be
in force, for the purpose of preserving the residential
characteristics of adjacent properties.
27. The applicant shall provide adequate methods of dust control
conforming to the City of Carlsbad's standard specifications
during all phases of construction.
28. Prior to the recordation of the final map, the subdivider
shall enter into a secured agreement for the completion of
one quarter of the cost of a traffic signal at the intersection
of Arenal Road and El Camino Real.
29. Fire hydrants shall be installed at locations and with flow
rates approved by the Fire Chief or his representative.

30. This subdivision is approved on the express condition that the
final map shall not be approved unless the City Council finds
as of the time of such approval that sewer service is available
to serve the subdivision.
31. This subdivision is approved upon the express condition that
building or grading permits will not be issued for development
on the subject property unless the City Engineer determines that
sewer facilities are available at the time of application for
such permit and will continue to be available until time of
occupancy. If the City Engineer determines that sewer
facilities are not available, building permits will not be
issued until arrangements satisfactory, to the City Council,
can be made to guarantee that all necessary sewer facilities
will be available prior to occupancy. This condition shall
be noted on the final map.
32. This Tentative Subdivision Map shall be subject to any
further approval as may be necessary in connection with
such plan for the allocation of sewer service among competing
uses as the City Council may adopt. If an allocation plan is
adopted prior to final map approval, the applicant shall
satisfy the requirements of such plan as a further condition
of this Tentative Subdivision Map approval.
